1970-021 NO 70 ~L/ AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, 1969, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO CFRTAIN PROPERTY KNOWN AS 6e085 ACRES OF LAND, AS SHOWN ON THE OFFICIAL TAX MAP OF THE CITY OF DENTON, TEXAS, AND MORE PARTICULARLY DESCRIBFD HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the Zoning Map of the City of Denton, Texas, adopted January 14, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas, under provisions of Ordinance No 69-1, be, and the same is hereby amended as follows Ail the hereinafter described property is hereby re- moved from the "A" Agriculture District as shown on said Zoning Map, and all provisions of Ordmnance No 69-1 adopted the 14th day of January, 1969, as amended, shall hereafter apply to said prooerty as "C" Commercial District in the same manner as other property located in the "C" Commercial District, All that certian lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, be- ing a part of the A White Survey, Abstract No 1406, and being a part of a tract of land conveyed by Juanita W¥che, et al to Union Oil Company of California by deed dated April 11, 1970 and recorded in Volume 602, Page 45 of the Deed Records of Denton County, Texas, and being more particulary described as follows BEGINNING at the southwest corner of said Union Oil Company of California Tract, said point of beginning lymng in the east boundary line of Interstate Highway 35 right of way, THENCE northerly with a curve to the right, said curve to the right having curve data of ~ord=N 1° 50' W~435 8' R=11320 00', Central Angle=2° 12', T=217 94', along the east boundary line of Interstate Highway 35, a distance of 435 82 feet to a wooden highway right of way post being the P T of said curve to the right, THENCE north 0° 04' east with the east boundary line of Inter- state Highway 35, a distance of 527 75 feet to a concrete monu- ment for a corner, THENCE north 61° 44' east with the east boundary line of Inter- state Highway 35, a distance of 99 55 feet to a concrete monu- ment for a corner, THENCE south 58° 27' east with the south boundary line of U S Highway 77, a distance of 271 07 feet to a pomnt for a corner, THENCE south 0° 44' east with the present City Limits Line, 500 00 feet east of and parallel to the centerline of Interstate Highway 35, a distance of 443 00 feet to a point for a corner, THENCE south 2°57' east, still with said City Limits Line, 500 00 feet east of and parallel to the centerline of Interstate High- way 35, a distance of 435 80 feet, more or less, to a point for a corner in the south boundary line of said Unmon Oil Company of California Tract, THENCE north 88° 47' west, a distance of 320 00 feet to the place of beginning and containing 6 085 acres of land, more or less SECTION II That the City Council of the City of Denton, Texas, here- by finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things, for the character of the district and for its peculiar suitability or particular uses, and with a view to con- serving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton and its citizens SECTION III That this ordinance shall be in full force and effect im- mediately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the City of Denton, Texas, after giving due notice thereof PASSED AND APPROVED this the ~ day of ~ , A D 1970 ~ ALEXAN©ER M 'F~'~LIY, ~ ~MAY CITY OF DENTON, TEXAS ATTEST ~ /,..4 / B/~,~ ~HOLT, C~TY SECRETARY CITY OF DENTON, TEXAS APPR0~/~D AS~TO LEGAL FORM ~AC~Q -BARTON, crTY A Cfr OF DENTON, TEXAS
