ORDINANCE NO. 2013-046
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING AN
ALTERNATIVE ENVIRONMENTALLY SENSITIVE AREA (ESA) PLAN TO
DEVIATE FROM SUBCHAPTER 35.17.8 (RIPARIAN BUFFER AND WATER
RELATED HABITAT DEVELOPMENT STANDARDS) OF THE DENTON
DEVELOPMENT CODE, ON APPROXIMATELY 19.87 ACRES OF LAND WITHIN
A NEIGHBORHOOD RESIDENTIAL MIXED USE (NRMU) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION, LOCATED AT THE SOUTHWEST
CORNER OF MINGO ROAD AND NOTTINGHAM DRIVE 1N THE CITY OF
DENTON, DENTON COUNTY, TEXAS; PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF; PROVIDING A
SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. (ESA12-0009)
WHEREAS, Allison Engineering Group has applied for an Alternative
Environmentally Sensitive Area (ESA) Plan to deviate from Subchapter 35.17.8
(Riparian Buffer and Water Related Habitat Development Standards) of the Denton
Development Code, on approximately 19.87 acres of land within a Neighborhood
Residential Mixed Use (NRMU) zoning classification and use designation, to be
developed with a multi-family development, in two (2) phases legally described in
Exhibit "A," attached hereto and incorporated herein by reference (hereinafter, the
"Property"); and
WHEREAS, on January 9, 2013, the Planning and Zoning Commission concluded
a public hearing as required by law, and recommended approval of the requested
Alternative Environmentally Sensitive Area Plan, subject to conditions; and
WHEREAS, the City Council finds that the change, subject to conditions, is
consistent with the Denton Plan and the Development Code, specifically finding that the
requirements of Subchapter 17 are satisfied by the proposal when conditioned by the Site
Plan, attached as Exhibit "B"; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this
ordinance are incorporated herein by reference and found to be true.
SECTION 2. The Alternative Environmentally Sensitive Area Plan, attached as
Exhibit "B", to deviate from Subchapter 35.17.8 (Riparian Buffer and Water Related
Habitat Development Standards) of the Denton Development Code, on the Property is
hereby approved, subject to the following conditions:
1. The applicant shall preserve 1,535 tree inches along the western property boundary.
The aforementioned preservation includes mitigation for the 570 inches proposed to be
removed from the ESA riparian buffer and a ten (10)-foot Type B buffer; and
2. Preserved trees within the Alternative ESA Plan located on the western property line
shall not be used toward the tree mitigation requirement (222 inches) for the Alternative
Tree Plan (ATP12-0001).
SECTION 3. If any provision of this ordinance or the application thereof to any
person or circumstance is held invalid by any court, such invalidity shall affect the
validity of the provisions or applications, and to this end the provisions of this ordinance
are severable.
SECTION 4. Any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this
ordinance is violated sha11 constitute a separate and distinct offense.
SECTION 5. This ordinance shall become effective fourteen (14) days from the
date of its passage, and the City Secretary is hereby directed to cause the caption of this
ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper
published in the City of Denton, Texas, within ten (10) days of the date of its passage.
