1968-018 NO AN ORDINANCE ARENDING THE ZONING RAP OF THE CITY OP DENTON, TEXAS, 1961, AS SARE WAS ADOPTED AS A PART OF PARTS II AND III OF CHAPTER 13 OF THE CODE OF ORDINANCES OF THE CITY OP DENTON, TEXAS, BY ORDINANCE NO 61-19, AND AS SAID RAP APPLIES TO C£RTAIN PROPERTY SITUATED IN CITY BLOCKS 378/A, 373/A, W 1/2 OF 373/B AND 374 AS SHOWN ON THE OFFICICAL CITY I~P OF THE CITY ~OF DENTON, TEXAS, RORE PARTICULARLY DESCRIBED HEREIN, PROVIDING CERTAIN CONDITIONS AND RESTRICITIONS, AND DESCLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the Zoning Rap of the City of Denton, Texas, 1961, adopted as a part of Parts II and III of Chapter 13 of the Code of Ordinances of the C~ty of Denton, Texas, under the provisions of Ordinance No 6~-19 be, and the same ~s hereby amended as follows All of the hereinafter described proper~y ~s hereby removed from the "R" ~ Dwelling Dlstr~ct as shown on sa~d map, and all provisions of Parts II and III of Chapter 13 of ~he Code of Ordinances of the C~ty of Denton, Texas, as provided by Ordinance No 61~19, shall hereafter apply to sa~d property as "^~2" D~elling D~str~ct provided, however, as a condition to the enactment of th~s ordinance, all uses of th~s tract of land will be limited to uses permitted ~n an "R" - Dwelling D~strict and the following uses only, which are permitted ~n an "A-~" - Dwelling D~str~ct 1 Fraternity Houses 2 Sorority Houses and provided further that owner shall, as a condition prec4)dent to the effective validity of th~s ordinance and zoning change~ dedicate all needed additional land to make Avenue B a s~xty (60) feet wide street from Eagle Dr~ve south, and dedicate to City adequate r~ght of way to c~nt~nue McCorm~ck Street between Fann~n and Marg~e Streets, and no Certificate of Occupancy will be issued for any other use until th~s Ordinance is repealed, and the validity of this entire Ordinance depends and ~s based upon the validity of the condition, th~s condition being a reasonable exercise of the police powers of the C~ty of Denton, Texas, said property being described as All of City of Denton Block 378/A except lots 4 l, 8, lB and 16' all of City Block 373/A except lots l, 2, 4, 5, 6 and 8, C~ty Block 374 except lots 6, 7, 8 and 9, and all of the west one half {1/2) of City Block 373/B, as shown on the official plat of the City of Denton as kept on f~le in the off~ce of the Tax Assessor SECTION II That the City Coucnll of the C~ty of Denton, Texas hereby finds that such change and condition is ~n accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, and with the reasonable consideration, among other things, for the character of the district and for its peculiar suitability or particular uses, and w~th a wew to conserving the value of buildings, protecting human l~ves, and encouraging the most appropriate uses of land for the maximum benefit to the C~ty of Denton and ~ts c~t~zens SECTION III That this ordinance shall be ~n full force and effect immediately after its passage and approval, the required public hearings hawng heretofore been held by the Planning and Zoning Commission and the City Council, after g~v~ng due not~ce thereof PASSED AND APPROVED this llth day of June, A D 1968 ATTEST Brooks Holt, City Secretary C~ty of Denton, Texas APPROVED AS TO LEGAL FORM y Q Barton, City Att~orney of Denton, Texas
