THE SUBJECT PROPERTY IS GENERALLY LOCATED ON THE WEST SIDE OF COOPER CREEK ROAD, APPROXIMATELY 750 FEET SOUTH OF SILVER DOME ROAD AND 1,250 FEET NORTH OF FISHTRAP ItOAD, IN TgIE CITY OF DENTON, DENTON COUNTY, TEXAS; AND PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF, SEVERABILITY AND AN EFFECTIVE DATE (Z14-0010). WHEREAS, Randall Smith, on behalf of the property owner, the Estate of C. L. Byrom, has applied for an initial zoning of Neighborhood Residential 4(NR-4) on approximately 17.76 acres and Neighborhood Residential 6(NR-6) on approximately 22.75 acres of land legally described in Exhibit "A" and depicted in Exhibit "B", attached hereto and incorporated herein by �'� reference (hereinafter, the "Property"); and WHEREAS, after providing notice and after conducting a public hearing on March 11, 2015 as required by law, the Planning and Zoning Commission recommended approval (6-0) of the initial zoning designations; and �VHEREAS, after providing notice and after conducting a public hearing on April 7, 2015 as required by law, the City Council finds that the initial zoning designations are consistent with Denton Plan 2030 and are in the public interest; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference as true. SECTION 2. The initial zoning designations on the Property are hereby approved. SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provi.sions or applications, and to this end the provisions of this ordinance are severable. SECTION 4. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 5. This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
