1966-034 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, REGULATING THE DIS- CHARGE OF WASTE WATER FROM SWIMMING POOLS BY RE- QUIRING SAME TO BE DISCHARGED INTO THE STORM SEWER OR SANITARY SEWER SYSTEM, PRESCRIBING THE ~IZE OF LINE REQUIRED FOR SUCH DISCHARGE, PROVID- ING OTHER RESTRICTIONS, PROVIDING A PENALTY FOR VIOLATIONS HEREOF, PROVIDING A SAVINGS CLAUSE, REPEALING CONFLICTING ORDINANCES, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS SECTION I That the Code of Ordinances of the City of Denton, Texas, as hereby amended and suDplanted by substltutang new Article 4 74 (k) to Chapter Four of said Code whach shall hereafter read as follows Article 4 74 (k) Swimming Pools All waste water from swimming pools shall be d~scharged into the storm sewer system ~f one is situated wlthan one hundred feet (100') of any such pool If no storm sewer system is situated within one hundred feet (100'), all waste water from any such pool shall be dis- charged into the sanitary sewer system Any such connection shall be made under the dar- ectlon of the Plumbing Inspector in one of the following manners. (1) Pumped The discharge lane of all waste pumped Into a sanatary sewer shall not exceed two inches (2") in d~ameter (2) Gravity A gravaty flow waste water l~ne connected to the sanitary sewer system shall not exceed four inches (4") in diameter Any such gravity flow llne shall have a free fall d~scharge ~th a minimum air break of four inches (4"). Under no condition shall cross connections exist between a swimming pool, swimming pool water, or the reclrculatlon system and the water supply or the waste drain or the sewer (Cross reference - Permits) SECTION II Any person, assoclatmon of persons, firm or corporation violating any provision of this Ordinance for which a penalty is not otherwise provided shall be fined upon conviction any amount not exceedlng Two Hundred Dollars ($200 00), and each day any such violation continues shall constitute a separate offense SECTION III That all ordinances or parts of ordinances in fomce when the provisions of this ordinance become effective which are inconsistent or in conflict with the terms or provisions contained in this ordinance are hereby repealed to the extent of any such conflict SECTION IV That if any section, subsection, paragraph, sentence, clause,phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTIO That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record Chronzcle wlthzn ten (10) days of the date of its passage ~~ PASSED AND APPROVED th~s ~day of A D. 1966 Warren Whltson, Jr , Mayor City of Denton, Texas ATTEST ~rooks Holt, Czty Secretary C~ty of Denton, Texas APPROVED AS TO LEGAL FORM
