2017-028 Prominence Square Clearing Issue Date: April 28, 2017 Report No. 2017-028 INFORMAL STAFF REPORT TO THE CITY MANAGER and CITY COUNCIL SUBJECT: Removal of vegetation on an approximately 47-acre tract located on the southeast corner of Loop 288 and East University Drive. BACKGROUND: The property owner has initiated brush mowing of understory vegetation in anticipation of future development. At this time, the Planning Division has not received any applications for platting or Site Plan Permits; as such, no information as to the future development or proposed use is available. However, the current brush mowing on the site does not conflict with the tree preservation or landscape requirements in Subchapter 13 of the Denton Development Code. Previously approved projects/permits on the subject property are as follows: Conditional letter of map revision (CL09-0001) was approved on July 7, 2011. Construction plans (CP13-0005) were approved on May 19, 2015. In preparation for the future development, the property owner would also like to begin grading the site in order to reclaim the floodplain per the approved conditional letter of map revision (CLOMR) and construction plans. Clearing of the understory vegetation, according to the property owner, is needed to stakethe limits of the grading. Based upon information provided by the Engineering Department, grading activities may not begin until the required drainage easement documents are submitted, inspection fees have been paid, a pre-construction meeting is held, and compliance with a stormwater permit has been verified (NOI, SWPPP, site notice, online survey, and initial inspection). The property owner and project engineer have been notified of the deficiencies; however, the property owner was not aware of the additional requirements. Currently, no additional vegetation should be removed until: (1) All engineering and stormwater requirements are met to enable the CLOMR work (grading, filling, etc.) may begin, (2) Or a minor site plan is obtained to clear the vegetation only. The property owner has agreed to discontinue the removal of vegetation until the matter is resolved.
