1967-042 NO Z ? ~N OI~DIN~CE ORDERING A SPECL~, ELECTION TO BE HELD IN THE CI~ OF D~O~ ~ O~ ~ ~U~S~O~ OF T~ ~OPT~O~ OF ~ O~E P~R- CENT (1%) LOC~ S~ES ~ USE T~ WITHIN ~ CI~, DESIGNATING ~E DAY OF THE ELECTION ~ ~E POLLING PLACE, ~POINTING ELECTION OFFICIOS THEREFOR, PROVIDING T~T ~L DULY QU~IFIED RESIDENT ELECTORS S~L BE QU~IFIED TO VOTE, P~SCRIBING FO~ OF B~LOT, PROVIDING FOR NOTICE OF ELECTION, CONT~NING OT~R PROVISIONS ~LATING TO SAID E~CTION, PROVIDING FOR SEVE~BILI~ ~ DEC- C~RING ~ E~RGENCY ~ Article 1066c, Vernon's Texas Civil Statutes (Acts 1967~ 60th Leglslature, Regular Sesslon, Chapter 36~ Page 62) authorizes the governing body of any c~ty~ town or v~llage ~n Texas to call an elect~on for the purpose of adopting a local sales and use tax w~thln such c~ty~ to~ or v~llage, Now Therefore~ THE COUNCIL OF T~ CITY OF DENTON~ TE~ ~REBY O~AINS SECTION I That a special elect~on shall be held in and throughout the Clty of Denton~ Texas~ on the 9th day of Dece~er~ 1967~ at which elect~on there shall be submitted to the resident qualified voters of sald Clty~ for their action thereupon~ the followlng propositions "FOR adoption of a one percent (1~) local sales and use tax w~th~n the c~ty" "AGAINST adoption of a one percent (1~) local sales and use tax within the c~ty" S,ECTION II That sa~d elect~on shall be held at one polling place for all qualified voters of sa~d C~ty~ and the polling place and presiding officers for sa~d elect~on shall be~ to w~t POLLING P~CE P~SIDING OFFICERS CO~NI~ BUI~ING JElL S~TH~ CIVIC CENTER PRESIDING JUDGE AT BELL ~ E~T MCKI~EY ~4 ~ pd D ~& ~ DENTON~ TE~ ~TE~ATE PRESIDING ~GE The Presiding Judge at such elect~on shall appoint not less ~han two (2) clerks SECTION III That sa~d elect~on shall be held ~n accordance w~th the Const%tut~on and laws of the State of Texas~ and all duly qualified resident electors of the C~ty of Denton~ Texas shall be qualified to vote Page One SECTION IV. That the ballots of said election shall conform to the require- ments of Section 2, Subsection G, of Article 1066c, Vernon's Texas Civil Statutes (Acts 1967, 60th Legislature, Regular Session, Chapter 36, Page 62), and to the requirements of Chapter 6 of the Election Code of the State of Texas, as amended, and the language to be printed thereon shall include the following OFFICIAL BALLOT INSTRUCTIONS Place an "X" in the square beside the state- ment indicating the way you wish to vote. ~ FOR adoption of a one percent (1%) local sales and use tax within the city ~ AGAINST adoption of a one percent (1%) local sales and use tax within the city SECTION V That election judges and clerks are directed to comply with Article 6 06, Election Code of the State of Texas, as amended (Section 2 of House Bill 181, Acts 1967, 60th Legislature, Regular Session, Chapter 452, Pages 1026, 1028), which provides that a square shall be placed beside each proposition in which the voter is instructed to place an "X" or other clear mark to indicate the way he wishes to vote, but which also provides that failure of a voter to mark his ballot in strict conformity with the directions on the ballot shall not invalidate the ballot, and the ballot shall be counted if the intention of the voter is clearly ascertainable, except where the law expressly prohibits the counting of the ballot. It is specifically provided that the election officers shall not refuse to count a ballot because of the voter's having marked his ballot by scratching out the statement of proposition for which he does not wish to vote SECTION VI. That notice of the election hereby ordered and called shall be given (a) by publication on the same day of two successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be at least twenty-one (21) days prior to the date set herein for such election, and (b) by, posting of such notice at the polling place of the City not less than twenty (20) days prior to the date set herein for such election It is hereby found and determined that the Denton Record- Chronicle is a newspaper published within the City of Denton, Texas, and is a newspaper of general circulation within said City Page Two PASSED APPROVED this ~___ day of November~ 1967 Martln~ Mayor of Denton~ Texas ATTEST ~~ Secretary City of Denton~ Texas APPROVED AS TO LEGAL FORM J~k Q.
