2013-089s:\legallour documentslordinances113\s12-0005 revisedfinal ordinance.doc ORDINANCE NO. 2013-089 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A SPECIFIC USE PERMIT TO ALLOW A BASIC UTILITY; A DME ELECTRIC SUBSTATION, ON APPROXIMATELY 8.75 ACRES OF LAND WITHIN A NEIGHBORHOOD RESIDENTIAL MIXED USE 12 (NRMLJ-12) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION, LOCATED WEST OF LOOP 288, SOUTH OF AUDRA LANE, AND DIRECTLY EAST OF AUDRA MEADOWS, PHASE 2 SUBDIVISION, WITHIN THE CITY OF DENTON, DENTON COUNTY, TEXAS; PROVIDING FOR A PENALTY 1N THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. (512-0005) WHEREAS, Teague, Nall and Perkins has applied for a Specific Use Permit to allow a basic utility; an electric substation on approximately 8.75 acres of land within a Neighborhood Residential Mixed Use 12 (NRMLJ-12) zoning classification and use designation legally described in E�ibit "A", attached hereto and incorporated herein by reference (hereinafter, the "Property"); and WHEREAS, on February 20, 2013, the Planning and Zoning Commission concluded a public hearing as required by law, and recommended approval of the requested Specific Use Permit, subject to conditions; and WHEREAS, the City Council finds that the request is consistent with the Denton Plan and the Denton Development Code; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference and found to be true. SECTION 2. The Specific Use Permit (SUP) to allow a basic utility on the Property is hereby approved, subject to the following conditions: 1. A one-hundred (100) foot wide buffer area shall be maintained on the western property line, adjacent to the existing single family subdivision (Audra Meadows, Phase 2). Within the 100-foot buffer area, the applicant shall provide a Type D Buffer using existing and new plantings. A Type D Buffer includes a thirty (30) — foot planted strip with a combination of 8 evergreen and deciduous trees and 20 shrubs per one-hundred (100) linear feet. The remaining seventy (70) feet shall include grass/ground cover only; 2. The aforementioned Type D Buffer shall extend to the east along the northern property line of the substation site, approximately 250 feet, shown as Exhibit B; s:llegal\our documents\ordinances1131s12-0005 revisedfinal ordinance.doc 3. A gate shall be erected at the entrance of the access road to prevent unauthorized access; and 4. A perimeter masonry wall shall be constructed with a minimum height of ten (10) feet. SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall affect the validity of the provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 4. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 5. This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
