2012-219ORDINANCE NO. 2O 12-219 AN ORDINANCE OF THE CITY OF DENTON, TEXAS AUTHORIZING THE EXPENDITURE OF FUNDS FOR PAYMENTS BY THE CITY OF DENTON FOR ELECTRICAL ENERGY TR.ANSMISSION FEES TO THOSE CITIES AND UTILITIES PROVIDING ENERGY TRANSMISSION SERVICES TO THE CITY OF DENTON; AND PROVIDING AN EFFECTNE DATE (FILE 4847-ELECTRICAL ENERGY TRANSMISSION FEES FOR ELECTRIC TRANSMISSION TEXAS, LLC 1N THE ADDITIONAL AMOUNT OF $69,576.90 FOR A TOTAL AWARD OF $289,830.60 AND ELECTRICAL ENERGY TRANSMISSION FEES FOR LOWER COLORADO RIVERAUTHORITY IN THE ADDITIONAL AMOUNT OF $111,809.61 FOR A TOTAL AWARD OF $1,057,018.70; FOR A TOTAL EXPENDITURE OF $1,346,849.30). WHEREAS, in order to comply with the legislative requirements contained in the Utility Regulatory Act of 1995, for the payment for energy transmission services fees, the City of Denton is required to pay such fees imposed by the Public Utilities Commission of Texas to two listed utilities set forth in Exhibit "A"; and WHEREAS, the City Manager has reviewed and recommended that the City Council approve and authorize the payment of such fees; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The expenditure of funds in the total amount of $1,346,849.30 to be paid to the Listed Utilities in the specified amount shown on E�ibit "A", which is attached hereto and made a part of this ordinance for all purposes, is hereby autharized. SECTION 2. The City Council of the City of Denton, Texas hereby expressly delegates the authority to talce any actions that may be required or permitted to be performed by the City of Denton under File 4847 to the City Manager of the City of Denton, Texas, or his designee.
