A~ ORDINANCE A~EI~DING THE CODE OF ORDINANCES OF THE CITY OF DENTO~ TEXA~ SO A~ ~O PROVIDE FOR DIRECT BURIAL OF HIGH VOLTAGE UNDERGROUND UTILITIES UNDER STRICT SUPERVISION~ AND ACCORDING TO CITY SPECIFICATIONS DETERMINED BY THE DIRECTOR OF UTILITIES, PROVIDING REDUCED YARD LIGHT BURIAL REQUIRE- MENTS; PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON~ TEXAS~ HEREBY ORDAINS SECTION I That the Code of ordinances of the City of Denton~ Texas~ is hereby amended and supplanted by repealing the fourth para- graph of Section 9-6~ which reads as follows Ail underground electrical wiring shall be installed in rigid metal conduit with water proof threaded connections, at adept of not less than 24 inches (24"), and by substituting new subsections (c) of Section 25-118~ and by adding subsection (k) to said Section 25-118 and sub- stltutlng new subsection (f) to Section 25-119 of said Code which sections shall hereafter read as follows Section 25-118 High Voltage Installations (c) The cable or cables shall have a metal conduit protection at all points where mechanical damage is likely to occur~ and all cable or cables shall conform to all utility department requirements and specifications regarding such metal condults~ and same shall be installed when required by the inspector of underground utll~tles (k) Ail underground dlrect burial shall be under the strict supervision of the lnspector of underground ut~llt~es~and shall conform to all utility depart- ment requirements, and be in accordance w~th the plans and spec~flcatlons previously submitted there- for by the installer or developer~ and approved by the director of utilities All underground d~rect burial of high voltage systems shall be marked above ground at locations and in the manner directed by the said inspector Section 25-119 Low Voltage Installations (f) Ail conduit systems shall be buried at minimum depth of forty-two (42) ~nches below finished grade, except electric yard lights which shall be buried at m~nlmum depth of twenty-four (24) inches below finished grade~ without conduit If rock or similar substance is present to prevent bur~al at such depth~ three (3) inches of concrete shall be poured over conduit at such above-minimum levels After excavation the first slx (6) inches of refill earth shall be of selected material free of stones and sharp objects The remainder of the refill may be of the excavated materials SECTION II That the above quoted fourth paragraph of Section 9-6 of the Code is hereby expressly repealed~ and the heretofore existing subsection (c) of Section 25-118 and subsection (f) of Section 25-119 are hereby expressly repealed and supplanted, and all other ordinances or parts of ordinances ~n conflict herewith are hereby expressly repealed to the extent of any such conflict SECTION III That if any sectlon~ subsect~on~ paragraph~ sentence~ clause~ phrase~ or word in this ordlnance~ or application thereof to any person or clrcumstances~ is held invalid by any court of competent 3urlsdlction such holding shall not affect the validity of the remaining port ions of this ordlnance~ and the City Council of the C~ty of Denton hereby declares it would have enacted such remaining portion or portions despite any such invalidity SECTION, IV That this ordinance shall become effective fourteen (14) days from the date of 1ts passage~ and the City Secretary · s hereby directed to cause the caption of this ordinance to be published twice ~n the Denton Record-Chron~cle~ the official newspaper of the City of Denton~ Texas~ within ten (10) days of the date of its passage PASSED AND APPROVED this /~ , day of February~ A D 1968 %~_.~Tty of Denton~ Texas City of Denton~ Texas APPR~D ASIO LEGAL FORM ~ Q Barton~ ~Clty Attorney ~lty of Denton~ Texas
