ORDINANCE NO. 2013-086
AN ORDINANCE ABANDONING AND VACATING (1) A PORTION OF A 2.322 ACRE
DRAINAGE EASEMENT (HEREIN SO CALLED) GRANTED TO THE CITY OF DENTON,
TEXAS, PURSUANT TO THAT CERTAIN DRAINAGE EASEMENT, ACCEPTED BY THE
CITY OF DENTON ON MARCH 15, 2007, FROM D.R. HORTON — TEXAS, LTD., AND
RECORDED AS INSTRUMENT NO. 2007-30855, REAL PROPERTY RECORDS, DENTON
COUNTY, TEXAS, AND (2) A 0.693 ACRE PUBLIC DRAINAGE EASEMENT (HEREIN SO
CALLED), GRANTED TO THE CITY OF DENTON, TEXAS, PURSUANT TO THAT
CERTAIN PUBLIC DRAINAGE EASEMENT, ACCEPTED BY THE CITY OF DENTON ON
SEPTEMBER 21, 2011, FROM D.R. HORTON — TEXAS, LTD., AND RECORDED AS
INSTRUMENT NO. 2011-91225, REAL PROPERTY RECORDS, DENTON COUNTY,
TEXAS (THE 2.322 ACRE DRAINAGE EASEMENT AND THE 0.693 ACRE PUBLIC
DRAINAGE EASEMENT ARE COLLECTIVELY REFERRED TO HEREIN AS THE
"DRAINAGE EASEMENTS"), SAID DR.AINAGE EASEMENTS LOCATED 1N THE
WILLIAM ROARK SURVEY, ABSTRACT NO. 1087, DENTON COUNTY, TEXAS; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, D.R. Horton — Texas, Ltd., a Texas limited partnership ("Owner") has
represented to the City of Denton that it is the underlying fee simple owner of lands encumbered
by the Drainage Easements;
WHEREAS, a portion of the 2.322 Acre Drainage Easement was partially abandoned
pursuant to Ordinance No. 2012-059 (the "Prior Ordinance"), passed and approved by the City of
Denton, Texas (the "City") on March 6, 2012, said partial abandonment affecting the 2.322 Acre
Drainage Easement insofar as it encumbered that certain .811 acre tract, as more particularly
described in the Prior Ordinance;
WHEREAS, the remaining land encumbered by the 2.322 Acre Drainage Easement, after
the enactment of the Prior Ordinance, is a 1.511 acre tract, as described on Exhibit "A", attached
hereto and made a part hereof (the "Remaining Lands");
WHEREAS, the lands encumbered by the 0.693 Acre Public Drainage Easement are
described on Exhibit "B", attached hereto and made a part hereof;
WHEREAS, the Owner has requested the City of Denton to abandon the (i) 2.322 Acre
Drainage Easement, as to the Remaining Lands; and (ii) the 0.693 Acre Public Drainage
Easement;
WHEREAS, staff has reviewed the requested abandonment by Owner of the Drainage
Easements, as provided above, and has recommended approval of such abandonxnents; and
WHEREAS, the City Council of the City of Denton, Texas has determined that it is in the
public interest to abandon the (i) 2.322 Acre Drainage Easement, as to the Remaining Lands; and
(ii) the 0.693 Acre Public Drainage Easement; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The recitations and fmdings contained in this ordinance are incorporated
herein by reference the same as if fully set forth in this Section 1.
SECTION 2. The (i) 2.322 Acre Drainage Easement, as to the Remaining Lands; and
(ii) the 0.693 Acre Public Drainage Easement, are hereby permanently abandoned and, subject to
the reservations set forth in this ordinance, all of the City's right, title and interest in the
Drainage Easements, as abandoned herein, are hereby released to the Owner. A certified copy of
this ordinance may be recorded in the Real Property Records of Denton County, Texas to
evidence this abandonment and release.
SECTION 3. Notwithstanding anything to the contrary contained in this ordinance, the
City of Denton hereby retains and reserves any and all easements, rights of way and any other
rights or interests, other than the Drainage Easements, whether acquired, obtained, owned or
claimed by the City of Denton ar public, by, through or under conveyance, dedication by plat or
other express dedication, irnplied dedication, prescription, or by any other manner or means, in
or to lands in which the Drainage Easements may cover, encumber, include, cross or overlap.
SECTION 4. This ordinance shall become effective immediately upon its passage and
approval.
