1966-033 ORDINANCE NO. ~ ~ ~ ORDINANCE DIRECTING THE PUBLICATION OF NOTICE TO BIDDERS THE STATE OF TEXAS ~ COUNTY OF DENTON ~ CITY OF DENTON ~ THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS 1. That the City Secretary of the City of Denton, Texas, is hereby authorized and directed to ~ssue a Not,ce to B~dders in substantially the following form NOTICE TO BIDDERS Sealed proposals addressed to the City of Denton, Denton County, Texas, will be received at the Off,ce of the City Secretary, C~ty Hall, Denton, Texas, until 10 00 A.M., C S T , October 13, 1966, for constructing ~mprovements at the City's Municipal Airport as follows Contract A For Constructing One (1) Metal A~rplane Hangar with Off,ce Space Contract B For Constructing Ten (10) Metal Airplane "T - Hangars" Contracts "A" and "B" will be awarded separately, but Bidders are lnvlted to bid for either or both of said contracts Bidders must submit with their b~ds a Cashiers or Certlf~ed Check payable to or endorsed, w~thout recourse, to the City of Denton, Texas, ~n the amount of $4,500 for Contract A and $1,750 for Contract B, or submit a Proposal Bond ~n the same amounts from a reliable Surety Company, as a guarantee that B~dder w~ll enter lnto a contract and execute the required bond and guarantee w~thln five (5) days after notlce of award of contract to h~m Bids without check or Proposal Bond will ~ot be considered. In accordance with Article 5159(a) V A.T S the successful B~dder will be required to furnish not only a Performance Bond · n the amount of the contract, but also a Payment Bond in the amount of the oontract, for the protection of all claimants supplying labor and materials as defined ~n said law. The bonds must be exeouted by an approved Surety Company holding a permit from the State of Texas to act as Surety, and acceptable accord- · ng to the latest l~st of companies holding cert~flcates of authority from the Secretary of the Treasury of the United States, or other Surety or Sureties acceptable to the C~ty All prices must he stated in both scrlpt and figures The City reserves the right to re3ect an~ or all b~ds and to waive formallt~es In case of ambiguity or lack of clearness in stat- lng the price ~n the b~s, the City reserves the r~ght to con- s~der the most advantageous construction thereof, or to reject the b~d Unreasonable or unbalanced prices w~ll be considered sufficient cause for re]ect~on of any hid or b~ds Bidders are expected to inspect the site of the work and to form themselves regarding local conditions and conditions under which the work is to be done Not less than the prevailing rate of per diem wages for work of similar character in the City of Denton, and County of Denton, and not less than the general prevailing rate of per diem wages for legal holidays, Saturdays, Sundays, and overtime work shall be pa~d to all laborers, workmen and C~ty Secretary, City Hall, Denton, Texas, and copies of said ~nstru- ments may be obtained from said City Secretary, upon depgslt of $5 00 as a guarantee of the safe return of the plans and specifications Said deposit will be returned provided (1) The Bidder returns the plans and specifications within 72 hours after the bid date, OR (2) The Non-Bidder returns the plans and specifications in good condition 72 hours prior to h~d date, Otherwise the entire $5.00 deposit will be forfeited and no re- fund made Suppliers may obtain Specifications and Plans at the address stated above upon deposit of Five ($5.00) Dollars, which sum is non-refundable It is the ~ntentlon of the City Council of the City of Denton to issue the time warrants of the City of Denton for payment of a part oF of all the Contracts to be made pursuant to this Notice, and to pay part oF all of the Engineer's fees in con- nectlon therewith The maximum amount of t~me warrant indebted- ness to be incurred for said purposes shall be $125,000, the maximum rate of interest such time warrants are to bear is 4½% per annum, and the maximum maturity date thereof shall be 1986 The City has obtained a commitment f~om a bank for the purchase of said time warmants from the Contractor, so that said warrants shall be delivered to the Contractor and the Contractor will immediately deliver said warrants to such bank and receive in cash the par value therefor.
