AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR AN 1NITIAL
ZONING DISTRICT AND USE CLASSIFICATION OF REGIONAL CENTER
COMMERCIAL DOWNTOWN (RCC-D) ON APPROXIMATELY 9.5 ACRES AND THE
REZONING OF APPROXIMATELY 3.6 ACRES FROM REGIONAL CENTER
RESIDENTIAL 1(RCR-1) ZONING DISTRICT AND USE CLASSIFICATION TO A RCC-D
ZONING DISTRICT AND USE CLASSIFICATION; LOCATED ON THE WEST SIDE OF
NORTH I-35, SOUTH OF GANZER ROAD AND NORTH OF BARTHOLD ROAD; AND
PROVIDING FOR A PENALTY 1N THE MAXIMUM AMOUNT OF $2,000.00 FOR
VIOLATIONS THEREOF, SEVERABILITY AND AN EFFECTIVE DATE (Z12-0004).
WHEREAS, Rick Baria, has applied for an initial zoning district and use classification of
Regional Center Commercial Downtown (RCC-D) zoning district and use classification on
approximately 9.5 acres, as legally described in Exhibit "1" and as depicted as Area "A" in
Exhibit "3"; and a change in zoning on approximately 3.6 acres from a Regional Center
Residential 1(RCR-1) zoning district and use classification to a RCC-D zoning district and use
classification, as legally described in Exhibit "2" and as depicted as Area `B" in Exhibit "3"; and
WHEREAS, on July 25, 2012, the Planning and Zoning Commission recommended
approval (7-0) of the initial zoning and the change in zoning; and
WHEREAS, the City Council finds that the change is consistent with the Denton Plan
and the Development Code; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference as true.
SECTION 2. An initial zoning district classification and use designation of Regional
Center Commercial Downtown (RCC-D) is hereby applied to approximately 9.5 acres depicted
as Area "A" in Exhibit "3"; and the zoning district and use classification is hereby changed from
Regional Center Residential 1(RCR-1) to a RCC-D zoning district and use classification to
approximately 3.6 acres depicted as Area "B" in Exhibit "3". Notwithstanding the attached real
property descriptions legally described in Exhibits "1" and "2", the two land areas being initially
zoned and rezoned includes all property to the centerline of all adjacent street rights-of-way.
SECTION 3. The City's official land use map is amended to show the change in the land
use designation.
SECTION 4. If any provision of this ordinance or the application thereof to any person
or circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable.

SECTION 5. Any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense.
SECTION 6. This ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, a daily newspaper published in the City of
Denton, Texas, within ten (10) days of the date of its passage.
