1969-009 NO AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, CALLING AND ORDERING AN ELECTION TO BE HELD ON THE 1ST DAY OF APRIL, A D 1969, THE SAME BEING THE FIRST TUESDAY IN SAID MONTH, FOR THE PURPOSE OF ELECTING THREE 43) COUNCILMEN FOR THE CITY OF DENTON, TEXAS, IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 3, SECTION 3 O1 (a) OF THE CHARTER OF THE CITY OF DENTON, TEXAS, ESTABLISHING THE HOURS AND PLACE FOR THE SAID ELECTION, PROVIDING FOR PUBLICATION OF THIS ORDINANCE AND POST- ING IN THREE PUBLIC PLACES IN THE CITY OF DENTON AS NOTICE OF SAID ELECTION, DIRECTING THE CITY SECRETARY TO MAKE UP THE OFFICIAL BALLOTS, CAUSING THE SAME TO BE PRINTED AND DELIVERED TO THE PRESIDING OFFICER, PROVIDING FOR THE MAKING OF OFFICIAL RETURNS OF SAID ELECTION, PROVIDING FOR THE CANVASSING OF THE RETURNS OF THE SAID ELECTION AND DECLARING THE RESULTS OF SAME BY THE CITY COUNCIL, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That an election shall be held in the Community Building, ~n the C~v~c Center on McK~nney Street, ~n the C~ty of Denton, Texas, between the hours of seven o'clock (7 00) A M and seven o'clock (7 00) P M , on the 1st day of April, A D 1969, the same being the f~rst Tuesday of sa~d month, for the purpose of electing three (3) Councilmen for the C~ty of Denton, ~n accor- dance w~th the provisions of Article 3, Section 3 O1 (a) of the Charter of the C~ty of Denton, Texas SECTION II That the three candidates who receive the h~ghest number of votes shall be declared elected to the C~ty Council of the C~ty of Denton, Texas SECTION III That not~ce of sald~ectlon shall be given by the posting of true cop~es of th~s ordinance, signed by the Mayor and attest- ed by the C~ty Secretary, ~n three public places of the said C~ty, one of which places shall be at the Municipal Building, for thirty (30) consecutive d~ys prior to the date of sa~d elect~on and this ordinance shall be published ~n full one time ~n the Denton Record-Chronicle at least thirty (30) days prior to sa~d election SECTION IV That ~J~w£~ ~/-~,~/4 ~s hereby appointed presiding judge of said election, and the sa~d presiding judge shall appoint such assistance as maybe necessary to properly conduct sa~d election SECTION V That the City Secretary shall make up the official ballot from the names presented to h~m by application or nominating pet~tqons as prowded by Article 3, Section 3 02 and 3 03 of the Charter of the City of Denton, Texas, and he ~s hereby authorized and d~rected to have the ballots to be used in such election printed and delivered to the sa~d presiding judge SECTION VI That immediately after the counting of the votes the pre- sldlng judge shall deliver the official returns of the election to the C~ty Secretary SECTION VII That on the Monday next following the elect~on, the City Council shall canvass the returns and declare the results which shall be recorded in the Minutes of the Council SECTION VIII That the three candidates who receive the highest number of votes shall be declared elected and the Mayor shall deliver certificates of election to the successful candidates If two candidates shall t~e with the second h~ghest number of votes, or ~f three or more candidates shall tie for the h~ghest number of votes, the Council shall order a second election to be held on the fourteenth day after the f~rst election at which only the names of the two candidates who receive the same number of votes at the first election shall be printed on the ballot In the event of a tie at the second election, the tied candidates shall cast lots to determine which one sh&ll be declared elected S,ECTION IX This ordinance shall become effective immediately upon its passage PASSED AND APPROVED th~s 25th day of February, A D 1969 J ZQKE MARTIN, MAYOR ~TY OF DENTON, TEXAS CITY OF DENTON,~XAS A?RO~ED /)r~ TO LEGAL FORM J,A~K Q BARTON, C~ITY ATTORNEY ~2ITY OF DENTON, TEXAS
