ORDINANCE NO. 2010-114
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A ZONING
CHANGE FROM THE NEIGHBORHOOD RESIDENTIAL 2 (NR-2) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION TO NEIGHBORHOOD RESIDENTIAL MIXED
USE 12 (NRMU-12) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION, AND
SUPERSEDING AND REPEALING ORDINANCE NOS. 87-113, 87-154, AND SPECIFIC USE
PERMIT S-193, ALONG WITH ANY SPECIAL EXCEPTIONS OR LEGALLY
NONCONFORMING USE STATUS CREATED AS A CONSEQUENCE OF THE ZONING
CLASSIFICATION CHANGE IN 2002, FOR APPROXIMATELY 5.2 ACRES OF LAND
LOCATED AT 4000 W. UNIVERSITY DRIVE, LEGALLY DESCRIBED AS RANCH ESTATES,
BLOCK E (SW CORNER), IN THE CITY OF DENTON, DENTON COUNTY, TEXAS;
PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR
VIOLATIONS THEREOF; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE
DATE. (Z09-0011)
WHEREAS, Girl Scouts of Northeast Texas initiated a change in zoning for approximately
5.2 acres of land depicted in Exhibit "A", attached hereto and incorporated herein by reference, and
legally described as Ranch Estates, Block E (SW Corner) (hereinafter the "Property") from the
Neighborhood Residential 2 (NR-2) zoning district classification and use designation to the
Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district classification and use
designation; and
WHEREAS, on April 14, 2010, the Planning and Zoning Commission concluded a public
hearing as required by law, and recommended approval of the requested change in zoning; and
WHEREAS, the City Council finds the change in zoning is consistent with the Denton Plan
and the Development Code; and; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference.
SECTION 2. The zoning district classification and use designation of the Property is hereby
changed from Neighborhood Residential 2 (NR-2) zoning district classification and use designation
to Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district classification and use
designation.
SECTION 3. Specific Use Permit S-193, Ordinance No. 87-113, and Ordinance No. 87-154
are hereby superseded and repealed by this zoning amendment, along with any special exceptions or
legally nonconforming use status which may have been established as a consequence of the zoning
classification change in 2002.
SECTION 4. The City's official zoning map is amended to show the change in. zoning
district classification.
SECTION 5. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable.
SECTION 6. Any person violating any provision of this ordinance shall, upon conviction, be
fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall
constitute a separate and distinct offense.
SECTION 7. That this ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton,
Texas, within ten (10) days of the date of its passage.
