CERTAIN SPECIAL WARRANTY ASSUMPTION DEED, DATED ON OR ABOUT
DECEMBER 18, 2008 AND RECORDED AS COUNTY CLERK FILE NO. 2008-134210,
REAL PROPERTY RECORDS, DENTON COUNTY, TEXAS, LOCATED GENERALLY AT
THE NORTHWEST CORNER OF THE INTERSECTION OF BONNIE BREA STREET AND
U.S. HIGHWAY 380; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City of Denton, Texas (the "City") has received a request from the
underlying fee simple owner, RR Marketplace LP (the "Owner"), for the vacation and
abandonment of (i) that certain storm water drainage easement (herein called "Easement 1"), as
conveyed to the City by J. Newton Rayzor, by instrument dated February 19, 1970, recorded at
Volume 598, Page 560, Real Property Records, Denton County, Texas, said lands covered
thereby being also described on Exhibit "A", attached hereto and made a part hereof; (ii) that
certain storm water drainage easement (herein called "Easement 2"), as conveyed to the City by
Suderman and Young Towing Company, Inc., by instrument dated on or about February 19,
1970, recorded in Volume 598, Page 562, Real Property Records, Denton County, Texas, said
lands covered thereby being also described on Exhibit "B", attached hereto and made a part
hereof; (iii) that certain Flowage Easement (herein called "Easement 3"), as conveyed to the City
by Suderman and Young Towing Co., Inc., by instrument dated on or about January 31, 1974,
and recorded in Volume 697, Page 219, Real Property Records, Denton County, Texas, said
lands covered thereby being also described on Exhibit "C", attached hereto and made a part
hereof; (iv) that certain Dam Construction and Flowage Easement (herein called "Easement 4"),
conveyed to the City by Suderman and Young Towing Company, Inc., by that certain Dam
Construction and Flowage Easement, dated on or about January 31, 1974, and recorded in
Volume 697, Page 222, Real Property Records, Denton County, Texas, said lands covered
thereby being also described on Exhibit "D", attached hereto and made a part hereof; and (v) that
certain right of way for drainage ditch or channel (herein called "Easement 5"), being a portion
of the lands and interests awarded to Denton County in that certain condemnation action styled
Denton County vs. J. A. Gladish, et al., Cause No. 3664, County Court of Denton County, Texas,
said action being referenced in that certain Deed from Rayzor Investments, Ltd. to Rayzor
Hillview, L.P., recorded as County Clerk File No. 2005-127449, Real Property Records, Denton
County, Texas, said lands covered thereby being also described on Exhibit "E", attached hereto
and made a part hereof;
WHEREAS, Easement 1, Easement 2, Easement 3, Easement 4 and Easement 5 are
collectively referred to herein as the "Easements"; and
WHEREAS, the Owner has completed all activities and requirements of the City,
including without limitation, the dedication and/or granting of additional easements covering and
affecting lands of the Owner, as conditions to the vacation and abandonment of the Easements;
and
WHEREAS, staff has reviewed the requested vacation and abandonment of the
Easements and has recommended approval of same; and
WHEREAS, the Easements may cover and encumber lands in which the City or public
may own or claim interests in addition to those granted or awarded by the Easements; and
WHEREAS, it is the intent of the City to solely vacate and abandon the Easements, in
which the City hereby retains and reserves, and excepts from such vacation and abandonment,
any and all easements, rights of way, and any other rights or interests owned or claimed by the
City or public, whether acquired, or claimed to be acquired, by conveyance, dedication by plat,
implied dedication, acquired or claimed by prescription or owned or claimed by or pursuant to
any other manner or means; and
WHEREAS, the City Council of the City of Denton, Texas has determined that it is in the
public interest to vacate and abandon the Easements.
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The recitations and findings contained in the preamble of this ordinance are
incorporated herein by reference.
SECTION 2. Subject to the terms of Section 3, below, the Easements are hereby
permanently vacated and abandoned. A certified copy of this ordinance may be recorded in the
Real Property Records of Denton County, Texas to evidence this vacation and abandonment.
SECTION 3. The City of Denton expressly reserves and retains, and this ordinance
vacating and abandoning the Easements expressly excepts from the effect hereof, any and a11

easements, rights of way and any otber rights or interests owned or claimed by the City or public
in or to lands in which the Easements may cover, encumber, include, cross or overlap, whether
said easements, rights of way and/or other rights or interests were acquired, or claimed to be
acquired, by conveyance, dedication by plat, implied dedication, acquired or claimed by
prescription or owned or claimed by or pursuant to any other manner or means.
SECTION 4. This ordinance shall become effective immediately upon its passage and
approval.
