One thing that UNT approached the City of Denton with was an update to 35 their existing interlocal agreement and the City of Denton regarding streets they have 36 enforcement over. The primary issues UNT would like to have addressed include metered 37 parking in the Fry Street area and Central Avenue which is a connector street from Eagle. 38 39 The park mobile meters would take the existing coin operated meters and put in a smart meter 40 device. The rate would also change from .10 for 12 minutes or .50 an hour to $2.45 per hour. 41 Also cover the capital cost associated with the parking meters and convenience of the mobile 42 meter. Commissioner Hennen asked for stakeholder information including a public meeting with 43 opinions from the businesses in the area. 44 45 Geary Robinson with UNT spoke about a meeting that was put together with the businesses. He 46 has been charged with the task of getting the meters replaced with smart meters. There is a 47 hardship of getting the coins counted from the meters. He reiterated the concern of the business 48 owners regarding only having meters in this part of Denton, no other place has parking meters. Page 2 of 6 1 The businesses would like to have two hours of free parking. Robinson stated that his concern 2 with that is the parking would be tied up with students and the businesses felt like they could 3 manage that. The other option would be to implement the park mobile system. There are a 4 couple of parking lots in UNT that already utilize the mobile app. 5 6 Nelson added that some of the options could change. The option of the park mobile could be one 7 of the options,with a two hour limit. There could be two hours of free parking. One of the 8 reasons that there is an interlocal agreement is to facilitate enforcement of the parking in the 9 retail area. If a City of Denton police officer gives a parking ticket, it doesn't seem to get paid, if 10 those citations come from a UNT police officer there is more leverage in that transcripts can be 11 held up as well as registration. 12 13 Commissioner Hennen stated he is interested in the businesses and what they have to say about 14 this item. 15 16 There were some citizens here to speak regarding this item. 17 18 1) Lou Delaney-Lucky Lou's—Unfair that they are the only area in town that has to pay to park for 19 businesses. The increase is a major increase. Should have free two hour parking like the other 20 businesses in town. 21 2) Kim McKibben— 1306 W. Hickory- Owns two businesses—meter increase is detrimental. Unfair to 22 pay for parking for business. Some of her customers do not have smart phones. 23 3) Brent Erskin— 1314 W. Hickory—opposed—meter too high 24 4) Paul Meltzer— 1914 W. Oak—running for City Council for this area. What is the goal for the Fry 25 Street area. Want Fry Street to be supported much like the downtown area. 26 5) Matt Quenette—321 W. Hickory—too high meter—could cause people to drive when they may not 27 normally drive because they do not want to get a parking ticket 28 29 Nelson then stated that staff would like to move forward with having UNT to enforce the Central 30 Avenue street segment. 31 32 The commissioners then discussed having two hour free parking or another option, Monday- 33 Friday 8:OOam—S:OOpm no charge after S:OOPM. No charge on the weekends. 34 Nelson added he would look at these options. 35 36 Commissioner Hennen asked about the small area plan and parking area that may be impacted. 37 Nelson will check with the planners on this. 38 39 Deshmukh answered that the small area plan and planning is looking for a consultant to develop 40 the plan. This will look at parking and traffic around UNT. A long term plan will be looked at 41 but no decisions have been made. 42 43 Commissioner Robinson stated that meters could be reinstated later if need be. Deshmukh 44 agreed. 45 46 Commissioner Owen stated he doesn't believe there is enough information to make a 47 recommendation. 48 49 This item was tabled and will talk about this item at the next meeting which is June 5. This will 50 also give time for outreach to the community. Page 3 of 6 1 2 4) Receive a report, hold a discussion and provide direction relating to a no parking any 3 time restriction on the south side of Hickory Street from Avenue B to Avenue A. 4 5 Pritam Deshmukh talked about this item regarding the removal of parking to install bike lane 6 along this area to complete the Bike Plan that was adopted in 2012. There are bike lanes all 7 along Hickory Street, this would complete the segment. 8 9 There are three different utility projects along Hickory Street to Carroll Blvd. As part of that 10 project the street department will come in and take out the meter parking and re-stripe bike lanes. 11 12 Since 2009 was a long time ago, this would be beneficial to talk to the businesses and have a 13 public meeting regarding this plan. 14 15 There are two options and staff would like to move forward with implementing bike lanes on this 16 segment of Hickory. 17 18 There are citizens that are here to talk about this item. 19 20 1) Kim McKibbin- 1306 W.Hickory—owns two businesses—if you remove parking that his her only business 21 parking. Not in favor of removing parking for bike lane.Need to compromise. 22 2) Brent Erskin— 1314 W.Hickory—not in favor of removing parking. Taking away parking when businesses are 23 being denied because of lack of parking seems like an attack. 24 3) Paul Meltzer—1914 W. Oak-possible compromise—not against bike lanes if you don't remove parking for 25 places that is a destination 26 27 Chair Campbell asked if a bike lane can be added without taking away parking. Deshmukh 28 stated only with sharrows, which is an option. The amount of vehicles that park and travel may 29 be a safety concern. 30 31 Commissioner Robinson asked if there is any count data for the shared bike lanes that are on east 32 Hickory and Oak. Julie Anderson answered there have been no bike counts in this area. Bike 33 lanes and sharrows are used on different facilities and staff would like a bike lane in this area. 34 35 4) Matt Quenette—321 W.Hickory-feels like Fry Street is being penalized-sharrow should work. Not in favor 36 of removing parking. 37 Commissioner Hennen asked if the bike lane could move over to UNT property, has that been 38 explored at all. Deshmukh answered that has not been talked about, not sure how open they 39 would be to that. That can be asked. 40 41 Commissioner Hennen believes that the bike lane should be added for connectivity and the 42 parking should be removed for safety reasons. 43 44 Commissioner Robinson is in favor of leaving the parking in place. 45 46 The citizens asked about using Ave B to Mulberry that is within UNT. Anderson answered she 47 and Noreen Housewright will take a look at that suggestion. 48 49 This item will be brought back in June to explore more options. 50 Page 4 of 6 1 5) Receive a report, hold a discussion, and make a recommendation to City Council to 2 update speed limits on FM1830 from Sanders Road to the Southern City Limits. 3 4 Pritam Deshmukh introduced this item and stated that traffic has increased south of Sanders 5 Road. A speed survey was conducted and the 85th percentile of the traffic is what determines the 6 rate of speed. Based on the survey the speed has decreased. It is currently posted at 55 MPH, 7 but TxDOT wants to lower to 50 MPH. 8 9 Commissioner Hennen motioned to approve with a second by Commissioner Owen, vote 4-0. 10 11 6) Receive a report, hold a discussion, and make a recommendation to City Council to 12 update speed limits on US377 from Acme Road to the Southern City Limits. 13 14 Pritam Deshmukh stated that the Texas Department of Transportation (TxDOT) recently 15 conducted a speed study(attached)to determine the 85th percentile speed along the segment of 16 Fort Worth Drive (US 377) from Lindsey Street to South/Westerly City limits. Deshmukh answered the problem 2 would be the curve to the west. There was discussion regarding this item. 3 4 Commissioner Hennen motioned to approve with a second by Commissioner Campbell, vote 4-0. 5 6 2) Receive training from Legal regarding meeting rules that impact to the Traffic Safety 7 Commission. 8 9 Trey Lansford stated that is a rule to have an attorney liaison at all commission meetings. Staff 10 asked Lansford to give a short training on the open meetings act. 11 Lansford talked about the Texas Open Meetings Act("TOMA"). The definition is "[E]very 12 regular, special, or called meeting or session of every governmental body shall be open to the 13 public...." Tex.Gov'tCode§551.002 14 The requirements under the TOMA are mandatory for every governmental body. 15 The public has a statutory right to observe its government in action. 16 17 Governmental body includes: 18 The City Council; 19 A deliberative body with rule making or quasi-judicial power that is classified as a department, 20 agency or political subdivision of a municipality(e.g., housing authority); and 21 The governing board of a special district created by law. 22 The TOMA does not apply to a purely advisory body. BACKGROUND As part of the discussion at the September 2016 joint Traffic Safety Commission (TSC) and Mobility Committee meeting, staff reported that discussions were in process with University of North Texas (UNT)representatives to implement strategies to address on-street parking constraints on campus and on streets adjacent to the UNT campus. One of the items discussed was the pending roll out of smart parking meters by UNT. At the November 2016 TSC meeting, staff advised that UNT has contracted with T2 Digital to serve as their service vendor for smart kiosk technology. UNT recently installed a T2 Digital kiosk at Lot 55 located at the southeast corner of Welch and Mulberry that employs smart meter technology. Previously this lot was restricted to UNT parking permit holders. With the new technology, non-permit holders may utilize the lot thereby increasing public parking capacity within walking distance to the Hickory/Fry Street commercial/retail area. In November, staff indicated that UNT's next phase of the "smart"parking technology will be the removal of existing coin operated parking meters and replace those with pay by cell technology on streets that are currently included in the UNT—City of Denton Interlocal Agreement, Ordinance 2006-358, attached to this report as Exhibit 1. On the identified sections of Hickory, Fry and Avenue A, coins are still accepted by the parking meters with the current rate of$0.10 per 12 minutes or$0.50 per hour. UNT has contracted with Parkmobile as their pay by cell provider. Parkmobile is a pay app that gives customers the ability to pay for parking via cell phone. Customers are instructed to download the Parkmobile app, create a profile where they will enter a license plate number and store their credit card. Once the profile is created customers will be able to park in any Parkmobile managed parking meter, space or zone. Customers will park in a space, enter the space number, zone number or meter number and select the amount of time they plan to park. Customers will receive an alert when their time is expiring with the option to extend their time through the app. If a customer does not have a smart phone to download the app, they may call the Parkmobile phone number to pay for their parking. UNT has established a $2.25 per hour rate for all proposed Parkmobile managed parking spaces which includes sections of Hickory Street, Fry Street and Avenue A all off campus. This is an increase in the current rate of$0.50 per hour or one dime for every 12 minutes. UNT Parking and Transportation staff representatives advise that a rate of$0.45 per each 12 minute period will maintain consistency with other smart meter locations on-campus. It was also suggested that the total time limit on the referenced streets be set for a maximum of one-hour and allow 12 minute increments up to the one-hour limit. It is anticipated this time limit will encourage parking stall turnover in the commercial/retail area along Fry and Hickory Streets. The proposed rate includes a first"time period"transaction fee in the amount of$0.35 that will be required and paid to Parkmobile for administrative costs. Should a customer choose to extend their time, the $0.35 administration fee would not be applied. To establish the recommended $2.25 per hour rate, Ordinance 2006-358 will need to be revised to allow the rate change for parking spaces affected on Hickory, Fry and Ave A. As part of the November 2016 meeting, the Commission endorsed a recommendation to allow UNT to establish a rate of$2.25 per hour, $0.45 per twelve minutes, on identified sections of Hickory Street, Fry Street and Ave A and maintain a one-hour time limit for metered on-street parking stalls. The Commission requested that prior to submitting this recommendation to Council, that UNT conduct public outreach efforts with the merchants and stakeholders in the affected area. UNT hosted a meeting with the area business owners on the afternoon of April 27, 2017. Comments from this meeting indicated that merchants questioned the need for metered parking and requested that free two-hour parking, similar to on-street parking restrictions on and near the Square, be considered for the Hickory/Fry Street area. As part of the May 1, 2017, TSC meeting, several area merchants and stakeholders outlined concerns with the proposed increase from$0.50/hour to $2.25/hour indicating that it would negatively impact access to their business. Due to the limited opportunity to weigh in on the proposal, it was requested that a public meeting or open house be conducted by staff to outline the proposed pay for parking options as well as seek input on options such as free two hour on- street parking similar to the downtown/square area. UNT and City of Denton staff hosted an open house on May 17, 2017 at the UNT Greek Life Center. Area merchants and residents as well as stakeholders (students, patrons of area merchants and cyclist)provided input on the proposed on-street parking rate increase and two hour free on-street parking. Area merchants and stakeholders requested that two-hour on-street parking be established similar to parking restrictions in the downtown area; two-hour term limited free parking enforced 8 am to 5 pm, no restrictions between 5 pm and 8 am. UNT and City of Denton staff expressed concerns to merchants and stakeholders that regardless of level of enforcement, students will most likely not abide by the proposed parking restrictions,thus reducing parking stall turnover in the affected area and limiting parking options. It was agreed by staff to consider the proposed two-hour term parking and reevaluate the proposal after six to eight months. In addition to staff concerns regarding limited parking stall turnover, cost to enforce the two-hour parking will be evaluated as part of the reassessment. Additional revisions may be warranted at the time of the reassessment or other best management parking practices may be identified and considered as part of the proposed Small Area Plan expected to be completed in Calendar Year 2018. As part of this discussion, it is important to note that continued use of the existing coin operated meters is not feasible. Financial institutions are no longer accepting bulk coins. In fact, Wells Fargo,the UNT and City of Denton bank, has indicated they will no longer accept bulk coins after July 14, 2017. With this understanding, near-term removal of the existing meters will be necessary. In addition to the proposed rate change, UNT Parking and Transportation is requesting authorization to enforce on-street parking on Central Avenue from Mulberry Street to Eagle. This street segment serves as a primary access route for students, staff, faculty and visitors to access UNT's parking garage located at the northwest corner of Central Avenue and Mulberry. This street segment is not currently within UNT's jurisdiction to regulate and/or enforce. Because private property, multi-housing developments, are present on the east side of this street segment, City of Denton staff is recommending that UNT be provided the authority to enforce City of Denton parking regulations rather than allow on-street parking to potentially be converted to UNT permit parking. City Staff is monitoring the on-street parking constraints in the area and may consider a future restriction of on-street parking on one side of this street segment should more consistent enforcement of current parking regulations not be successful in providing intended traffic safety improvements (line of sight, blocked driveways and constrained roadway). UNT has also requested regulation and enforcement authority as part of the proposed amendment to Ordinance 2006-358 to address parking congestion on Wilshire, from North Texas Boulevard (NT Blvd) to Avenue C. UNT owns the adjacent property along this street segment except for an approximate 100 foot segment on the SE corner of Wilshire and NT Blvd. This tract is owned by the IHOP restaurant and currently has head in parking off of Wilshire as well as loading a zone (deliveries and solid waste service) that prevent on-street parking. City of Denton staff is amenable to this request as part of the overall parking plan for streets in and adjacent to the UNT campus. OPTIONS 1. Recommend to City Council to allow two hour term limited on-street parking on the identified sections of Hickory Street, Fry Street and Avenue A, Monday through Friday 8 am to 5 pm. Provide UNT on-street parking enforcement authority for Central Avenue, and provide UNT on-street parking regulation and enforcement on Wilshire from NT Blvd to Avenue C. 2. Recommend to City Council to allow UNT to establish a rate of$2.25 per hour, $0.45 per twelve minutes, on identified sections of Hickory Street, Fry Street and Ave A and maintain a one-hour time limit. Provide UNT on-street parking enforcement authority for Central Avenue, and provide UNT on-street parking regulation and enforcement on Wilshire from NT Blvd to Avenue C. 3. RECOMMENDATION Staff recommends Option 1 - Allow two hour term limited on-street parking on the identified sections of Hickory Street, Fry Street and Avenue A, Monday through Friday 8 am to 5 pm. Revising the current ordinance to provide UNT on-street parking enforcement authority for Central Avenue and provide UNT on-street parking regulation and enforcement on Wilshire from NT Blvd to Avenue C. ESTIMATED SCHEDULE OF PROJECT If a recommendation is advanced by the Traffic Safety Commission, this item can be placed on the June 20, 2017 Council agenda for consideration. PRIOR ACTION/REVIEW: TSC considered this item as part of the November 2016 TSC meeting. TSC considered this item as part of the May 2017 TSC meeting. On-street parking metered parking and two-hour parking was vetted as part of the May 17, 2017 Open House meeting at the UNT Greek Life Center. FISCAL INFORMATION The City receives one-third of the parking meter receipts from the meters on Hickory, Fry and Avenue A. $26,017 was received by the City of Denton in Fiscal Year 2015 for approximately 101 meters located on the identified street segments. $19,178 in revenue was received by the City of Denton for Fiscal year 2016. It is anticipated the enforcement of the free two-hour on-street parking as outlined in Option 1 could result in deficit of approximately $13,000 as no revenue will be generated from paid parking to cover overhead for enforcement. BACKGROUND The Update to the Pedestrian and Bicycle Linkage Component of the Denton Mobility Plan(the Bike Plan), adopted by City Council in February 2012, designates Hickory Street as a bike route with a bike lane as the on-street bike facility. Since adoption of the Plan, sections of Hickory Street have been completed with either bike lanes or sharrows. The section from Avenue C to Welch Street is the last remaining piece to make a complete and connected bike corridor on Hickory Street from Bonnie Brae Street to the Downtown Denton Transit Center(DDTC). In order to complete the gap on Hickory Street with a bike lane from Avenue C to Welch Street, twenty-two on-street parking stalls on the south side of Hickory Street need to be removed from Avenue B to Avenue A, and six on-street parking stalls from Avenue A to Welch Street need to be removed(see Exhibit 2). Prior to the May 1, 2017 Traffic safety Commission meeting, businesses and residents on Hickory St from Avenue B to Avenue A were notified with a mailed letter dated April 24 of the proposal to remove twenty-two on-street parking stalls on the south side of Hickory Street between Avenue B and Avenue A. At that meeting, the item was tabled and staff was asked to look into alternatives that did not include the removal of parking. Staff then held an Open House on Wednesday, May 17 to receive feedback from citizens. The feedback staff received was split between removal of on-street parking for facilitation of a bike lane, and suggestions to route the bike lane elsewhere to keep on-street parking. Several suggestions were made to reroute the bike lane beginning at Avenue B through the University of North Texas campus. This would output the people on bikes to Mulberry Street, and then route them to Hickory Street by way of Welch Street. Several suggestions were made to remove the on-street parking, including the six stalls east of Avenue A, to facilitate a complete and continuous bike lane with no reroutes from Bonnie Brae Street to Carroll Boulevard. Staff made the suggestion to reroute the people on bikes to an expanded sidewalk at Avenue B through Avenue A and then connect back to the bike lane on Hickory through Mulberry and Welch Streets. Subsequent to the May 17 Open House, several local bicycle advocates and Fry Street business owners met to discuss options that would be beneficial to both parties. The two groups have proposed a plan that removes on-street parking on the north side of Hickory Street, with the remaining on-street parking on the south side used as a buffer between the bike lane and travel lane. Due to the number of driveway entrances on the north side, this option removes 17 on- street parking stalls instead of 22, saving 5 on-street parking stalls. This option shifts the travel lanes by eight feet for one block. A transition taper, per state and federal standards, is needed to facilitate safe travel lane shifts. This taper would result in the loss of additional on-street parking. Staff discussed each option and weighed the pros and cons. Due to the conflicts and safety issues proposed for reroutes, staff is recommending removal of the remaining six on-street parking stalls east of Avenue A in addition to the twenty-two that were initially proposed on the south side of Hickory St. The rest of Hickory Street from Avenue A to Welch Street is already signed as No Parking.
