2017-05-01 Agenda with Backup AGENDA TRAFFIC SAFETY COMMISSION May 1, 2017 After determining that a quorum of the Traffic Safety Commission of the City of Denton, Texas is present, the Chair of the Traffic Safety Commission will convene an Open Meeting on Monday, May 1, 2017, at 5:30 p.m. in the City Council Work Session Room, 215 E. There was a map attached to the backup 37 that she referred too. Behrens spoke of a fire back in April that was on Texas Street. At that 38 time they were not required to provide aerial access to the buildings. Today they are required to 39 meet all code requirements. The building was so damaged it had to be re-built. 40 Currently they have to provide a 26 foot aerial apparatus fire lane. The street is the fire access 41 and is allowed by code. 42 43 Staff is asking to restrict parking one block from Vine to Frame on both sides. 44 45 Hennen asked how wide the street is. Behrens answered 30 feet. 3 Page 2 of 3 1 Lyke asked how tall can a structure be without having the aerial apparatus. Behrens answered 30 2 feet and this structure is 34 feet. 3 4 Behrens stated there was one person that responded to the letters. 5 6 Citizen input included: 7 Lt. D.L. Law—TWU Patrol Services 8 Jay Noyd- 601 Texas Street- against no-parking 9 10 Motion was made by Chair Campbell second by Commissioner Nancy DiMarco vote 6-0 11 approved. 12 13 4) Receive a report, hold a discussion and provide direction relating to a no park any time 14 restriction on Denton Street from Oak Street to Hickory Street. 15 16 Pritam Deshmukh spoke about this item stating it was initiated by several complaints from 17 residents as well as citizens. This portion of Denton is more narrow that the rest of Denton 18 Street north of Oak. The street width is 24 feet. There are issues with emergency vehicles on 19 this section of street as well. Staff is recommending approving an ordinance to Council for no 20 park on both sides of Denton from Oak to Hickory. 21 22 Citizen input included: 23 Joe Zelmer, Owner- 620 West Hickory—in favor of the no park, option to no park east side only 24 Jeff Webenka- 619 West Oak-would like no park on east side only. 25 26 Deshmukh addressed the need to no park both sides. Since the street is 24 feet, if you leave an 27 eight foot parking lane it would only leave 16 feet which is less than the minimum fire lane. 28 29 Motion was made by Commissioner Hennen second by Chair Campbell vote 6-0 approved. 30 31 5) Receive a report,hold a discussion,and make a recommendation regarding relocating the existing 32 speed limit sign and extending the 20 mile per hour(MPH)zone along Bell Avenue(northbound 33 direction)north of Texas Street in the Texas Woman's University(TWU)campus. 34 35 Pritam Deshmukh talked about this item regarding extending the 20 MPH speed zone. The primary 36 reason is that the TWU campus ends at Texas and anything north is within the campus. 37 38 Lt. DL Law, Patrol Service - TWU talked about this item and is in favor of slowing the traffic and 39 moving the sign. 40 41 Motion was made by Chair Campbell second by Commissioner DiMarco vote 6-0 42 approved. 43 44 6) Receive a report,hold a discussion and provide staff direction regarding a proposal to implement 45 a time limited parking district in the neighborhood north of Oak, south of Scripture, east of 46 Marietta and west of Fulton. 4 Page 3 of 3 1 Mark Nelson talked about this item looking at options associated with this particular neighborhood. 2 There has been much on street parking pressure in this area. Staff initially attempted to advance a 3 time restriction that could be Monday through Friday 8am to 5pm. There were some similar items 4 where the fire code would supersede the proposed plan,some of the streets are less than 28 feet. Staff 5 no longer believes the time restriction is a valid option. Staff will also continue to work with UNT. 6 UNT has requested increasing the parking meter rates as part of the interlocal agreement with the City 7 of Denton and have also asked to cover additional streets inside the campus for enforcement. UNT 8 also has the leverage of holding transcripts if citations are not taken care of. 9 10 Staff will continue to look for other options. Signs have been posted not to park within 30 feet of an 11 intersection. 12 13 Commissioner Hennen clarified that Marietta is included,Nelson agreed it is. 14 15 7) Discussion of the Matrix representing items for discussion for future Traffic Safety Commission 16 meetings. 17 18 #5—Gregory asked assisting DCTA for parking restrictions at the bus shelters. 19 20 Add—Owen—Shady Oaks and Woodrow—Signal timing 21 Add—Robinson-Hickory and Bell- Signal timing 22 Add—FM 426 Hennen—sidewalk not until 2020. Gov't Code §551.002 • The requirements under the TOMA are mandatory for every governmental body. • The public has a statutory right to observe its government in action . Open Meetings Governmental body includes: • The City Council; • A deliberative body with rulemaking or quasi-judicial power that is classified as a department, agency or political subdivision of a municipality (e.g., housing authority); and • The governing board of a special district created by law. • The TOMA does not apply to a purely advisory body. • Exceptions: • Planning & Zoning Commissions (Tex. Loc. Gov't Code § 211.075) • State Nursing Advisory Committee (Tex. Health & Safety Code § 104.0155(e)) Tex. Gov't Code §551.001(3); Tex. Att'y Gen. Op. No. GA-0232 (2004) at 3-5 8 Open Meetings • To trigger the TOMA provisions, there must be : • A quorum of members of a gov't body; AND • Public business that the gov't body has authority to supervise or oversee is deliberated or discussed . • "Deliberate" or "Discuss" includes: • Receiving information from; or • Giving information to; or • Asking questions of; or • Receiving questions from any Yd party, including gov't employees. • This can be for either a meeting in which the gov't body participates OR for which the gov't body is responsible. 9 Open Meetings: "Deliberate or Discuss" • A gov't body may receive information from a member of its body or from a staff member without prior notice if the information is related to an "item of community interest:' • An "item of community interest" includes: (1) expressions of thanks, congratulations, or condolence; (2) information regarding holiday schedules; (3) an honorary or salutary recognition of a public official, public employee, or other citizen, except that a discussion regarding a change in the status of a person's public office or public employment is not an honorary or salutary recognition for purposes of this subdivision; 10 Open Meetings: "Deliberate or Discuss" (4) a reminder about an upcoming event organized or sponsored by the governing body; (5) information regarding a social, ceremonial, or community event organized or sponsored by an entity other than the governing body that was attended or is scheduled to be attended by a member of the governing body or an official or employee of the political subdivision; and (6) announcements involving an imminent threat to the public health and safety of people in the political subdivision that has arisen after the posting of the agenda. Tex. Gov't Code §551.0415 Open Meetings: "Deliberate or Discuss" • Written electronic communications on a gov't body controlled website DO NOT constitute a "meeting" or "deliberation" when : • Communication is displayed in real time to Internet message board for at least 30 days; • Website/Internet application must be owned or controlled by gov't body and is the gov't body's only Internet message board, and it is prominently displayed on the gov't body primary webpage or one click away; • Communication is written by member of gov't body or employee with the name and title if by employee; • Communication/posting is archived and accessible to the public for at least 6 years after the post; AND No vote or action takes place as a result of the written communication/posting. (Effective September 1, 2013) (S. B. 1297, 83rd R. Session 2013) 12 Open Meetings • Quorum: A majority of a governmental body • Quorum can be established electronically (email, social media, etc.) • Quorum can be established verbally or via telephone • A quorum need not be established in real time • "Walking Quorum" : • When a governmental body "deliberates through a series of closed meetings of members of less than a quorum:' Att'y Gen. Op. No. DM-0095 ( 1992). • Refers to a quorum or more of a body that attempts to avoid the TOMA's purposes by deliberately meeting in numbers physically less than a quorum in closed sessions to discuss public business and then ratifying its actions in a physical gathering of the quorum in a subsequent sham public meeting. Att'y Gen. Op. No. GA-0326 (2005) at 4. 13 Open Meetings • Quorum Ex: Mayor meets with council members constituting less than a quorum to reach a conclusion on public business; the city manager keeps track of the number of council members present so as to avoid a formal consensus on public business was reached and memorializejuorum; in a memorandum prepared by the city manager, which as manifested by a vote in an open meeting. See Esperanza Peace and Justice Center v. City of San Antonio, 316 F. Su pp. 2d 433 (W. D. Tex. 2001) . • The TOMA generally excludes: • Purely Social Gatherings; • Conventions; and • Workshops/Training Sessions. Tex. Gov't Code §551.001(4)( b)(iv) • Caution : Even informal social settings could be subject to the TOMA if the quorum and discussion elements are met. • When no formal action is taken and any discussion of public business is incidental to the social gathering, there is no "meeting" for the purposes of the TOMA. 14 Notice Requirements • Written notice of the date, hour, place and subject of each meeting must be given at least 72 hours before the meeting and placed on the city's physical or electronic bulletin board at a place convenient to the public in city hall . • This notice must also be posted on website, if the governmental entity maintains a website. • Notice is required to be readily available during normal business hours. • Notice must be sufficient to inform the public of the subject matter to be addressed during the meeting. (Agendas) • Cannot simply be categories like "litigation" or "personnel :' 15 Notice Requirements • General rule of thumb: The more important the subject to the public, the more specific the agenda should be of that subject. • Emergency meeting or supplemental posting: Where there is an imminent threat to public health and safety or a reasonably unforeseeable situation, a meeting on an emergency matter may be held after two hours notice. - The agenda must describe the emergency situation. • What if we "forgot to post" an item? • Not an emergency • Recess: May recess to following business day if the action is taken in good faith and not to circumvent the TOMA s requirements. If meeting continues a 3rd consecutive business day, a new posting is required. • May not adjourn and start meeting again the same day. 16 Recordkeeping • Must keep minutes or tape recording of the open meeting. • Minutes must : • State subject of each deliberation ; and • Indicate the vote, order, decision, or other act taken . • Record of meeting must be available to the public. • Public allowed to make audio/visual record of the open meeting, but governmental body may reasonably regulate manner and location . Open Sessions • A meeting may not be convened unless a quorum of the governmental body is present. • Governmental body may discuss and take action only on items posted . • Governmental body may discuss items not on agenda, but discussion is limited as to: • when to place the item on a future agenda; • statements of factual information in response to a question; or • recitation of existing policy in response to a question . • The governmental body must vote in public unless the matter is competitive utility matter. (§551.086) • No anonymous/secret ballots. 18 Open Sessions • At a public hearing, the public has a right to speak and be heard . • Governmental body may reasonably limit speaking time. • In Denton, Citizens have 3-4 minutes and an applicant has 10 minutes; Groups of 4+ with representative speaker have 10 minutes. • At a public meeting, the public has a right to attend, but has no right to speak, although many cities, including Denton, set aside time for citizen comments. • Denton has an "open mic" policy. On Consent and regular items, citizens have 3 minutes; Citizens have 4 minutes for public reports; Groups of 4+ with representative speaker have 10 minutes. *See Sec. 2-29(f)(4) of the Denton Code of Ordinances. 19 Open Sessionsm: Video Conferencing • A member of a governmental body or its employee are allowed to remotely participate in an open meeting via videoconferencing and the gov't body member may vote and his/her attendance is counted towards the quorum (H .B. 2414, 83rd R. Session 2013); 551. 127 TGC. • The following requirements must be met: • The video and audio feed is broadcast live at the meeting; • There is at least one physical space located near the gov't body meeting place that is equipped with videoconference equipment providing atwo-way audio and visual display so that members of the public can participate with the remote gov't body member or employee; • The presiding officer of the gov't body meeting is present in the physical space; • Any member of the public present in the physical space has the same opportunity to participate in the open meeting as if it were not conducted with a videoconference; and • It is properly noticed in accordance with Chapter 551. * Note that a quorum of gov't body members is no longer required to be physically present for videoconferencing. The City of Denton requires 7 days notice to the CM for videoconferencing. See Sec. 2-29(c)(6) of the Denton Code of Ordinances. 20 Executive Session (Closed Meeting ) • A quorum in open session must be established before calling an executive session . • The authority for the executive session must be announced by the presiding officer of the governmental body. • Notice requirements for the executive session must be complied with . • Any vote regarding the executive session must occur in open session with the exception of competitive utility matters where a vote may be done in closed session . • A gov't body may not conduct a closed meeting without specific and express statutory authority to do so (See Subchapter D, Chapter 551, Texas Government Code). 21 Executive Session (Closed Meeting) • Must a gov't body use closed sessions? Closed sessions are discretionary with the governing body and not mandatory under the Texas Open Meetings Act except in certain circumstances. Executive session MAY be called for such matters as: 1. Attorney Consultation (§551.071) • Attorney for gov't body must be present for this exception to apply; general discussions of policy unre a�dto legal matters is NOT allowed. • The gov't body must also make a certified agenda or recording of the closed meeting for this exception. 2. Real Property Purchase, Lease, or Value (§551.072) • Deliberation in the open would have detrimental effect on negotiations. Having a closed meeting allows the City to obtain the best price. 3. Prospective Gift or Donation (§551.073) • Deliberation in the open would have detrimental effect on negotiations. Having a closed meeting allows the City to keep donors confidential. 22 Executive Session (Closed Meeting ) 4. Security Personnel, Devices or Audits (§551.076) • Those designed to do harm to City personnel will not be made aware of security countermeasures being deployed. 5. Public Power Utility Competitive Matters (§551.086) (electric or gas) • Only requires general description on agenda so as not to compromise competitiveness. • Holding these matters in closed session allows the City to obtain the best deal and price points and have an advantage in competitive matters. 6. Economic Development Considerations (§551.087) • Must be a prospective incentive. • Holding these matters in closed session ensures the best deal for the City in that the business prospect will not be aware of negotiated deal points. • Holding these matters in open session could be detrimental to the business prospect in the disclosure of financial statements, Trade Secrets or other proprietary information. Executive session MUST be called for such matters as: 7. Personnel Matters (§551.074) • Council MUST have closed session unless employee requests a public hearing. 8. Medical/Psychiatric Information of applicants to benefit plan (§551.0785) • Only if gov't body administers the public insurance or retirement plan. • Council MUST have closed session. 23 Executive Session ( Closed Meeting ) • Only a governmental body's members have a right to attend a closed meeting. Although a governmental body may include others in a closed meeting if necessary to the matter under consideration, it may not admit a person whose presence is against the interests of the governmental body that the closed meeting is designed to protect. • No "straw vote" or any other attempt to count votes in executive session . • Many agendas routinely include a statement that the governmental body may convene into executive session on any listed agenda item for purposes of consulting with the City's attorneys. 24 Penalty Provisions • The TOMA prescribes several misdemeanor offenses for violations of the Act which are enforced by local, district, and county attorneys. • A member or group of members who knowingly conspire(s) to circumvent TOMA by meeting in numbers less than a quorum for secret deliberations is guilty of a misdemeanor. Tex. Gov't Code §551 . 143 (a ) • This offense is punishable by: • A fine of $ 100-$500; • Confinement in the county jail for one to six months; or • Both . Tex. Gov't Code §551. 143( b) 25 Penalty Provisions • An official who knowingly calls, aids in calling, closes, aids in closing, or participates in a closed meeting where a closed meeting is not permitted, is deemed guilty of a misdemeanor. Tex. Gov't Code §551.144(a). • This includes when a meeting is: • Not properly noticed; • Not properly convened; or • There is no applicable exception. • This offense is punishable by: • A fine of $100-$500; • Confinement in the county jail for one to six months; or • Both. Tex. Gov't Code §551. 144(b) 26 Penalty Provisions • A member who participates in a closed meeting knowing that a certified agenda or a recording of the closed meeting is not being kept is guilty o�C` C misdemeanor. Tex. Gov't Code §551. 145 • An individual who knowingly discloses the certified agenda or tape recording of a closed meeting to a member of the public is deemed guilty of a Class B misdemeanor. Tex. Gov't Code §551. 146(a). • Class B Misdemeanor Penalty • a fine not to exceed $2000; • confinement in jail not to exceed 180 days; • or both. Tex. Gov't Code §551. 146(b) . 27 Penalty Provisions Civil Actions • Any interested person may bring a civil lawsuit to force officials to comply with the TOMA, to enjoin officials from acting, or to void actions taken in an illegal meeting. • Any action taken found in violation of TOMA is voidable. • A person injured by the unlawful disclosure of a certified agenda or tape recording of a lawfully closed meeting may sue for damages, attorney fees, and exemplary damages. 28 TRAFFIC SAFETY COMMISSION AGENDA ITEM#3 Agenda Information Sheet DEPARTMENT: Transportation CM/ACM: Bryan Langley, Deputy City Manager Date: May 1, 2017 SUBJECT Receive a report, hold a discussion and provide a recommendation on a proposed revision to Ordinance 2006-358 relating to an interlocal agreement between the University of North Texas and City of Denton for the enforcement of parking regulations by the University of North Texas on City of Denton streets. BACKGROUND As part of the discussion at the September 2016 joint Traffic Safety Commission(TSC) and Mobility Committee meeting, staff reported that discussions were in process with University of North Texas (UNT)representatives to implement strategies to address on-street parking constraints on campus and on streets adjacent to the UNT campus. One of the items discussed was the pending roll out of smart parking meters by UNT. At the November 2016 TSC meeting, staff advised that UNT has contracted with T2 Digital to serve as their service vendor for smart kiosk technology. UNT recently installed a T2 Digital kiosk at Lot 55 located at the southeast corner of Welch and Mulberry that employs smart meter technology. Previously this lot was restricted to UNT parking permit holders. With the new technology, non-permit holders may utilize the lot thereby increasing public parking capacity within walking distance to the Hickory/Fry Street commercial/retail area. In November, staff indicated that UNT's next phase of the "smart"parking technology will be the removal of existing coin operated parking meters and replace those with pay by cell technology on streets that are currently included in the UNT—City of Denton Interlocal Agreement, Ordinance 2006-358, attached to this report as Exhibit 1. Installation of new meters was completed in December 2016. On the identified sections of Hickory, Fry and Avenue A, coins are still accepted by the parking meters with the current rate of$0.10 per 12 minutes or $0.50 per hour. UNT has contracted with Parkmobile as their pay by cell provider. Parkmobile is a pay app that gives customers the ability to pay for parking via cell phone. Customers are instructed to download the Parkmobile app, create a profile where they will enter a license plate number and store their credit card. Once the profile is created customers will be able to park in any Parkmobile managed parking meter, space or zone. Customers will park in a space, enter the space number, zone number or meter number and select the amount of time they plan to park. Customers will receive an alert when their time is expiring with the option to extend their time through the app. If a customer does not have a smart phone to download the app, they may call the Parkmobile phone number to pay for their parking. UNT has established a$2.25 per hour rate for all proposed Parkmobile managed parking spaces which includes sections of Hickory Street, Fry Street and Avenue A all off campus. This is an increase in the current rate of$0.50 per hour or a dime for every 12 minutes. UNT Parking and 29 Transportation staff representatives advise that a rate of$0.45 per each 12 minute period will maintain consistency with other smart meter locations on-campus. It was also suggested that the total time limit on the referenced streets be set for a maximum of one-hour and allow 12 minute increments up to the one-hour limit. This time limit will encourage parking stall turnover in the commercial/retail area along Fry and Hickory Streets. The proposed rate includes a first"time period"transaction fee in the amount of$0.35 that will be required and paid to Parkmobile for administrative costs. Should a customer choose to extend their time, the $0.35 administration fee would not be applied. To establish the recommended$2.25 per hour rate, Ordinance 2006-358 will need to be revised to allow the rate change for parking spaces affected on Hickory, Fry and Ave A. As part of the November 2016 meeting, the Commission endorsed a recommendation to allow UNT to establish a rate of$2.25 per hour, $0.45 per twelve minutes, on identified sections of Hickory Street, Fry Street and Ave A and maintain a one-hour time limit for metered on-street parking stalls. The Commission requested that prior to submitting this recommendation to Council, that UNT conduct public outreach efforts with the merchants and stakeholders in the affected area. UNT hosted a meeting with the area business owners on the afternoon of April 27, 2017. Preliminary comments from this meeting indicated that merchants questioned the need for metered parking and requested that free two-hour parking, similar to on-street parking restrictions on and near the Square, be implemented in the Hickory/Fry Street area. Due to the deadline to meet the publication of the Traffic Safety Commission backup, additional information addressing the merchant request was not available at the time this report was submitted. Staff is hopeful additional information can be made available as part of the Commission's consideration of this agenda item on May 1. In addition to the proposed rate change, UNT Parking and Transportation is requesting authorization to enforce on-street parking on Central Avenue from Mulberry Street to Eagle. This street segment serves as a primary access route for students, staff, faculty and visitors to access UNT's parking garage located at the northwest corner of Central Avenue and Mulberry. This street segment is not currently within UNT's jurisdiction to regulate and/or enforce. Because private property, multi-housing developments, are present on the east side of this street segment, City of Denton staff is recommending that UNT be provided the authority to enforce City of Denton parking regulations rather than allow on-street parking to potentially be converted to university permit parking. City Staff is monitoring the on-street parking constraints in the area and may consider a future restriction of on-street parking on one side of this street segment should more consistent enforcement of current parking regulations not be successful in providing intended traffic safety improvements (line of sight, blocked driveways and constrained roadway). OPTIONS I. Recommend to City Council to allow UNT to establish a rate of$2.25 per hour, $0.45 per twelve minutes, on identified sections of Hickory Street, Fry Street and Ave A and maintain a one-hour time limit. Provide UNT on-street parking enforcement authority for Central Avenue from Mulberry to Eagle. 2. Recommend to City Council to allow UNT to establish a rate of$0.20 per 12 minutes or $1.00 per hour Hickory Street, Fry Street and Ave A, maintain a one-hour time limit and authorize UNT to enforce on-street parking on Central Avenue from Mulberry to Eagle. 3. Recommend to City Council to allow UNT to enforce on-street parking on Central Avenue from Mulberry to Eagle and maintain the current rate of$0.10 per 12 minutes or$0.50 per hour for parking meters on Hickory Street, Fry Street and Ave A. 30 4. Provide staff with additional direction to address proposed roll out of technology based parking meters, associated parking rates and on-street parking enforcement. RECOMMENDATION Staff recommends revising the current ordinance to authorize UNT to enforce on-street parking on Central Avenue. Staff recommends that a rate increase to the $0.10 per 12 minutes be considered to embrace the pay cell technology. ESTIMATED SCHEDULE OF PROJECT If a recommendation is advanced by the Traffic Safety Commission, this item can be placed on the May 23, 2017 Council agenda for consideration. PRIOR ACTION/REVIEW: At the November 2016 meeting, the Commission endorsed Option 1, but requested that UNT provide evidence of public outreach with retail establishments adjacent to the affected corridors. FISCAL INFORMATION The City receives one-third of the parking meter receipts from the meters on Hickory, Fry and Avenue A. $26,017 was received by the City of Denton in Fiscal Year 2015 for approximately 101 meters located on the identified street segments. Mark Nelson talked about this item stating that UNT approached staff looking at different parking strategies. One component that UNT is looking at is a smart meter. They have installed smart meters at Mulberry and Welch. They have reduced the number of permits sold and have created an on- demand location. These meters are paid by smart phone or credit card for time segments. With a rate study completed they are at$2.25 per hour. The next phase is to replace all of the coin parking meters with a smart meter. There are a number of meters on West Hickory, Fry Street and Avenue A that require a written approval through the City. There is an ordinance that relates to the streets within campus and adjacent to campus where UNT has enforcement authority. The agreement was entered with UNT because of their ability to enforce parking restrictions by holding transcripts or graduation pending payment of citations. UNT suggests $2.25 per hour to maintain consistency with other lots. The meters that the City maintains are ten cents for twelve minutes. The new smart meters have a one-time fee of $.35 then $.45 for the first twelve minutes, then $.45 for each additional twelve minutes. This is a substantial increase for parking. This would help to keep the vehicles moving (turnover) instead of sitting all day. UNT is moving forward to change the meter heads in the December timeframe. In order to make that deadline staff would have to take the recommendation to Council in early December. Nelson listed the options which are: 1. Recommend to City Council to allow UNT to install smart parking meter technology and establish a rate of$2.25 per hour, $0.45 per twelve minutes, on identified sections of Hickory Street, Fry Street and Ave A and maintain a one hour time limit. 2. Recommend to City Council to allow UNT to install smart meter technology on Hickory Street, Fry Street and Ave A and establish a rate of$0.20 per 12 minutes or$1.00 per hour. 39 3. Recommend to City Council to allow UNT to install smart meter technology on Hickory Street, Fry Street and Ave A but maintain the current rate of$0.10 per 12 minutes or $0.50 per hour. 4. Provide staff with additional direction to address proposed roll out of technology based parking meters and/or associated rates. Commissioner Owens stated the City's share is one third. Nelson agreed. Owens then asked if that third would be after the$.35. Nelson agreed. The initial amount goes to the vendor of the meters. Commissioner Hennen asked if information from businesses has been received regarding how this might impact their businesses. Chair Campbell answered that part of the reasoning for this is to keep vehicles moving and not park all day. Nelson added that UNT has done outreach with businesses particularly from Welch and Hickory toward the campus but does not have the documentation on hand. Hennen then asked if the businesses have to be notified,Nelson answered no. Commissioner Lyke asked if the meters are enforced 24 hours a day. Nelson answered during business hours. Lyke answered that could keep turnover going during the day at the higher rate and in the evening the meters wouldn't be enforced. Commissioner Krutka stated that he is in favor of the higher price so people can make choices to stay at the higher price or move on for other customers. Nelson added that the one hour would be a limit. You couldn't just add money to stay longer. Nelson added that a recommendation does not have to be made tonight,the final information can be brought back as long as there is a general consensus regarding the direction. Hennen would be interested in the additional information especially from the businesses and the times that it would affect their business. Owen asked if the City is comfortable with the entire overlay of the parking enforcement. Nelson answered it is a City ordinance he would like changes to the cost share. Nelson referred to a map that shows what UNT has authority over and the areas they have requested authority over. A first step would be to advance some level of a partnership on the meter component. Lyke asked about the price from the other commissioners, she is in favor of the increase to $2.25 per hour. After discussion the commissioners agreed with the increase. Owen asked if the City receives one third of a parking citation as well,Nelson agreed. Lyke stated that in other areas a portion of the fees received would go toward street trees and sidewalk improvements. Unsure if Denton could accomplish something comparable. Nelson answered that he has spoken with the finance staff and there is some willingness. Revenue is being looked at for stripping and other bike/ped enhancements. There is funding available but the budget has not been increased for replacement stripping. The Commission directed toward option#4. Adjournment: 7:26pm 40 TRAFFIC SAFETY COMMISSION AGENDA ITEM#4 AGENDA INFORMATION SHEET DEPARTMENT: Engineering Services CM/ACM: Jon Fortune Date: May 1, 2017 SUBJECT Receive a report, hold a discussion and provide direction relating to a no parking any time restriction on the south side of Hickory Street from Avenue B to Avenue A. BACKGROUND The update to the Pedestrian and Bicycle Linkage Component of the Denton Mobility Plan(the Bike Plan)was adopted by City Council in February 2012 which designates Hickory Street as a bike route. Since the adoption of this plan, sections of Hickory Street have been completed with either bike lanes or sharrows. The section from Avenue C to Welch Street is the last remaining piece to make a complete and connected bike corridor on Hickory Street from Bonnie Brae Street to DCTA Downtown Denton Transit Center. Hickory Street between Avenue C and Welch Street comprises of three segments; 1. The first segment between Avenue C and Avenue B, parking is currently restricted on the south side of Hickory Street and bike lanes can be accommodated within the existing roadway width. At this time City staff is not requesting any changes to on-street parking along this portion of Hickory Street. 2. The second segment between Avenue B and Avenue A, metered on-street parking exist on both sides of Hickory Street. This is the subject segment where a no parking any time restriction on the south side of Hickory Street is being considered for accommodating bicycle facility. 3. The third segment between Avenue A and Welch Street, parking is currently restricted on the south side of Hickory Street on majority of this segment. At this time the City staff is not requesting any changes to on-street parking along this portion of Hickory Street. University of North Texas (UNT) the adjacent property owner and the City staff have been working together since 2009 for restricting on-street parking on the south side of Hickory Street from Avenue B to Avenue A. To that end, on March 6, 2009, then-President of UNT, Gretchen M. Bataille, provided a letter of support (attached) to the City for restricting on-street parking along this segment of Hickory Street. Additionally, in 2016 the Director of Transportation for UNT Geary Robinson, reiterated UNT's support and desire for restricting on-street parking on the south side of Hickory Street between Avenue A and Avenue B. Based on review of existing conditions, City's mobility plan and UNT's Transportation Master Plan, staff recommends restricting parking on south side of Hickory Street between Avenue A and Avenue B. This will allow installation of Bike lanes along this segment of Hickory Street. The Hickory Street reconstruction project is currently underway and implementation of bike lanes along Hickory Street between Avenue C and Avenue A is part of this project. As such, the restriction of on-street parking is being considered at this time. 41 Staff has notified the property owners and businesses on Hickory Street and Avenue A about the proposed discussion item regarding parking on Hickory Street to ensure businesses and property owners have an opportunity to voice any concerns they may have. Letters were mailed on April 24th and door hangers were placed on April 27th on addresses on both sides of Hickory Street. OPTIONS 1. BACKGROUND The primary criterion used in establishing a speed limit is called the 85th percentile speed which is determined by performing a speed study for calculating the speed at which 85 percent of the vehicles are traveling long a given stretch of roadway. The 85th percentile speed has been determined as being the speed at which a prudent driver, given the type of street, will drive that roadway under normal driving conditions. Texas Department of Transportation (TxDOT)recently conducted a speed study(attached)to determine the 85th percentile speed along the segment of Country Club Drive/FM 1830 from Sanders Road to southerly City Limits. Based on the results of the study, TxDOT recommends reducing the speed limit along Country Club Drive/FM 1830 from Sanders Road to southerly City limits to 50 miles per hour(mph) from the existing speed limit of 55 mph. City staff has reviewed the TxDOT speed study and finds the overall results and recommendations acceptable and consistent with state and federal guidelines. As such, the City staff requests the Traffic Safety Commission to recommend the updated speed limits on Country Club Drive/FM 1830 from Sanders Road to southerly City limits to City Council for review and approval. Please note that staff will prepare a new ordinance to revise the current speed limits included in the City's municipal code (see attached sections), along Country Club Drive/FM 1830. This revised ordinance will be submitted to the City Council for review and approval. ESTIMATED SCHEDULE OF PROJECT It is anticipated the work could be scheduled for completion within a month of Council approval. OPTIONS: Recommend to the Council, approval of updates to the speed limits on Country Club Drive/FM 1830 from Sanders Road to southerly City limits. The speed study was done after the request from TXDOT, Denton County Area Office to re-evaluate the speed for the section of FM 1830 in Denton County. The printout shows that the recommended speeds correspond to the speeds at which the normal and prudent driver is driving under the existing conditions. To proceed with the changing of the speed limits, TxDOT requires a signed city ordinance matching the zones on the speed study. BACKGROUND The primary criterion used in establishing a speed limit is called the 85th percentile speed which is determined by performing a speed study for calculating the speed at which 85 percent of the vehicles are traveling long a given stretch of roadway. The 85th percentile speed has been determined as being the speed at which a prudent driver, given the type of street, will drive that roadway under normal driving conditions. Texas Department of Transportation(TxDOT)recently conducted a speed study(attached)to determine the 85th percentile speed along the segment of Fort Worth Drive (US 377) from Lindsey Street to South/Westerly City limits. Based on the results of the study, TxDOT recommends the following speed limits along various segments of Fort Worth Drive (US 377) between Lindsey Street and South/Westerly City limits. From Lindsey Street to IH 35 E Southbound Frontage Road 35 mph From IH 35 E Southbound Frontage Road to 550 feet north of Massey Road 40 mph From 550 feet north of Massey Road to 250 feet south of Country Club Drive/FM 1830 50 mph From 250 feet south of Country Club Drive/FM 1830 to South/Westerly City limits 55 mph City staff has reviewed the TxDOT speed study and finds the overall results and recommendations acceptable and consistent with state and federal guidelines. As such, the City staff requests the Traffic Safety Commission to recommend the updated speed limits on Fort Worth Drive (US 377) from Lindsey Street to South/Westerly City limits to City Council for review and approval. Please note that staff will prepare a new ordinance to revise the current speed limits included in the City's municipal code (see attached sections), along Fort Worth Drive (US 377). This revised ordinance will be submitted to the City Council for review and approval. ESTIMATED SCHEDULE OF PROJECT It is anticipated the work could be scheduled for completion within a month of Council approval. OPTIONS: Recommend to the Council, approval of updates to the speed limits on Fort Worth Drive (US 377) from Lindsey Street to South/Westerly City limits. BACKGROUND The primary criterion used in establishing a speed limit is called the 85th percentile speed which is determined by performing a speed study for calculating the speed at which 85 percent of the vehicles are traveling long a given stretch of roadway. The 85th percentile speed has been determined as being the speed at which a prudent driver, given the type of street, will drive that roadway under normal driving conditions. Texas Department of Transportation (TxDOT)recently conducted a speed study(attached)to determine the 85th percentile speed along the segment of Teasley Lane (FM 2181)between IH 35 E Southbound Frontage Road and the South/Easterly City limits. Based on the results of the study, TxDOT recommends the following speed limits along various segments of Teasley Lane (FM 2181)between IH 35 E Southbound Frontage Road and the South/Easterly City limits. From IH 35 E Southbound Frontage Road to Savannah Trail 35 mph From Savannah Trail to 500 feet West of Pennsylvania Drive 45 mph From 500 feet West of Pennsylvania Drive to Lillian Miller Parkway 40 mph From Wind River Lane to South/Easterly City limits 45 mph There are two schools; Sam Houston Elementary School and Guyer High School along Teasley Lane/FM 2181 that currently have school zones where the speed limit is lowered for specific time periods during the day. TxDOT allows lower school zone speed limits to be set at 15 mph below the regular speed limit of the roadway segment. As such, a speed limit of 25 mph is recommended along the school zone in front of Sam Houston Elementary since the regular proposed speed limit along this segment of Teasley Lane/FM 2181 is 40 mph. Similarly, a speed limit of 30 mph is recommended along the school zone in from of Guyer High School since the regular proposed speed limit along this segment of Teasley Lane/FM 2181 is 45 mph. City staff has reviewed the TxDOT speed study and finds the overall results and recommendations acceptable and consistent with state and federal guidelines. As such, the City staff requests the Traffic Safety Commission to recommend the updated speed limits on Teasley Lane/FM 2181 from IH 35 E Southbound Frontage Road to the South/Easterly City limits to City Council for review and approval. Please note that staff will prepare a new ordinance to revise the current speed limits included in the City's municipal code (see attached sections), along Teasley Lane/FM 2181 and the school zones. This revised ordinance will be submitted to the City Council for review and approval. ESTIMATED SCHEDULE OF PROJECT It is anticipated the work could be scheduled foi�Eompletion within a month of Council approval.
