AN ORDINANCE AMENDING THE CODE OF THE CITY OF
DENTON; PROVIDING FOR THE DISPOSITION OF IM-
POUNDED PROPERTY, PROVIDING THE MANNER AND
GIVING OF NOTICE OF PUBLIC SALE, PROVIDING A
STORAGE FEE IN ADDITION TO THE IMPOUNDING FEE,
AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
SECTION I
That the Code of Ordinances of the City of Denton, Texas,
is hereby amended by adding new Section 24-131 1 to Chapter
24 of said Code which shall hereafter read as follows
SECTION 24-131 1 - Disposition of Impounded Property,
Storage Fee
(a) In the event that any impounded property shall
not be redeemed by the owner or his authorized
agent within thirty (30) days, it shall be sold
at public auction to the highest bidder after
notice of such sale as hereinafter provided
(b) The C~ty Secretary shall post notice of such
auction sale in three (3) public places within
the Clty of Denton, and such notices shall be
posted not less than ten (10) full days
ately preceedlng the sale, and shall give the
exact date and hour of the sale and a descrip-
tion of the motor vehicle, vehicle or other
property to be sold at such auction
(c) Ail auction sales under the provisions of th~s
Section shall be held at the place designated
in the Notice of Sale
(d) The City Secretary shall conduct such auction
sales, and he shall have the r~ght to reject
any and all bids if same are determined by
him to be unreasonably iow
(e} In the event that the owner of any such ~m-
pounded property shall claim the same at or
before the auction sale as provided herein,
possession of such property shall be given to
such owner upon payment of the impounding fee
plus the sum of Three Dollars ($3 00) per day
storage fee for each day such property has been
impounded beyond the ~nlt~al thirty (30) day
per~od
SECTION II
That if any section, subsection, paragraph, sentence,
clause or phrase of this ordinance should be declared ~nvalld
for any reason whatsoever, such decision shall not affect
the remaining portions of this ordinance, which shall re-
main in full force and effect, and to this end the provisions
of thls ordinance are hereby declared to be severable
SECTION III
That th~s ordinance shall be cumulative of all ordinances
of the Clty of Denton, and of all laws of the State of Texas
SECTION IV
That this ordinance shall become effective immediately
upon its passage, and the Clty Secretary is hereby directed
to cause the caption of this ordlnance to be published twice
in the Denton Record-Chronicle within ten (10) days of the
date of its passage
