1970-046 NO ,?m - AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, 1969, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO CERTAIN PROPERTY KNOWN AS PART OF CITY LOTS 7 AND 8, BLOCK 276A AS SHOWN ON THE OFFI- CIAL TAX MAP OF THE CITY OF DENTON, TEXAS, AND MORE PARTI- CULARLy DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the Zoning Map of the City of Denton, Texas, adopted January 14, 1969, as an Appendix to the Code of Ordinances of the Clty of Denton, Texas, under provisions of Ordinance No 69-1, be, and the same ~s hereby amended as follows All the herelnafter described property ~s hereby re- moved from the "SF-7" Single Family D~strlct as shown on said Zoning Map, and all provlslons of Ordinance NO 69-1 adopted the 14th day of January, 1969, as amended, shall hereafter apply to said property as General Retail Dlstr~ct ~n the same manner as other property located ~n the General Retail D~strlct, Ail that certain lot, tract or parcel of land lying and being s~tuated ~n the City and County of Denton, State of Texas, being a part of the Wm Teague Survey, Abstract No 1266 and being a part of the tract of land conveyed by A B Baker, Jr , and Elv~n Baker to Arohie R Kelley and w~fe, Ett~e Inez by deed dated March 6, 1968 and recorded ~n Volume 563, Page 397 of the Deed Records of Denton County, Texas, and belng more particularly des- crlbed as follows BEGINNING at the ~nterse~tion of the north r~ght of way l~ne of Morse Street and the east r~ght of way line of woodrow Lane, THENCE north 70° 41' west w~th the north rlght of way l~ne of Morse Street a d~stance of 400 0 feet to a point for a corner, THENCE north 19° 19' east a d~stance of 200 0 feet to a point for a corner, THENCE south 70° 41' east a d~stance of 112 78 feet to a polnt for a corner, THENCE north 0° 59' east a d~stance of 112 78 feet to a polnt for a corner, THENCE south 89~ 01' east a d~stance of 200 0 feet to a point for a corner in the west rlght of way lane of Woodrow Lane, THENCE south 0° 59' west with the west right of way l~ne of Wood- row Lane a d~stance of 400 0 feet to the place of beginning and containing 102,556 0 square feet of land, more or less SECTION II That the City Council of the City of Denton, Texas, hereby finds that such change is in accordance with a comprehensive plan for the purposes of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things, for the character of the district and for its peculiar suitability or particular uses, and wzth a vzew to con- serving the value of the buzldlngs, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton and ~ts citizens SECTION III That this ordinance shall be in full force and effect zm- medlately after zts passage and approval, the required public hearings having heretofore been held by the Plannzng and Zoning Commission and the Clty Council of the Czty of Denton, Texas, after gzving due notice thereof PASSED AND APPROVED thzs the 24th day of November, A D 1970 ATTEST CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM NOTICE OF PUBLIC IIkARING Notzce ~s hereby given that the Czty Council of the C~ty of Denton, Text, w~ll hold a public he~nng Tuesday, November 10, 1970 at 7 00 p m ~n the Counczl Chambers of the ~banzczpal Butldang to consider the request of blt Ard~e Kelly that the zonzng classification of part of C~ty Lots ? and 8, Block 276 A be changed from the "SF-7" S~ngle Frankly classification to the General Retail class~fzcat~on Thzs property ~s further described as being located at the northwest comer of Woodrc~ aha Horse Streets extendu~g 200' ~n depth north and west along bbrse and Woodrow Streets a d~stance of 400 ' S Hauptmar~, P E Director of Communzty Development SH/klr
