ORDINANCE NO. 2013-075
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING
FOR A ZONING CHANGE FROM A COMMUNITY MIXED USE
GENERAL (CM-G) ZOlvING DISTRICT AND USE CLASSIFICATION
TO A NEIGHBORHOOD RESIDENTIAL 4(NR-4) ZONING DISTRICT
AND USE CLASSIFICATION ON APPROXIMATELY 34.04 ACRES OF
LAND LOCATED ON THE EAST SIDE OF COUNTRY CLUB ROAD (FM
1830), BETWEEN RYAN ROAD TO THE NORTH AND HICKORY
CREEK ROAD TO THE SOUTH, IN THE CITY OF DENTON, DENTON
COUNTY, TEXAS; AND PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF,
SEVERABILITY AND AN EFFECTIVE DATE (Z12-0010).
WHEREAS, Bob Shelton (Shelton Development) has applied for a change in zoning on
approximately 34.04 acres of land legally described in Exhibit A and depicted in Exhibit B,
attached hereto and incorporated herein by reference (hereinafter, the "Property"), from a
Community Mixed Use General (CM-G) zoning district and use classification to a Neighborhood
Residential4 (NR-4) zoning district and use classification; and
WHEREAS, on January 23, 2013, the Planning and Zoning Commission held a public
hearing and recommended approval (7-0) of the change in zoning; and
WHEREAS, on March 5, 2013 the City Council held a public hearing and fmds that the
change is consistent with the Denton Plan and the Development Code; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance
are incorporated herein by reference as true.
SECTION 2. The zoning district and use classification for the Property is hereby
changed from Community Mixed Use General (CM-G) to Neighborhood Residential 4(NR-4)
and hereby approved for the Property. Notwithstanding the attached real property description,
the property being rezoned includes all property to the centerline of all adjacent street rights-of-
way
SECTION 3. The City's official land use map is amended to show the change in the land
use designation.
SECTION 4. If any provision of this ordinance or the application thereof to any person
or circumstance is held invalid by any court, such invalidity sha11 not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable.

SECTION 5. Any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense.
SECTION 6. This ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, a daily newspaper published in the City of
Denton, Texas, within ten (10) days of the date of its passage.

Country Club Road Tract
All that certain trect or parcel of land situated in the J. W. Withers Survey, Abstract No. 1343, Dentoh
County, Texas, being part of a certain 76,5 acre tract described in a Deed ofTrust from Thomas W. Fry,
etux, to A. C. Williams, Trustee, dated September 16,1933, and being the same two tracts described in a
Deed from Anna R. Fry, a widow to Gordon Fry, dated August 17,1968, recorded in Volume 571, Page
18, Deed Records of Denton County, Texas, and being more particularly described as follows:
BEG INNING at a fence corner at the existing Northwest corner of said 76.5 acre tract on the East right of
way of FM Road 1830;
THENCE North 89 degrees 58 minutes East with a fence on the North line of said tract, a distance of
751.0 feet to a fence corner on the Southwest right of way of the Santa fe Railroad;
THENCE South 34 degrees 12 minutes East with the southwest right �f-way of the Santa Fe railroad, a
distance of 1536.40 feet to a corner on the South line of said 76.5 acre tract;
THENCE SOUTH 89 degrees 58 minutes West with a fence on the south line of said 76.5 acre trect, a
distance of 1609,9 feet to a right of way post for comer, in tfie East right of way of F-M Road 1830 and
being the existing Southwest corner of sald 76.5 acre trect;
THENCE North 06 degrees 49 minutes West with the East right of way of said F-M Road 1830, a distance
of 42, 2 feet to a corner;
THENCE with the East right of way of said F-M Road 1830 around a curve to the right, having a radius of
1,392.50 feet, an arc length of 195,98 feet, and a cord which bears North 02 de�rees 52 minutes 06
seconds West a distance of 195.81 feet to a corner;
THENCE North 00 degrees 32 minutes East with the East right of way of said F-M Road 1830, a distance
