CO~CIL FOR DRILLING FOR OIL OR GAS WI~-ZIN ~ COR-
PORATE LIMITS OF THE CITY; DETERMINING SUCH DRILLING
OPERATIONS TO BE POTENTIAL FIRE HAZARDS; REQUIRING
A PERMIT FOR SEISMIC OR EXPLOSIVE-TYPE EXPLORATIONS;
REPEALING CONFLICTING ORDINANCES; PROVIDING A SAVINGS
CLAUSE; AND DECLARING AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS:
SECTION I.
That the Code of Ordinances of the City of Denton, Texas,
is hereby amended by adding new section 10-8 to Chapter 10 of
said Code which shall hereafter read as follows:
Section 10-8 Permit required for drilling or exploring
for oil or gas.
(a) The activity and use of drilling for the purpose
of locating or removing combustible products such
as oil or gas from beneath the surface in an urban
or densely populated area is hereby declared to be
a fire hazard unless proper measures and methods
are employed which safe guard the surrounding area
and the area involved, and no such drilling shall
be permitted within the corporate limits of the
City except upon express written permission of the
Ci%y Council. This permission may be given only
after a complete investigation is made of the en-
tire area to be affected, and of the particular
operation involved and shall prescribe all necess-
ary safety features to be used, which shall be a
condition to such permission.
(b) No seismic, or explosive type, explorations of
any kind shall be conducted within the coDporate
limits of the City except upon express written
permission of the City Council as such explora-
tions are declared to be blasting or demolition
as prohibited by Section 14-3 of this Code, except
upon express permission of the City Council.
SECTION II.
That all ordinances or parts of ordinances in force when
the provisions of this ordinance become effective which are
inconsistent or in conflict with the ~erms or provisions con-
tained in this ordinance are hereby repealed to the extent of
any such conflict.
SECTION III.
That if any section, subsection, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereof
to any person or circumstance ~$held invalid by any court of
competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance, and the
City Council of the City of Denton, Texas, hereby declares
it would have enacted such remaining portions despite any such
invalidity.
SECTION IV.
That this ordinance shall become effective immediately
upon its passage.
