1968-020AN ORDINANCE AMENDING THE CODE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR THE LICENSING OF CERTAIN TEMPORARY OR ITINERANT BUSINESSES, PROVIDING A LICENSE FEE THEREFOR, PROVIDING A PEN- ALTY FOR VIOLATIONS THEREOF, PROVIDING A SAVINGS CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTIQN I That the Code of Ordinances of the City of Denton, Texas, is hereby amended by substituting new Section 20-53 and new Section 20-54 in Chapter 20 of said Code which Sections shall hereafter read as follows Section 20-53 LICENSE - REQUIRED It shall be unlawful for any person to go from house to house, or from place to place, or to set up and operate a temporary or ~t3nerant business wlthln the premises of another bus3ness or any other building or location, in the City, sollcltlng, selling or tak3ng orders for, or offering to sell or take orders for,my goods, wares, merchandise, services, photographs, newspapers, magaz3nes, or subscriptions to newspapers or magazines, w3thout hawng f~rst applied for and obtained a license so to do from the City Secretary Section 20-54 SAME APPLICATION, CONTENTS Any person desiring to go from house to house or from place to place, or to set up and operate a temporary or itinerant bus- iness within the premises of another business or any other build- lng or location, in the City, to sell or sollclt orders for goods, wares, merchandise, services, photographs, newspapers, magaz3nes, or subscr3ptlons to newspapers or magazines, shall make written application to the C~ty Secretary at least seven (7) days prior to the date 3n which such person ~ntends to sell or solicit in the City, for a license so to do, which application shall show the following (1) The name and address of applicant (2) The name and address of the person, firm or corporation ~f any, that he represents and the kind of goods offered for sale (3) Whether such applicant upon any such sale or order shall demand, accept or receive payment or deposit of money in advance of final delivery (4) The period of time such applicant w~shes to sell or sol- iclt in the City (5) Proof that applicant has a proper sales tax permit from the comptroller of the State of Texas (6} Any other reasonable and pertinent information which the City Secretary may require SECTION II ~hat all ordinances or parts ~f ordinances in ~orce when the prows~ons of this ordinance become effective which are consistent or in conflict with the terms or prows~ons confined in this ordinance are hereby repealed to the extent of any such conflict Sections 20-53 and 20-54 as existed prior to the enact- ment hereof are hereby expressly repealed in their entirety SECTION III That if any section, subsection, paragraph, sentence, clause, phrase or word ~n th~s ordinance, or application there- of to any person or c~rcumstance ~s held invalid by any court of competent Jurlsdlctlon, such holding shall not affect the validity of the remaining portions of this ordinance, and the C~ty Council of the C~ty of Denton, Texas, hereby declares ~t would have enacted such remaining portions despite any such ~nval~d~ty SECTION IV It shall be unlawful to violate any prowslon of th~s ordinance, which hereby ~ncorporates Section 20-59 of the Code as ~f set out in full here~n SECTION V That th~s ordinance shall become effective fourteen (14) days from the date of ~ts passage, and the City Secretary hereby d~rected to cause the caption of this ordinance to be published twice ~n the Denton Record-Chronicle w~th~n ten {10) days of the date of its passage PASSED AND APPROVED this~f~/.~day of ~L~ , A D 1968 ATTEST ~, C~ty Secretary C3ty of Denton, Texas APPRO~D AS T~) LEGAL FORM Jack/~Q Barton, City'q~l~torney C~/of Denton, Texas
