AN ORDINANCE PROHIBITING THE CONSTRUCTION
OF ANY NEW ROADS, STREETS, OR THOROUGHFARES
FOR VEHICULAR TRAFFIC UPON, INTO, THROUGH,
OR ACROSS THE CITY PARK KNOWN AS CIVIC PARK,
AND MORE PARTICULARLY DESCRIBED THEREIN
PROVIDI~G A SAVING CLAUSE, AND DECLARING AN
EFFECTIVE DATE
AS INTTIATED BY THE ELECTORS OF THE CITY OF
DENTON, TEXAS, UNDER THE PROVISIONS OF ARTICLE
IV OF THE CHARTER OF THE CITY OF DENTON
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I
That, in order to have an adequate, undivided open
park area for all the people of the City, and to maintain
its continuity, safety, and to fulfill a need for future
contiguous open area, no streets, roads, or thoroughfares
for vehicular traffic, other than service roads, shall
be open, re-opened, or constructed through, upon, into
or across the below described tract or parcel of land,
to-wit.
Ail that certain tract or parcel of land,
lying and being situated in the City and
County of Denton, State of Texas, to-wit
BEGINNING at the intersection of the South
right-of-way line of Withers Street with the
West right-of-way line of Bell Avenue,
THENCE South with the West right-of-way line
of Bell Avenue, and continuing Southerly with
the West right-of-way line of the Bell Avenue
extension to Blount Street, a total distance
of 1720 feet, more or less, to a point, said
point being the intersection of the North
right-of-way line of East McKinney Street with
the West right-of-way line of said Bell Avenue
extension to Blount Street,
THENCE West with the North right-of-way line of
East McKinney Street, a distance of 1030 feet,
intersection of the East right-of-way line of
Austin Avenue with the North right-of-way line
of McKinney Street,
THENCF North with the East right-of-way line of
Austin Avenue, a distance of 540 feet, more or
less, to a point, said point being the inter-
section of the South right-of-way line of Parkway
Street with the East right-of-way line of Austin
Street,

SECTION II.
That it is also the intent and purpose of this ordinance
to p~event the connection of any existing streets through the
above described area, including Oakland Avenue, but to permit
the public use of that portion of said Oakland Avenue which
extends into the described area a distance of 2~8 feet North
from the North boundary line of McKtnney Avenue.
SECTION ~II.
That all ordinances or par~s of ordinances in force when
the provisions of this ordinance become effective which are
inconsistent or in conflict with the terms or provisions
contained in this ordinance are hereby repealed to the extent
of any such conflict.
SECTION IV
That if any section, subsection, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereof
to any person or circumstances is held invalid by any court of
competent Jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance and the
City Council of the City of Denton, Texas, hereby declares it
would have enacted such remaining portions despite any such
invalidity, and that same is the declared intent of the
electors initiating this ordinance.
