FIXIN~ A ¢!~R~E AND LIEN A~AINST ALL SAID ABUTTIN~ PROPERTY AND THE R~L AND TRUE OWNERS THEREOF~ PROVIDING FOR THE ISSUANCE OF AS~:I~N~ELE CERTIFICATES UPON THE COMPLETION AND ACCEPTANCE OF SA]iD WORK~ PROVIDING FOR THE MANNER OF PAYMENT OF SUCH ASSESS- ME~'T, THE RATE OF INTEREST AND THE CONDITIONS OF DEFAULT TH] COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS, THAT~ SE( ~IQN Z. Th~ City Council of the~ City of Denton, Texas, finds the City Enginee~ has prepared an estimate of the cost of improvements on Pro, eot, num~:~e=ed ~iVE , , , ......... , the estimate of cost having been completed and filed in the office of ~he City Enginee~ ten days ~rior to the date of this ordinance and the esti~ mates o~ cost leo preps=ed and filed are hereby approved. The City Council further finds that the plans and specifications prepared by the Cit~' Engineer for the improvements of the herein named streets are satisfactory, and such plans and specifications are hereby approve~ TbS City Council finds that due notice and opportunity to be heard o~ this assessment has been given, and that notice Of the public ~earing was given at ~least ten days before the date of the hearing}and inserted at least three times in a newspaper published in the ~ity of Denton, as required by law The public hearing was opened and held in accordance with the ordinance and notice, at which t~me and place an opportunity was given to all of the persons, firms, 'orporations and estates owning or claiming any such abutting propert', or any interest ~herein, to be heard and to offer evidence as to a 1 matters in accordance with said ordinance and notice In the course of the hearing, Sufficient and competent evidence was heard s~owing that the improvemants to be placed along the property involve( would xn each instance increase the value of such property by more than the cost of such improvements to ~he property owners Based oh the evidence, matters, testimony and objections considered at such heari~g~ the said City Councml has determined that the properties and each and every parcel of such property abutting upon the streets and units as hereinafter set out will be enhanced in value a~Ld epecifioally bene~ited in an amount in excess of the ~ amount ¢,f the !Cost of such improvements proposed to be, and as here- inafter assessed against each of said parcels of property, abutting upon sa~d streets and the real and true owners thereof ~ Th~, cost ~of improvements of each portion of street ordered im- proved ~,erein Shall be appo=~tioned among the parcels of abutting property' and oWnerS thereof lin accordance with the front foot plan, which p~,an is Ifound to be fair and equitable SECTION ~ There is hereby levied and assessed ageznst the parcels of pro- perry d~scrzbed in Exhibit E attached hereto and made a part hsreof, and against the real and true owners thereof, whether such owners are named or correctly named in such exhibit or not, the sums of money shown opposite the description of property in such exhibit ,SECTION $. Wh~re more than one person, firm or corporation owns an interest · n any parcel of property described in Exhibit B, each owner shall be pers9nally liable only for the pro rata share of the total assess- ment against such property in proportion as such owner's interest bears to the real ownership of such property, and such owner's inter- est in such property may be released from the assessment lien upon payment~of such proportional sum The several sums mentioned in Exhibit B and assessed against the respective parcels of property described therein and the owners there- of and interest thereon as specified herein, together with expenses of collection and reasonable attorney's fees, if incurred, shall be a first and prior lien on the respective parcels of property assessed superio~ to all other liens and claims, except State, County, School District and City Ad Valorem taxes, and shall be a personal liabil~ty and charge against the res1 and true owners of such property, whether such owners are named or correctly named in such exhibit or not SECTION 5~ Th~ several sums mentioned in Exhibit B and assessed against the respective parcels of property described therein and the owners thereof, shall be payable by one of the alternative methods below set forth~ ' (A) Placing an amount equal to the paving assessment in escrow for the City of Denton with the City Engineering Department to be pa~d upon completion and acceptance of the paving by the City of|Denton, or (B) Ex~outing a note or notes, payable to the city of Denton in an amount e~ual to the paving assessment to be assessed against the ab~tting property, said notes to be payable in egual monthly installments not to exceed ~years Interest on the note or notes, payable in equal monthly install- meDtS, shall be at a rate of 8% per annum Any balance on any no~e that is due end owing and unpaid shall carry an interest rate of 8~ per annum until paid Inl the event that the total amount of paving assessment against an~ one lot is less then two hundred dollars ($200), two notes sh~11 be executed by the owner of the property, payable to the City of Denton as follows~ Th~ first note equalling 50~ of the paving assessment to be assessed against his ~roperty is to be paid upon completion and acceptance of the paving by the C~ty of Denton The second note equalling the remaining 50% of the paving assessment to be assessed against the property shall be pay- able in twelve equal monthly installments, the first install- meat being due and payable thirty days after the completion an~ acceptance of the paving by the city of Denton, and the balance shall be paid in eleven equal monthly installments, parable on the same date of each month thereafter, and shall bear interest at the rate of 8% per annum An~ such installment may be paid at any time before maturity by,the payment of the principal and accrued interest thereon Pa~t due principal and interest shall bear interest et the ss~ rate from maturity until paid If default is made in th~. amount of any such installments or interest, the entire un~aid balance of the assessment plus interest shall, without no~:ice to the owners, and et the option of the holder of the Ce~"tificate of Special Assessment, if any, immediately become dui and payable, together with expenses of collection and rea- soneble attorney's fees, if incurred In the event of such default, oollection shall be enforced by suit in any courts having Jurisdiction (C) In the event the amount payable for the paving assessment is not placed in escrow, as provided in persgrsph (A) above, or bylthe execution of notes, as provided in the foregoing para- graph, the full sum of the assessment es shown in Exhibit B shall be due end payable upon the completion and acceptance oflthe work provided for herein SEITION Fo~ the purpose of evidencing the several assessments levied, assigna~le certificates may be issued by the City of Denton upon completion and acceptance of the iraprovements Such certificates, if issugd, shall be executed by the Mayor, signing the same, or by his ~ecsimile signature impressed thereon, and attested by the City SeCretary, under the ir~ress of the corporate seal, and shall be payable to the City of Denton or its assigns, Such certificates shall provide in substance the following (A) Th~ amount of the assessment ss specified in Exhibit B, together with time, terms, rate of interest and conditions oflpayment as specified in Section 5 above (B) The terms and conditions of default as specified in Section 5 above. (C) Thdt the proceedings with reference to making the improve- me,ts therein referred to have been regularly had in comp- l~nce with the law and that all prerequisites to the fixing of lthe. assessment lien against property described in the certificate and the personal liability of the owner or owners thereof have been performed (D) Co~pons may be ettaohed in evidence of the several installments which mey be signed with the facsimile signatures of the Mayor and City Secretary (E) That the City of Denton shall exercise all of its lawful powers when requested by the holder to aid in the collection thereof SuCh certificates may also contain other appropriate end pertinent recitals. SECTION 7 Inlthe event any such assessment for any reason whatsoever shall b$ held or determined to be invalid or unenforceable, then the City Council r~serves the right to supply any deficiency in proceedings with reference thereto and correct any mistake or zrregularity in connection therewith, and at any time to make and lev~ reassessments after notice and hearings as nearly as possible in the ~lanner provided by the Statute referred to in Section,8! hereof for original assessments and sub3ect to the pro- visionslthereof with reference to special benefits ,S SuCh assessments are levied under the provisions of the Acts of the ~egislature of the State of Texas, known as Article ll0§b of Vern~n's Texas Civil Statutes. Exhibit "A° to the release contained one incorrect ta�c account number and four incorrect street names. This Corrected Release of Paving Liens Assessed Against Homesteads by Ordinance No. 66-30 corrects the above referenced enors.
