2015-232sAlegal\ our documents \ordinances \15 \auto theft ord 2016.doex ORDINANCE NO. 2015 -232 AN ORDINANCE OF THE CITY OF DENTON, TEXAS AUTHORIZING THE CITY MANAGER TO MAKE AN APPLICATION WITH THE TEXAS AUTO BURGLARY AND THEFT PREVENTION AUTHORITY FOR A GRANT TO FOCUS ON AUTO THEFT AND AUTO BURGLARY AND TAKE ALL OTHER ACTIONS NECESSARY TO OBTAIN AND IMPLEMENT THE PROGRAM; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Denton, Texas, is concerned with the reduction of auto theft and auto burglary crimes which adversely affect our community; WHEREAS, under the provisions of the Texas Revised Civil Statutes Article 4413(37), Texas Administrative Code, Part 3, Chapter 57, entities are eligible to receive grants from the Automobile Burglary and Theft Prevention Authority to provide financial support to law enforcement agencies for economic automoblile theft enforcement teams and to combat automobile burglary in the jurisdiction; WHEREAS, a Texas Auto Burglary and Theft Prevention Authority grant will assist the City of Denton in combating vehicle burglary and theft; WHEREAS, the City of Denton will adhere to all policies and regulations governing grants awarded by the Texas Auto Burglary and Theft prevention Authority; WHEREAS, the City of Denton has agreed that in the event of loss or misuse of said grant funds, the City of Denton assures that the grant funds will be returned in full to the Texas Automobile Burglary and Theft Prevention Authority; and WHEREAS, the Texas Auto Burglary and Theft Prevention Authority requires the appropriate certifications and the City Council deems it in the public interest to authorize the City Manager to execute a grant agreement; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Council of the City of Denton, Texas, authorizes the City Manager or his designee to sign and submit a grant application to the Texas Auto Burglary and Theft Prevention Authority and all appropriate officials thereof, together with all necessary certifications, grant agreements and other documents, to obtain a grant under the Texas Auto Burglary and Theft Prevention Authority. The purpose of the grant is to assist the City of Denton in combating vehicle burglary and theft. The City Manager is authorized to take all other actions necessary to execute an agreement and administer this grant including execution of agreements. SECTION 2. The City Council of the City of Denton, Texas, authorizes the City Manager or his designee to sign and submit to the Texas Auto Burglary and Theft Prevention Authority and all appropriate officials thereof, amendments, change orders, together with all necessary certifications, and other documents, under the supervision of the City Manager or his designee, to handle all fiscal and administrative matters relating to the administration of the Texas Auto Burglary and Theft Prevention Authority Grant Program and the task force to focus on auto theft and burglary, if it is funded and all other matters connected therewith. SECTION 3. The City Secretary is hereby authorized to furnish true, complete, and correct copies of this ordinance to all interested parties. SECTION 4.
