1967-020 AN ORDINANCE AMESDING THE CODE OF THE CITY OF DENTON, TEXAS, REMOVING THE CHARGES FOR USE OF THE CITY SANITARY LANDFILL BY PERSONS OTHER THAN COMMERCIAL HAULERS WHO RESIDE WITHIN THE CORPORATE LIMITS, PROVIDING A PENALTY FOR USING SUCH LANDFILL BY OTHER PERSONS WHO FAIL TO PAY THE PROPER CHARGE THEREFOR, OR FOR ANY UNAUTHORIZED USE, REPEALING CONFLICTING ORDINANCES, PROVIDING A SAV- INGS CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I. That the Code of Ordanances of the Caty of Denton, Texas, is hereby amended by substatutang new Sections 12-16 (d) and 12-19 1 an Chapter 12 of said Code which shall hereafter read as follows Sectaon 12-16 Unauthorized handling of garbage, trash or rubbash prohab~ted (d) It shall be unlawful for any person to enter the Caty Sanatary Landfall except City Officials and employees of the sanatatlon dzvas~on persons operatzng under a permit granted under the provas- ·ons of Section 12-9, above, persons del~verang their own garbage, trash or rubbish from premises located wathln~the corporate lamzts of the City of Denton; and persons payzng the charges required by Section 12-19 1, below Sectzon 12-19 1 Charges for use of the City Sanitary Landfzll The following charges shall be pald by persons not re- s~dang wathan the corporate lamits of the City, and by per- sons operating under a permzt as requzred by Section 12-9 regardless of residence, for use of the Czty garbage, trash and rubbish dasposal grounds, known as the Sanitary Landfzll (a) Automobiles, station wagons, one-half ton p~ck-ups and two wheel trailers shall be charged fifty cents ($ 50) for each load disposed of (b) Pmck-up trucks w~th sade boards, and all other vehicles w~th a carrying capacaty of less than one and one-half tons or five (5) cubic yards, whlch- ever ~s the smaller, shall be charged one dollar ($1 00) for each load dzsposed of (c) Ail larger vehzcles shall be charged two dollars ($2 00) for each load dlsposed of, excepting those vehicles described below (d) Conunmrc~al, lmcensed haulers and ~nstztutlonally owned packer-type trucks shall be charged fave dollars ($5 00) for each load 4~sposed of Monthly rates for regular use of the Sanitary Landfill may be contracted for w~th the City under special cIrcum- stances, in which case the above per load charge will not apply SECTION II. The violation of any provision of this ordinance shall be punished by a fine of not exceeding two hundred dollars ($200 00), and each day any such v~olatlon continues shall constitute a separate offense (Note to Editor this penalrprovlslon need not be printed in code as it expressly comes within purview of Section ~ ) SECTION III. That all ordinances or parts of ordinances ~n force when the provls~ons of this ordinance become effective which are ~nconslstent or in conflict with the terms or provisions contained in this ordinance are hereby repealed to the extent of any such conflict Code Sections 12-16 (d) and 12 19 1 are e~pressly repealed SECTIQN IV That if any section, subsection, paragraph, sentence, clause, phrase or word in th~s ordinance, or application thereof to any person or circumstance ~s held invalid by any court of competent ]urlsdlot~on, such holding shall not affect the validity of the remalnlng portions of this ordin- ance, and the City Council of the C~ty of Denton, Texas, here- by declares it would have enacted such remalnlng portions despite any such invalidity SECTION V That this ordinance shall become effective fourteen (14) days from the date of 1ts passage, and the City Secretary is hereby dlreoted to cause the caption of th~s ordinance to be published twice in the Denton Record Chronicle within ten (10) days of th~s date of lts passage PASSED AND APPROVED th~s 23rd day of May, A D 1967~ ATTEST ~~ty Secretary ' City of Denton, Texas APPROVED AS gO LEGAL FORM l k'Q Barton, City Attorney y of Denton, Texas
