1970-026 NO 7e ~ & AN ORDINANCE AUTHORIZING NORTH TEXAS STATE UNIVFRSITY CAMPUS PATROLMEN TO ENFORCE ALL TRAFFIC LAWS WITHIN A PARTICULAR DES- CRIBED AREA, PROVIDING THAT SUCH PATROLMFN SHALL NOT BE EMPLOY- EES OF THE CITY OF DENTON, TEXAS, NOR BE ENTITLED TO ANY COMPEN- SATION FROM THE CITY OF DFNTON, TEXAS, FOR SERVICES PERFORMED, PROVIDING A SAVINGS CLAUSE, AND DECLARING AN FFFFCTIVE DATE WHEREAS, the commzssloned and bonded campus security per- sonnel of North Texas State University are peace officers, auth- orized under the provzslons of Revised Czvll Statutes Artzcle 29193 to preserve the public peace, protect the property of the State of Texas, and enforce all traffic and parking laws, w~th all the powers, prlvzleges and zmmunltles of peace officers while on property under the control and ]urlsdzctlon of sazd Unzverslty, and WHEREAS, it ls in the public ~ntere~t that the aforesaid campus patrolmen be authorzzed to enforce traffic and parking laws and re- gulations beyond the existing control and jurIsdiction of sald Unlverslty, but within the lmmedzate area and neighborhood of same, now therefore THE COUNCIL OF THE CITY OF DENTON, TFXAS, HERFBY ORDAINS SECTION I That each commlsszoned peace officer regularly employed by North Texas State University, including future employed, who is bonded as requzred by qectlon 3 Revised Czvll Statutes Article 29193 after taking and fzlzng the oath required of peace officers by the Constltutlon of the State of Texas is hereby authorized to carry arms zn the performance of h~s duties, and to enforce all traffic and parkzng laws of %h~ City of Denton and the State of Texas, subject to the llmltat~ons set forth zn Sectzon 2 of thls ordinance, in, upon, and adjacent to, the following public streets (a) All the publlc streets of the City of Denton being situated within the area czrcumscrlbed by West Oak, Welch, West Hlckory, Bernard, Eagle Drive, Interstate Highway 35 E, and Bonnze Brae ~treets, (b) West Oak from Bonnie Brae to Welch Streets, (c) Welch from West Oak to West Hickory Street~, (d) West Hickory from Bonnie Brae to Bernard Street~ (e) Bernard from West Hickory to Eagle Drive ~treets, (f) Fagle Drive from Bernard Street to Interstate High- way 35E~ (g) North service (access) road of Interstate Highway 35 F from Fagle Dr~ve to Bonnie Brae qtreets, and (h) Bonnie Brae from Interstate Highway 35 F to West Oak Street SECTION II Provided, however, that this extension of police jurisdic- tion of said campus peace officers shall apply to enforcement of traffic laws and ordinances only, except when otherwise authoriz- ed in writing by the Chief of Police of the City of Denton, and, provided further, that each such campus peace officer shall comply with all orders g~ven by the City Chief of Police which concern law enforcement within the above described area, whether emergency or routine, and failure to comply w~th any such order is declared to be grounds for ~mmedlate revocation of this ordinance by the Councll of the City of Denton SECTION III That nothing in this ordinance shall be so construed as to render any such North Texas State University employee an employee of the City of Denton, Texas, or so as to subject any such employee to the d~sclpllne of the Denton Police Department, or so as to create any rights or l~ablllt~es for any such em- ployee under %he Flremen's and Pollcemen's Civil Service Act, and no suoh employee shall be entltled to any compensation from the City of Denton, Texas, for any act performed, or any l~ablllty or injury incurred in the performance of his duties, it being the purpose and intent of this ordinance only to extend the physical jurisdiction of North Texas ~tate University peace officers in a limited manner SECTION IV That if any section, subsection, sentence, clause or phrase of this ordinance, or the application thereof to any person or circumstance is held invalid by any court of competent jurisdiction such invalidity shall not affect any provision or applIcation of this ordinance which can be given affect w~thout the ~nval~d pro- v~s~on or application, and to this end the provisions of this ord · nance are declared to be severable SECTION V That this ordinance shall become effective ~mmedlatel¥ upon its passage PASSFD and APPROVED this the // day of { ~~ , A D 1970 ALFXANDER M FINLAY, JR , MAYOR CITY OF DENTON, TEXAS ATTEST/f ~ ~ BRO~ HOLT, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM J~ Q BARTON, C~TY ATTORNEY fY OF DENTON, TEXAS
