2012-154Z�\OrdinancesV2�Z11-0025 Ordinance.doc ORDINANCE NO. 2012-�.54 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR AN 1NITIAL ZONING DISTRICT AND USE CLASSIFICATION OF COMMUNITY MIXED USE GENERAL (CM-G) AND NEIGHBORHOOD RESIDENTIAL MIXED USE 12 (NRMU-12) TO APPROXIMATELY 33.1 ACRES OF LAND AND THE REZONING OF APPROXIMATELY 3.7 ACRES OF LAND FROM A NEIGHBORHOOD RESIDENTIAL 6 (NR-6) ZONING DISTRICT AND USE CLASSIFICATION TO A NRMU-12 ZONING DISTRICT AND USE CLASSIFICATION; LOCATED AT THE SOUTHEAST CORNER OF MCKINNEY STREET AND MAYHILL ROAD; AND PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF, SEVERABILITY; AND AN EFFECTIVE DATE (Z11-0025). WHEREAS, Spring Broolc Planning Group, has applied for an initial zoning district and use classification of Community Mixed Use General (CM-G) to approximately 4.3 acres of land and a Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district and use classification to approximately 28.8 acres; and a change in zoning to approximately 3.7 acres of land from a Neighborhood Residential6 (NR-6) zoning district classification and use designation to a NRMU-12 zoning district classification and use designation; and WHEREAS, on February 8, 2012, the Planning and Zoning Commission recommended approval (5-1) of the initial zoning and the change in zoning; and � WHEREAS, the City Council finds that the change, subject to an overlay condition, is consistent with the Denton Plan and the Development Code; NOW, THEREFOR, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1, The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference as true. SECTION 2. An initial zoning district classification and use designation of Community Mixed Use General (CM-G) is hereby applied to approximately 4.3 acres of land; an initial zoning district classification and use designation of Neighborhood Residential Mixed Use 12 (NRMU-12) is hereby applied to approximately 28.8 acres of land; and the zoning district classification and use designation for approximately 3.7 acres is hereby changed from a Neighborhood Residential 6(NR-6) zoning district classification and use designation to a NRMU-12 zoning district classification and use designation, and hereby approved for the property. Both changes in zoning are subject to the following overlay condition: A Specific Use Permit (SUP) is required for multi-family under all conditions listed within the limitation L(4) of Subchapter 5 of the Denton Development Code. Notwithstanding the attached real property description, the property being rezoned includes all property to the centerline of all adjacent street rights-of-way. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity sha11 not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 5. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 6. This ordinance shall become effective 14 days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton, Texas, within 10 days of the date of its passage.
