2011-171s:llegallour documents\ordinances1111sd11-0004 ordinance.doc ORDINANCE NO. 2011-171 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING AN OVERLAY DISTRICT AND APPROVING AN AMENDMENT TO THE QUAIL CREEK SPECIAL SIGN DISTRICT FOR 3.5 ACRES OF LAND WITHIN THE 35.5 ACRE DISTRICT LOCATED AT THE NORTHEAST CORNER OF BRiNKER ROAD AND QUAIL CREEK BOULEVARD AND ALSO KNOWN AS LOT 1, BLOCK A OF THE BIOLIFE PLASMA ADDITION, WITHIN THE CITY OF DENTON, DENTON COUNTY, TEXAS; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF, SEVERABILITY AND AN EFFECTIVE DATE. (SD11-0004) WHEREAS, Build to Suit, Inc., has applied for an amendment to the Quail Creek Special Sign District (Ordinance Number 2003-199) on real property containing approximately 3.5 acres of land within the approximately 35.5 acre district of land in the Regional Center Residential 1 (RCR-1) and Regional Center Commercial Neighborhood (RCC-N) zoning districts; such real property being more particularly described in Exhibit "A" attached hereto and made a part hereof by reference (the "Property"); and WHEREAS, on August 10, 2011, the Planning and Zoning Commission concluded a public hearing as required by law, and recommended approval of the amendment subject to conditions to the Special Sign District, and WHEREAS, the City Council finds that the amendment is in compliance with Subchapter 15 of the Development Code and consistent with the Denton Plan; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The Special Sign District is hereby approved on the Property subject to the following conditions: a. Sign "A" shall be moved to the northeast intersection of Brinker Road and Quail Creek Boulevard within the 3.5 acre property known as Lot 1, Block A of the Biolife Plasma Addition from its original location near a mutual access taken from Quail Creek Boulevard and shall be developed, constructed, used and maintained in accordance with and limited to the Sign Site Plan attached hereto and made a part hereof as Exhibit "C". The subject sign shall not be placed within any easements, rights-of-way or other encumbrances and shall adhere to the maximum effective area, dimensions and heights table attached to the original granting ordinance (2003-199). b. The allowed Sign "B" along Brinker Road frontage shall be removed from the Sign Site Plan and only Sign "A" shall be permitted for the entire 3.5 acre property known as Lot 1, Block A of the Biolife Plasma Addition. s;llegallour documentslordinances111\sdll-0004 ordinance.doc SECTION 2. This ordinance shall supersede a11 requirements of the Sign Ordinance and Ordinance 2003-199 affecting the Property that are in conflict with or addressed by the Special Sign District Plan and the Special Sign District Regulations established by this ordinance. All other provisions of the Sign Ordinance shall remain in full force and effect against the Property. SECTION 3. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 4. This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
