1967-006 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF DENTON,
TEXAS, CALLING AND ORDERING AN ELECTION TO BE HELD ON
THE 4TH DAY OF APRIL, A. D. 1967, THE SAME BEING THE
FIRST TUESDAY IN SAID MONTH, FOR THE PURPOSE OF ELECT-
ING THREE (3) COUNCILMEN FOR THE CITY OF DENTON, TEXAS,
IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 3, SECTION
3.01 (a) OF THE CHARTER OF THE CITY OF DENTON, TEXAS,
ESTABLISHING THE HOURS AND PLACE FOR THE SAID ELECTION,
PROVIDING FOR PUBLICATION OF THIS ORDINANCE AND POSTING
IN THREE PUBLIC PLACES IN THE CITY OF DENTON AS NOTICE
OF SAID ELECTION, DIRECTING THE CITY SECRETARY TO MAKE
UP THE OFFICIAL BALLOT, CAUSING THE SAME TO BE PRINTED
AND DELIVERED TO THE PRESIDING OFFICER, APPOINTED HEREIN,
PROVIDING FOR THE MAKING OF OFFICIAL RETURNS OF SAID
ELECTION, PROVIDING FOR THE CANVASSING OF THE RETURNS
OF THE SAID ELECTION AND DECLARING THE RESULTS OF SAME
BY THE CITY COUNCIL, AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I t
That an electmon shall be held mn the Munlczpal Bumldmng
in the City of Denton, Texas, located at 221 North Elm Street,
between the hours of 8 00 o'clock A. M. and 7 00 o'clock P M.
on the 4th day of April, A. D. 1967, said day bezng the first
Tuesday of sa~d Month, for the purpose of electing three (3)
Councmlmen for the Cmty of Denton, mn accordance with the
provlsmons of Artmcle 3, Sectzon 3.01 (a) of the Charter of
the City of Denton, Texas.
SEC ION II.
That the three can~dates who receive the highest number
of votes shall be declared elected to the C~ty Council of the
Cmty of Denton, Texas.
SECTION III~
That notmce of samd elect~on shall be g~ven by the posting
of true copies of this ordmnance, smgned by the Mayor and
attested by the City Secretary, in three public places ~n
the ¢lty of Denton, one of whmch places shall be at the Mun~cmpal
Building, for thmrty (30) consecutive days prmor to the date of
the said election and thls ordinance shall be published ~n full
one tmme mn the Denton Record-Chronicle at least thmrty (30)
days prolr to the said election.
SECTION IV.
That Jewel Smith is hereby appomnted presmdmng Judge of
sazd electmon, and the said presmdlng Judge shall appomnt such
assmstants as may be necessary to properly conduct samd electmon.
SECTION V
That the Cmty Secretary shall make up the official ballots
from the names presented to hmm by applmcatmon or nomlnatmng
petltmons as provided by Artmcle 3, Sectmons 3.02 and 3.03 of
Charter of the City of Denton, Texas, and he is hereby authorized
and d~rected to have the ballots to be used ~n such elect~on
prznted and delmvered to the said presldzng Judge.
SECTION VI.
That ~mmed~ately after the counting of the votes the preszd~ng
Judge shall delzver the off~czal returns of the election to the
C~ty Secretary.
,S CTIO vii.
That on the Monday next following the electzon, the C~ty
Councll shall canvass the returns and declare the results which
shall be recorded in the Minutes of the Counczl.
SECTION VIII~
That the three ear, dates who receive the h~ghest number of
votes shall be declared elected and the Mayor shall deliver
Certificates of Electzon to the successful can~dates. If two
or more can~dates shall t~e, the Counczl shall order a second
elect~on to be held on the 14th day after the f~rst election
at which only the names of the can~dates who recezve the same
number of votes at the first electzon which resulted in a t~e
for the h~ghest number of votes, shall be printed on the ballot.
In the event of a tze at such second election, the can~°dates
shall cast lots to determine which shall be declared elected.
SECTION IX.
Th~s ordinance shall become effectzve ~mmedlately upon
· ts passage.
