CALLING AND ORDERING AN ELECTION TO BE HELD ON THE 2ND DAY OF
APRIL~ A D 1968~ THE SAME BEING THE FIRST TUESDAY IN SAID
MONTH~ FOR THE PURPOSE OF ELECTING TWO (2) COUNCILMEN FOR THE
CITY OF DENTON, TEXAS, IN ACCORDANCE WITH THE PROVISIONS OF
ARTICLE 3, SECTION 3 01 (a) OF THE CHARTER O~ THE CITY OF DENTON,
TEXAS,; ESTABLISHING~ THE HOURS AND PLACE FOR ~HE SAID ELECTION,
PROVIDING FOR PUBLICATION OF THIS ORDINANCEA~ POSTING IN THREE
PUBLIC PLACES IN THE CITY OF DENTON AS NOTICE ~F SAID ELECTION
DIRECTING THE CITY SECRETARY TO MAKE UP THE OFFICIAL BALLOTS,
CAUSING THE SAME TO BE PRINTED AND DELIVERED TO tHE PRESIDING
OFFICER, PROVIDING FOR THE MAKING OF OFFICIAL RETURNS OF SAID
ELECTION, PROVIDING FOR THE CANVASSING OF THE RET%~NS OF THE
SAID'ELECTION AND DECLARING THE RESULTS OF SAME BY'THE CITY
COUNCIL, AND DECLARING AN EFFECTIVE DATE ~
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
That an election shall be held in the Community Building,
zn the Civic Center on McKznney Street, ~n the C~ty of Denton,
Texas, between the hours of eight o'clock (7 00) A M and
seven o'clock (7 00) P M , on the 2nd day of April, A D 1968,
the same being the fzrst Tuesday of sazd month, for the pur-
pose of electzng two (2) Counczlmen for the C~ty of Denton,
zn accordance with the prov~szons of Artzcle 3, Sectzon 3 01
(a) of the Charter of the City of Denton~ Texas
SECTION II
That the two candidates who receive the highest number of
votes shall be declared elected to the City Council of the
C~ty of Denton
SECTION III.
That not~ce of sa~d elect~on shall be g~ven by the post-
lng of true cop~es of this ordznance, szgned by the Mayor
and attested by the City Secretary, in three public places of
the said City, one of which places shall be at the Municipal
Building, for thirty (30) consecutive days prxor to the date
of sazd elect~on and this ordinance shall be published ~n
full one time in the Denton Record-Chronicle at least thirty
(30) days przor to said election
SECTION IV
That Jewel Smith is hereby appointed presiding 3udge of
sa~d electlon, and the sa~d presiding 3udge shall appoint
such assistance as maybe necessary to properly conduct sa~d
election
SECTION V
That the Cmty Secretary shall make up the off~czal ballot
from the names presented to hzm by application or nominating
petitions as provided by Article 3~ Section 3 02 and 3 03
of the Charter of the City of Denton, Texas, and he ~s hereby
authorized and d~rected to have the ballots to be used ~n such
election printed and delivered to the sa~d presiding 3udge
SECTION VI
That immediately after the counting of the votes the presiding
]udge shall deliver the official returns of the election to the
City Secretary
SECTION UII
That on the Monday next following the election, the City
Council shall canvass the returns and declare the results which
shall be recorded in the Minutes of the Council
SECTION UIII
That the two candidates who receive the highest number of
votes shall be declared elected and the Mayor shall deliver
certificates of election to the successful candidates If
two candidates shall tie with the second h~ghest number of
votes, or if three or more candidates shall tie for the h~ghest
number of votes, the Council shall order a second election to
be held on the fourteenth day after the first election at which
only the names of the two candidates who receive the same number
of votes at the fzrst election shall be printed on the ballot
In the event of a tie at the second elect~on, the tzed candidates
shall cast lots to determine which one shall be declared elected
SECTION IX
This ordinance shall become effective ~mmedlately upon
its passage
