2013-209sAlegahour documentslordinances1131z13 -0004 draft ordinance.doc ORDINANCE NO. 2013 -209 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, REGARDING AN INITIAL ZONING REQUEST OF INDUSTRIAL CENTER GENERAL (IC -G) FOR APPROXIMATELY 6.88 ACRES OF LAND, GENERALLY LOCATED APPROXIMATELY 1,250 FEET SOUTH OF THE MCKINNEY STREET AND GRISSOM ROAD INTERSECTION, LEGALLY DESCRIBED AS LOT 1, BLOCK 1 OF THE LAKE DALLAS STORAGE ADDITION, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF; PROVIDING SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. (Z13 -0004) WHEREAS, the applicant, Atmos Energy, has applied for an initial zoning request of Industrial Center General (IC -G) for approximately 6.88 acres of land; and WHEREAS, after providing notice and after conducting a public hearing on July 24, 2013 as required by law, the Planning and Zoning Commission recommended approval of the requested initial zoning; and WHEREAS, after providing notice and after conducting a public hearing on August 20 2013 as required by law, the City Council finds that the requested initial zoning is consistent with the Denton Plan and are in the public interest; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference and found to be true. SECTION 2. The zoning district classification and use designation for approximately 6.88 acres of land legally described as Lot 1, Block 1 of the Lake Dallas Storage Addition, which for all purposes herein (the "Property "), is hereby assigned an Industrial Center General (IC -G) zoning district classification and use designation. Notwithstanding the real property description, the property being zoned includes all property to the centerline of all adjacent street rights -of- way. SECTION 3. The City's official zoning map is amended to show the change in zoning district classification and use designation. SECTION 4. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 5. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 6. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 7. This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record - Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
