1969-025AN ORDINANCE PROHIBITING DISORDERLY CONDUCT, PROVIDING PENAL- TIES FOR VIOLATIONS THEREOF, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS PART I That Chapter 14 of the Code of the City of Denton, Texas, is hereby amended by adding new Section 14-48 to sa~d Chapter which Code shall hereafter read as follows SECTION 14-48 (1) Definitions A person shall be gm~lty of d~sorderly conduct ~f, with a purpose to cause public danger, alarm, dis- order, nuisance or if with the knowledge that he is l~kely to create such public damger, alarm, d~sorder or nuisance he w~l- fully (a :reates a d~sturbanc~ of the public order by an act of violence or by any act likely to produce v~olence, or (b engages ~n f~ghtlng, or ~n wolent, threatening or tumultuous behavior, or (c makes any unreasonably loud no~se, or (d addresses abusive language or threats to any person present which creates a clear and present danger of violence, or (e) causes l~kellhood of harm or serious ~nconvenlence by fa~l~ng to obey a lawful order of d~spersal by a police officer, where three or more persons are com- mitting acts of disorderly conduct ~n the immediate vicinity, or (f) damages, befouls or d~sturbs public property or pro- perty of another so as to create a hazardous, unhealthy or physically offensive condition, and (g) commits a~espass on private property or on public property T~espass for the purpose of th~s ordinance shall mean, (1) Entering upon, or refusing to leave, any private property of another, either where such property has been posted with "NO TRESPASSING' signs, or where ~mmedlately prior to such entry, or subsequent thereto, not~ce is given by or on behalf of the owner or occu- pant, orally or in writing, that such entry, or con- tinued presence, ~s prohibited (2) Entering upon, or refusing to leave, any public property in wolat~on of regulat~ens promulgated by the official charged w~th the security, care or main- tenance of the property and approved by the governing body of the public agency owning property, wb~re such regulations have been conspicuously posted or where ~mmedlately prior to such entry, or subsequent there- to, such regulations are made known by the official charged with the security, care or maintenance of the property, his agent or a police officer This ordinance shall not apply to peaceful p~cketlng, public speaking or other lawful expressions of opinion not ~n contraven- tion of other laws PART II OFFENSE It shall be unlawful for any person to engage ~n disorderly conduct in the City of Denton PENALTIES Any person conwcted of violating this ordinance shall, upon conv~ctlon, be subject to pay a f~ne not exceeding $200 00, as provided in Section 1-5 of this Code PART III SEVERABILITY If any section, subsection, sentence, clause or phrase of th~s ordinance ~s for any reason held to be uncon- stitutional, such decision shall not affect the validity of the remaining portions of this ordinance The City Council hereby declares that ~t would have passed this ordinance and each ~ectlon, subsection, sentence, clause and phrase thereof, irres- pective of the fact that any one o~ more sections, subsections, sentences, clauses or phrases be declared unconstitutional PART IV EFFECTIVE DATE This this ordinance shall be effective fourteen days from the date of ~ts passage, and the C~ty Secre- tary ls hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle wlthln ten (10) days of the date of its passage PASSED AND APPROVED this // day of ,~ ~-"~'~ , A D 1969 L A NELSON~ MAYOR CITY OF DENTO~ TEXAS ATTEST/~ CITY OF DENTON, TEXAS JA,C~ B~A~TON, C~ YTYT~TTORNEY C~/~ OF DENTON, TEXAS
