2017-040 Tree Stand Issue Loop 288 and BrinkerDate: June 2, 2017 INFORMAL STAFF REPORT TO THE CITY MANAGER and CITY COUNCIL SUBJECT: Report No. 2017-040 Feasibility of development of tree stand property located at the southeast corner of Loop 288 and Brinker. BACKGROUND: The subject property is part of the Wal-Mart development and is being considered for development by Raising Cane's Restaurant. Community concern has been expressed, contending that the tree stand was to be preserved under an agreement with Wal-Mart. However, thorough research was conducted but there is no evidence of such an agreement and therefore, the lot can be developed per the requirements of the Denton Development Code (DDC). As a result, Raising Cane's is seeking approval of a site plan which was submitted on April 7, 2017. Currently the site plan has been through the first review and is due a second review. The applicant is required to resubmit for second review with first review comments addressed by July l, 2017. The site plan elements comprise a site layout, screening and landscaping plan and tree mitigation/preservation plans. The DDC tree code requires either 25 percent preservation of the canopy or 25 percent of the total diameter inches of a quality tree stand. The developer chose the diameter inch option for preservation and mitigation purposes. The developer's minimum requirement is to preserve 12.5 percent of the diameter inches on site and mitigate the other 12.5 percent. There are currently 36 Post Oak and 1 Cedar Elm totaling 673.2 inches of diameter. The proposed landscape plan reflects 6 trees totaling 112.7 diameter inches or 16.7 percent being preserved, 4 percent more than required by code. The remaining requirement can be mitigated by paying into the Tree Fund or by planting additional trees. Based on the information provided on the initial landscape plans submitted for the first review, the applicant exceeds the landscaping requirement of 15% (6,316 SF) and has provided 32.7% (15,038 SF) of landscaped area. The landscape plan has been attached for reference. CONCLUSION: The proposed development is not under any restrictions from past development agreements and exceeds existing tree and landscape code requirements.
