WHEREAS, Mr. Jeff Hardgrave, on behalf Atmos Pipeline, Texas, has applied for a
Specific Use Permit to allow installation of a telecommunication tower on a praperty located in
an Industrial Center General (IC-G} zoning and use district on approximately 6.88 acres and
legally described in Exhibit "A99y attached hereto and incorporated herein by reference (Plat of
Lot l, Block 1 of Lake Dallas Storage Addition); and
WHEREAS, on June 11, 2014, the Planning and Zoning Commission concluded a public
hearing as required by law, and recommend approval of the Specific Use permit with conditions
of approval; and
WHEREAS, on July I5, 2014, the City Council concluded a public hearing as required
by law, and finds that the Specific Use Permit is consistent with the Denton Plan and the
Development Code; NOW, THEREFORE,

SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference and faund to be true.
SECTION 2. A Specific Use Permit to allaw the installation of a telecommunication
tower use on the Property is hereby approved, subject to the following conditions:
1. The site plan as submitted and shown as Exhibit 66g'j99 shall guide the development of the

telecommunication tower on the subject site.
2. The elevations plan submitted and shown as Exhibit 66("199 shall guide development of the
\✓
tower. The tower shall not exceed 165 feet in height as shown in the elevation plan.
SECTION 3. The Specific Use Permit site plan attached hereto and incorporated herein
by reference as Exhibit "B99y is hereby approved, as an additional condition of the perrnit.
SECTION 4. If any provision of this ordinance or the application thereof to any person
or circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions ar applications, and to this end the provisions of this ordinance are severable.
SECTION 5. Any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense.
SECTION 6. This ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, a daily newspaper published in the City of
Denton, Texas, within ten (10) days of the date of its passage.
