1968-013AN ORDINANCE GRANTING TO TRINITY STEEL COMPANY CONSENT TO THE
USE OF A CERTAIN STREET FOR LIQUID AND GAS PIPE LINE PURPOSES,
PROVIDING STANDARDS FOR SUCH USE, AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
~ECTION I
The City of Denton, Texas, hereby grants to Trinity
Steel Company consent to use and occupy a certain portion of
the 600 block of East Sycamore Street, the same being a public
stree~ of the City, said portion to be determined by the
Director of Public Works of the City, for the purpose of
laying, constructing, maintaining, operating and replacing
therein and thereunder a pipe line and all other appurtenant
equipment necessary for the transmission of oxygen and
carbon dioxide from the present storage tank location south
to the new building on the opposite side of said street, in
the City of Denton, for a term beginning with the effective
date of this ordinance and continuIng until the first day of
January, 1984, sub3ect to the following conditions
1 Ail piping valves and fittings, for liquid
oxygen, shall be throughly cleaned of o11,
grease, and other readily oxldzzable materials
2 The underground piping for the liquid oxygen
must be Type K copper tubing
3 The llquld oxygen piping must not parallel
any sewer lzne within a distance of less
than four (4) feet
4 The depth of the llquzd oxygen and carbon d~oxlde
piping must be at least three (3) feet
5 The liquid oxygen piping must be encased in
Schedule 40 steel p~pe
6 Inside the Trinity Steel Company property line,
on each side of said East Sycamore Street, the
pipe that encases the liquid oxygen piping must
be vented, and such venting must provide for
protection from precipitation and ln]ury and be
safe for persons and property
7 After installation the piping must be sub3ected
to a test pressure of one and one-half (1%) tunes
maximum working pressure but in no case less than
150 p s 1
8 Items of th~s installation not specifically mentioned
herein must conform to NFPA No 565 and NFPA No 566
standards, and the entire installation shall be
generally acceptable to sald NFPA practice
9 Ail such ventbng, constructbng and bnstallbng shall
be under the strbct supervbsbon of the Fbre Marshal
of the Cbty of Denton
~ECTION II.
Trznbty Steel Company shall lay, mabntabn, construct,
operate and replace bts pzpe, pbpbng, and other equbpment
so as,to bnterfere as lzttle as possbble wzth vehbcular
traffmc, and shall promptly clean up and restore to an
approxbmate orbgbnal condbtzon, at bts cost, all portbons
of the sabd street whbch bt may dbsturb, and bt shall
promptly repabr any bmperfect restoratbon whbch may be
called to bts attentbon by the Cbty The locatbon of all
pbpbng, pbpes, tubes, laterals, and other appurtenant
equbpment shall be fbxed under the supervbsbon of the
Czty Dbrector of Publbc Works or an authorbzed agent
thereof
SECTION III.
When Trbnbty Steel Company shall make or cause to be
made excavations or shall place obstructbon bn any street
or other publbc place, the publbc shall be protected by
barrbers and lbghts placed, erected and mabntabned by
Trbnbty Steel Company, and bn the event of bn]ury to any
person or damage to any property by reason of the
lnstallatzon, constructbon, operatbon or mabntenance of
any of these lbquzd or gas pzpe lbnes, Trbnbty Steel
Company shall bndemnbfy and keep harmless the Cbty of
Denton from any and all lbabblbty bn connectzon therewzth,
and shall furnzsh the Cbty wbth a Certbfbcate or other
proof of bnsurance coverbng and protecting the sabd
Cbty as stated an thbs sectbon
SECTION
The provbszons of thms ordbnance shall be subjected to
all applbcable regulatory and other authorbty of the Cbty
of Denton contazned bn the Cbty's Charter and Code of
Ordbnances, and the statutes and constbtutbon of the
State of Texas
SECTION ~.
Trznbty Steel Company shall fzle mts wrmtten acceptance
of thbs ordbnance wbthbn sbxty (60) days after fbnal passage
and approval by the Cbty, and fablure to do so wmthzn such
perbod shall bmmedbately revoke and nulbfy thbs ordinance

bts ~mployees, agents, successors or asszgns to all the
