PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Tree Fund is administered by the City as a fund for tree mitigation,
which is used to purchase, plant and maintain trees in the City and to educate citizens and
developers on the benefits and value of trees; and

applicants on a first come -first served basis, which allows for reimbursement for the purchase of
trees in the form of a credit on the applicant's City of Denton Utility Service Bill, in order to
encourage the planting of new trees within the city limits; and
WHEREAS, the City Council hereby finds that the proposed rules and procedures for the
Tree Rebate Program as reflected in the Tree Rebate Program Application, attached as Exhibit

retention of control over the funds to ensure that the above public purpose is accomplished in
order to protect the public's investment and to insure the City receives a return benefit; and
WHEREAS, the City Council approved Ordinance 2015 — 25Z , authorizing an
amendment to Section 35.13.7.A.7.e of the Denton Development Code, amending use of the

adopted in the City's annual budget, and has determined that the use of proceeds from the tree
fund for this program is in the best interest of the health, safety, morals, and general welfare of
the City of Denton and should be granted as set forth herein: NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
