1966-019 AN ORDINANCE AMENDING AND CORRECTING ORDINANCE NO.
64-54 BY CORRECTING THE FIELD NOTE DESCRIPTION OF
THAT PORTION OF OAKLAND STREET LYING BETWEEN
McKINNEY AND ~ONGRESS AVENUES WHICH STREET PORTION
WAS CLOSED AND ABANDONED BY SAID ORDINANCE ON DEC-
EMBER 8, 1964 AS A PUBLIC CONVENIENCE AND NECESS-
ITY, AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I.
The City Council at a public meeting held on the 8th day
of December, 1964, found and determined that the public con-
venlence and necessity no longer required the continued exist-
ance of a portion of Oakland Street lying between McKlnney
Avenue and Congress Avenue running North 569 feet from a point
248.4 feet North of the North right-of-way line of McKlnney
Street, in the City of Denton, Denton County, Texas, and further
determined that the construction and development of the current
Clvlc Center complex requires said closing and abandonment
The City Council hereby finds that the field notes of
said portion of Oakland Street were in error due to the fact
that a call was left out, Therefore, the following field notes
are hereby substituted in said Ordinance for the purpose of
correcting the field notes described therein
A tract of land being part of Oakland Street lying between
Blocks 123 and 115 as shown on the official C~ty of Denton
plat record. Said tract being in the B B.B and C R R Survey,
Abstract No. 185.
BEGINNING at a point 248 4 feet North of the North right-
of-way line of McKlnney Avenue, said point being in the West
rlghtTof-way line of Oakland Street and the East property line
of Lot 1, Block 115 as shown on the plat records of the City
of Denton, Texas,
THENCE North with the West line of Oakland Street a dls-
tancelof 569 feet to a point for a corner,
THENCE East a distance of 40 feet to a point for corner,
said point being in the East right-of-way line of Oakland Street,
THENCE South with the East rIght-of-way lane of Oakland
Street 569 feet to a poant for corner, saad poant beang 248.4
feet North of the North raght-of-way l~ne of MoKanney Avenue,
THENCE West a dastance of 40 feet to the Place of Begannang
SECTION II.
Thas Ordanance shall be effectzve as of the 8th day of
Decemberm A. D 1964, the date of ars original passage, and
shall an all ways date back to sa~d oraganal passage.
SECTION III.
That af any sectaon, subsectaon, paragraph, sentence, clause
phrase or word in thas ordanance~ or applacataon thereof to
any person or carcumstances as held anvalad by any court of
competent ]urasdactaon, such holding shall not affect the
valad~ty of the remaanzng port~ons of thas ordanance~ and the
Caty Council of the City of Denton, Texas, hereby declares at
would have enacted such remaanang portaons despate any such an-
valldaty.
SECTION IV.
The City Secretary is hereby darected to cause the captaon
of this Ordinance to be published twice in the Denton Record
Chronacle within ten (10) days of the date of its passage.
