WHEREAS, Spring Brook Planning Group, has applied for an initial zoning district and use classification of Community Mixed Use General (CM-G) to approximately 4.3 acres of land and a Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district and use classification to approximately 28.8 acres; and a change in zoning to approximately 3.7 acres of land from a Neighborhood Residential6 (NR-6) zoning district classification and use designation to a NRMU-12 zoning district classification and use designation, with all three land areas subject to an overlay restriction prohibiting multi-family dwelling units; and WHEREAS, on February 8, 2012, the Planning and Zoning Commission recommended approval (5-1) of the initial zoning and the change in zoning; and WHEREAS, the City Council finds that the change is consistent with the Denton Plan and the Development Code; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference as true. SECTION 2. An initial zoning district classification and use designation of Community Mixed Use General (CM-G) is hereby applied to approximately 4.3 acres of land; an initial zoning district classification and use designation of Neighborhood Residential Mixed Use 12 (NRMU-12) is hereby applied to approximately 28.8 acres of land; and the zoning district classification and use designation for approximately 3.7 acres is hereby changed from a Neighborhood Residential 6(NR-6) zoning district classification and use designation to a NRMU-12 zoning district classification and use designation, and hereby approved for the Property, with all three land areas subject to the following overlay restriction: Multi-family dwelling units are prohibited. Notwithstanding the attached real property description, the property being rezoned includes all property to the centerline of a11 adjacent street rights-of-way. SECTION 3. The City's official land use map is amended to show the change in the land use designation. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 5. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 6.
