2013-133s:llegallour documentslordinances\131canvass election 2013 gas utility.doc ORDINANCE NO. 2013-133 AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF AN ELECTION HELD 1N THE CITY OF DENTON ON MAY 11, 2013 ALLOWING THE CITY OF DENTON TO OWN, ACQUIRE, CONSTRUCT, MAINTAIN, AND OPERATE A GAS UTILITY 1N ORDER TO PROVIDE GAS UTILITY SERVICES TO NON- RESIDENTIAL CUSTOMERS IN THAT AREA OF THE CITY NEAR THE AIRPORT 1NDUSTRIAL PARK AND BOUNDED BY THE EMBR.ACEMENT OF C. WOLFE ROAD, JIM CHRISTAL ROAD, THOMAS J. EGAN ROAD, U.S. HIGHWAY 380, INTERSTATE HIGHWAY 35, INTERSTATE HIGHWAY 35 WEST, JOHN PAINE ROAD, F.M. HIGHWAY 2449, AND TOM COLE ROAD; AND PROVIDING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Council finds and declares that the May 11, 2013 regular municipal election was duly ordered for the purpose of putting the question before the City of Denton voters of whether the City should become a gas utility in a limited area of the City and for a limited purpose; that proper notice of said election was duly given and election officials appointed; that the election was duly held and the returns of the election officials have been delivered to the Council, all in accordance with the laws of the State of Texas and the Charter and ordinances of the Ciiy of Denton. SECTION 2. The official returns of the election officials having been opened, examined, and canvassed, and the Council hereby finds and declares that 2,385 ballots were cast at the election, and that the votes cast for the Proposition stated below were as follows: EARLY VOTING: PROPOSITION SHALL THE CITY OF DENTON BE ALLOWED TO OWN, ACQUIRE, CONSTRUCT, MA1NTAlN, AND OPERATE A GAS UTILITY IN ORDER TO PROVIDE GAS UTILITY SERVICES TO NON-RESIDENTIAL CUSTOMERS IN THAT AREA OF THE CITY NEAR THE AIRPORT INDUSTRIAL PARK AND BOUNDED BY THE EMBRACEMENT OF C. WOLFE ROAD, JIM CHRISTAL ROAD, THOMAS J. EGAN ROAD, U.S. HIGHWAY 380, 1NTERSTATE HIGHWAY 35, 1NTERSTATE HIGHWAY 35 WEST, JOHN PAINE ROAD, F.M. HIGHWAY 2449, AND TOM COLE ROAD. WOLFE ROAD, JIM CHRISTAL ROAD, THOMAS J. EGAN ROAD, U.S. HIGHWAY 380, INTERSTATE HIGHWAY 35, INTERSTATE HIGHWAY 35 WEST, JOHN PA1NE ROAD, F.M. HIGHWAY 2449, AND TOM COLE ROAD. YES 1,661 NO 620 SECTION 3. The City Council has found and determined that the meeting at which this ordinance is considered is open to the public and that notice thereof was given in accordance with provisions of the Texas open meetings law, Tex. Gov't Code ch. 551, as amended, and that a quarum of the City Council was present. SECTION 4. This ordinance shall become effective immediately upon its passage and approval.
