ORDINANCE NO. 2014-421
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING A SPECIFIC USE
PERMIT TO ALLOW A`�BASIC UTILITY," A DENTON MUNICIPAL ELECTRIC
(DME) ELECTRICAL SUBSTATION, ON APPROXIMATELY 10.45 ACRES OF LAND
WITHIN A NEIGHBORHOOD RESIDENTIAL 3(NR-3) AND A NEIGHBORHOOD
RESIDENTIAL 4(NR-4) ZONING DISTRICT. THE SUBJECT PROPERTY IS
GENERALLY LOCATED ON THE NORTHWEST CORNER OF KINGS ROW DRIVE
AND N LOOP 288, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS; AND
PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR
VIOLATIONS THEREOF, SEVERABILITY AND AN EFFECTIVE DATE (514-0007).
WHEREAS, Denton Municipal Electric, has applied for a Specific Use Permit to allow a
"Basic Utility," an electrical substation, on approximately 10.45 acres of land within a
Neighborhood Residential 3(NR-3) and a Neighborhood Residential 4(NR-4) zoning district
legally described in Exhibit A and depicted in Exhibit B, attached hereto and incorporated herein
by reference (hereinafter, the "Property"); and
WHEREAS, after providing notice and after conducting a public hearing on November
5, 2014 as required by law, the Planning and Zoning Commission recommended approval (6-1)
of the Specific Use Permit; and
WHEREAS, after providing notice and after conducting a public hearing on December
2, 2014 as required by law, the City Council finds that the initial zoning is consistent with the
Denton Plan and is in the public interest; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance
are incorporated herein by reference as true.
SECTION 2. The Specific Use Permit to allow a"Basic Utility" on the Property is
hereby approved, subject to the following conditions:
A perimeter masonry security wall shall be constructed with a minimum height of
ten (10) feet.
2. The substation shall be subject to the attached site plan and landscape plan.
3, Upon construction of the N Loop 288 "backage" road, the eastern driveway shall
be closed and moved to the location shown on the future site plan attached.
4. Upon construction of the new driveway along N Loop 288, a minimum 10 ft. high
masonry wall shall replace the existing gate opening and new tree and landscape
planting shall be used to screen the wall.
SECTION 3. If any provision of this ordinance or the application thereof to any person
or circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable.
SECTION 4. Any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense.
SECTION 5. This ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, a daily newspaper published in the City of
Denton, Texas, within ten (10) days of the date of its passage.

BEINO a 10.45 acre tract of land situated in the J. Coltart Survey, Abstract No. 288 and the D. Culp
Survey, Abstract No. 287, City of Denton, Denton Cour�y, Texas, and being known as part of a
called 200 acre tract of land described in a Deed to Brown Development I, Ltd., as recorded in
Document Number 1999-001683 of the Real Property Records of Denton County, Texas, and
being more particularly described as follows:
BEGINNINC3 at a broken concrete monument found for corner at an angle point in the
Southwesterly line of S.H. Loop 288, a variable width right-of-way described in a Deed to the State
of Texas, as recorded in Volume 1029, Page 134 of the Deed Records of Denton County Texas;
THENCE South 02°34'02" West along the Southwesterly line of said S.H. Loop 288, for a distance
of 32.68 feet to a 1/2 inch iron rod with cap stamped "METROPLEX" found for corner in the South
line of said State of Texas tract and the South line of said 200 acre tract;
THENCE North 87°36'33" West along the South line of said 200 acre tract, for a distance of 147.55
feet to a PK nail found for corner in King's Row Road;
THENCE North 87°06'21" West continuing along the South line of said 200 acre tract, and along
and near the Northerly edge of said King's Row Road, for a distance of 752.42 feet to a 5/8 inch
iron rod with cap stamped "TNP" set for corner, from which a 1/2 inch iron rod with cap found for
reference bears North 87°06'21" West a distance of 482.91 feet;
THENCE North 11 °10'04" West departing the South line of said 200 acre tract and said King's Row
Road, for a distance of 1030.72 feet to a 5/8 inch iron rod with cap stamped "TNP" set for corner in
the Southwesterly line of said S.H. Loop 288, from which a 1/2 inch iron rod with cap stamped
"Metroplex" found for reference bears North 44°58'34" West a distance of 178.54 feet;
THENCE South 44°58'34" East along the Southwesterly line of said S.H. Loop 288, for a distance
of 622.71 feet to a concrete monument found for corner;
THENCE South 50°37'22" East continuing along the Southwesterly line of said S.H. Loop 288, for a
distance of 200.32 feet to a broken concrete monument found for corner;
THENCE South 47°58'30" East continuing along the Southwesterly line of said S.H. Loop 288, for a
distance of 679.81 feet to the POINT OF BEGINNING, and containing 10.45 acres of land, more or
less.
