2015-102ORDINANCE NO. 2015-102 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING A SPECIFIC USE PERMIT TO ALLOW FOR EXPANSION OF THE MUNICIPAL SOLID WASTE LANDFILL AND ASSOCIATED SOLID WASTE AND RECYCLING GROUND SERVICES OPERATIONS AND EQUIPMENT STORAGE ON APPROXIMATELY 156.9 ACRES. THE SUBJECT PROPERTY IS ZONED INDUSTRIAL CENTER GENERAL (IC-G) AND IS GENERALLY LOCATED NORTH OF SPENCER ROAD AND EAST OF MAYHILL ROAD, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS; AND PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF, SEVERABILITY AND AN EFFECTIVE DATE (513-0007). WHEREAS, the City of Denton, has applied for a Speciiic Use Permit to allow a "Sanitary Landfill" and "Heavy Manufacturing," on approximately 156.9 acres of land within an Industrial Center General (IC-G) zoning district legally described in Exhibit "A" and depicted in Exhibit B, attached hereto and incorporated herein by reference (hereinafter, the "Property"); and WHEREAS, after providing notice and after conducting a public hearing on February 18, 2015 as required by law, the Planning and Zoning Commission recommended approval (5-2) of the Specific Use Permit with conditions; and WHEREAS, after providing notice and after conducting a public hearing on April 7, 2015 as required by law, the City Council finds that the Specific Use Permit is consistent with Denton Plan 2030 and is in the public interest; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference as true. SECTION 2. The Specific Use Permit to allow a"Sanitary Landfill" and "Heavy Manufacturing" on the Property is hereby approved, subject to the following conditions: 1. The property owner shall construct a"Type D" buffer along the boundary of the entire western property line of the landfill and along the northern property lines of the lands subject to this zoning case, except on the portions of the boundary that are adjacent to 1001 South Mayhill Road, Buildings 101 and 102. 2e The buffer applicable to the lands subject to this zoning case shall be constructed prior to using the property for depositing debris. • SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 4. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 5. This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
