~N ORDINANCE AMENDING THE ZONING MAP OF THE CITY
OF DENTON, TEXA~ 1961, 2%$ SAME WAS ADOPTED AS A
PART OF PARTS II AND III OF CHAPTER 13 OF THE
CODE OF ORDINANCES OF THE CITY OF DENTON~ TEXAS
BY ORDINANCE NO 61-19~ AND AS SAME MAP APPLIES
TO CERTAIN PROPERTY KNOWN AS CITY LOT 2 1 OF
CITY BLOCK 3025~ AS SHOWN ON THE OFFICIAL CITY
MAP OF THE CITY OF DENTON~ TEXAS~ AND MORE PART-
ICULARLY DESCRIBED HEREIN, PROVIDING AND REMOVING
CERTAIN CONDITIONS AND RESTRICTIONS, AND DECLARING
AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON~ TEXAS~ HEREBY ORDAINS
SECTION I.
That the Zoning Map of the C1ty of Denton, Texas, 1961,
adopted as a Part of Parts II and III of Chapter 13 of the
Code of ordinances of the City of Denton, Texas, under the
provisaons of Ordanance No 61-19, be, and the same as hereby
amended as follows
All of the hereanafter described property ~ndacated on
and descrabed below as hereby removed from the "R" -
Dwelling Dastract as shown on saad map, and all provasaons
of Parts II and III of Chapter 13 an the Appendax to the
Code of Ordinances of the Caty of Denton, Texas~ as pro-
vaded by Ordanance No 61-19, shall hereafter apply to
saad property as "A-2" - Dwellang D~str~ct in the same
manner as other property located ~n the "A-2" Dwellang
Dastract, provided, however, as a condition to the enact-
ment of thas ordanance, the owner or owners of the property
covered by thas ordanance, has he,rs, assagns, executors,
or admanastrators, shall, before a Certafacate of Occupancy
as assued by the Caty of Denton, buald or cause to be built
a solad masonary fence sax (6) feet an heaght along the
north boundary lane of such property, whlch f~%ce shall
contaan such areas of angress and egress as are reasonably
necessary for the occupants~ owners and tenants of the
buald~ngs and premises located on saad property,~ and
the valadaty of thas entare ordanance~
depends and is based upon the validity of this set back
provlslon, and such provision being a reasonable exer-
clse of the Police Powers of the City of Denton~ Texas
All that certaln property sltuated an the City of Denton,
County of Denton~ State of Texas~ known as City Lot 2 1
of City Block 3025
SECTION II.
That the City Council of the City of Denton~ Texas, hereby
finds that such change and condition is in accordance with a
comprehensive plan for the purpose of promoting the general
welfare of the City of Denton~ Texas, and with reasonable con-
slderatlon~ among other thlngs~ for the character of the district
and for its peculiar suitability or particular uses, and with a
view to conserving the value of the bulldlngs~ protecting human
llves~ and encouraging the most appropriate uses of land for
the maximum benefit to the City of Denton and its citizens
SECTION III.
That this ordinance shall be in full force and effect
immediately after its passage and approval, the required public
hearings having heretofore been held by the Planning and Zoning
Co~nlsslon and the City Council of the City of Denton, Texas~
after giving due notice thereof
