AN ORDINANCE ABANDONING AND VACATING A PORTION OF A DRAINAGE
EASEMENT {HEREIN SO CALLED) GRANTED TO THE CITY OF DENTON, TEX�S
PURSUANT TO THAT CERTAIN DRATNAGE EASEMENT, ACCEPTED BY THE CITY
OF DENTON, MARCH I5, 2007, FROM D.R, HORTON — TEXAS, LTD., AND RECORDED
AS INSTRUMENT NO, 2007-30855, REAL PROPERTY RECORDS, DENTON COUNTY,
TEXAS, SAID DRAINAGE EASEMENT LOCATED IN THE WILLIAM ROARK SURVEY,
ABSTRACT NO. I087, DENTON COUNTY, TEXAS; AND DECLARING AN EFFECTIVE
DATE.
WHEREAS, D.R. Horton — Texas, Ltd., a Texas li�nited pat�kne�•ship ("Owner") has
�•epresented to the City af De��toji that it is the underlying fee sin�ple ownez of lands encumbereci
by t�e Drainage Easement, 1NSOFAR AND ONLY INSOFAR as the D�•ainage Easement covers
and encumbers that certain. 0.8I1 ac�•e t�•act of land, being more particula�•ly described and
depicted on Exl�ibit "A", attached hereto and made a pa�-t he�•eof for alI purpases (the
"Abandanment A�•ea"}; and
WHEREAS, the Ownez� k�as rec�uested tl�e City of Dei�ton to abandon t��e Drai�lage
Easen�ent, INSOFAR AND ONLY INSOFAR as the Drainage Easement cove�•s and ex�cumbers
t��e Aba�donment Area; and
WHEREAS, staff has reviewed t�e requested abandonrr�ent af the Drainage Easemexit,
INSOFAR AND ONLY INSOFAR as it covers and ejicumbers tl�e Abandonment Area, and has
recommended app��aval of such abandonme��t; and
WHEREAS, the City Council of the City a� Denton, Texas has determin.ed that it is in the
public interest to abandon the Drainage Eas�ment, INSOFAR AND ONLY INSOFAR as the
Drainage Ease��ient covers and encumbe��s the Abat�da�unent A�'ea; NOW, THEREFORE,
THE COUNCIL OF THE CITY �F DENTON HEREBY ORDAINS:
SECTION 1. Tl�e recitations and findings contained in tliis o�•dinance are ii�coiporated
herei�� by z�eference the same as if fuily set �oz�th in this Seetion 1.
SECTION 2, T��� Drainage Easement, iNSOFAR AND ONLY INSOFAR as it covers
and encumbezs the Abai�donment Area, is l�ez'eby permanently abandoned and, s�bject to the
reservations set farth in this ordinance, all o� the City's right, titie ai�d inte�•est in the Drainage
Ease�nent, INSOFAR AND ONLY INS4FAR as same cavers and encumbe�•s the Abandon�i�ent
Area, is hereby released to tl�e Owner. A ce�•ti�'ied capy of this o�•dinance may be �•ecarded in tlle
Real P�•aperty Records af Denton Co�tnty, Texas to evidence this abandonment and �•elease.
SECTION 3. Notwithstanding anything to the cantt�ary contained in this o�•dinanee, the
City of Denton hereby retains anti reserves (i) any and ail easements, rigl�t� and interests granted,
ow��ed or ciain�ed by the City o£ De�itan, by, th�•ough or unde�• the Draixaage Ease�nent, insofai• as
said D�•ainage Easement covers and encumbers lands other than the Abandonment Area; and {ii)
any and ail easements, rights of way and any othe�• rights ar interests, otliex� than the Drainage
Easenient, wheti�er ac�uired, obtained, owned or clai�ned hy the City of Dentan ot• public, by,
