AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A SPECIFIC USE
PERMIT FOR MULTI-FAMILY DWELLINGS ON PROPERTY WITHIN A
NEIGHBORHOOD RESIDENTIAL MIXED USE 12 (NRMU-12) ZONING DISTRICT AND
USE CLASSIFICATION ON APPROXIMATELY 0.8 ACRES OF LAND GENERALLY
LOCATED ON THE SOUTHEAST CORNER OF TALIAFERRO STREET AND NORTH ELM
STREET, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS; PROVIDING FOR A
PENALTY 1N THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF;
PROVIDING A SEVERABILITY CLAUSE, SAVINGS CLAUSE, AND AN EFFECTIVE
DATE. (S 15-0018)
WHEREAS, Yolanda Vela Vorel with Tim Beaty Builders has applied for a Specific Use
Permit (SUP) on behalf of the property owner to allow Multi-Family dwellings on property within
a NRMU-12 zoning district and use classification, legally described in Exhibit "A" and attached
hereto and incorporated herein by reference (hereinafter, the "Property"); and
WHEREAS, on March 9, 2016, the Planning and Zoning Commission, in compliance with
the laws of the State of Texas, have given the requisite notices by publication and otherwise, and
have held due hearings and afforded full and fair hearings to all property owners interested in this
regard, and have recommended approval (7-0) of the requested SUP, subject to conditions; and
WHEREAS, on April 5, 2016, the City Council likewise conducted a public hearing as
required by law, and finds that the request is consistent with the Denton Plan and federal, state,
and local law and that the Applicant has agreed to comply with all provisions of the Denton
Development Code, as they exist, may be amended, or in the future arising, including but not
limited to, this Ordinance, and has further agreed to comply with the additional restrictions and
conditions set forth herein; and
WHEREAS, the Planning and Zoning Commission and the City Council of the City of
Denton, in considering the SUP request have determined that the proposed use is in the best interest
of the health, safety, morals, and general welfare of the City of Denton, and accordingly, the City
Council of the City of Denton is of the opinion and finds that said zoning change is in the public
interest and should be granted as set forth herein; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION lm. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference and found to be true.
SECTION 2. The SUP to allow Multi-Family Dwellings on the property is hereby
approved, subject to the following condition:
The proposed development on the Property shall substantially comply with the attached site plan
(Exhibit "B"), building elevations (Exhibit "C"), and landscape plan (Exhibit "D").
SECTION 3w If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of the
provisions or applications, and to this end the provisions of this ordinance are severable.
SECTION 4. Any person, firm, partnership or corporation violating any provision of this
ordinance shall, upon conviction, be deemed guilty of a misdemeanor and shall be punished by
fine in a sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense.
SECTION 5. That an offense committed before the effective date of this ordinance is
governed by prior law and the provisions of the Denton Code of Ordinances, as amended, in effect
when the offense was committed and the former law is continued in effect for this purpose.
SECTION 6. In compliance with Section 2.09(c) of the Denton Charter, this ordinance
shall become effective fourteen (14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-
Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the
date of its passage.

SUP Legal Description
FIELD NOTES to all that certain lot, tract or parcel of land situated in the N.H. Meisenheimer Survey,
Abstract Number 247, and the D.O. Goddard Survey, Abstract Number 811, City of Denton, Denton County
Texas; and being all of a called 0.794 Tract One and Two described in the deed to PHCF, Inc., recorded in
Volume 4425, Pave 1757, Deed Records, Denton County, Texas, the subject tract being more particularly
described as follows;
BEGINNING for the Northwest corner of the tract being described herein at a ROW Monument found at the
intersection of the East line of North Elm Street and the South line of Taliaferro Street, same being the
Northeast corner of a save and except tract described in the deed from E.E. Wright Jr. and E.E. Wright, III
to the State of Texas recorded in Volume 4306, Page 1632, of the Real Property Records of Denton County
Texas;
THENCE South 89 degrees 58 minutes 25 seconds East along the South line of said Taliaferro Street for
a distance of 129.87 feet to a Metal Fence Corner Post for the Northeast corner of the tract being described
herein, same being the Northwest corner of a called 0.457 acre tract described in the deed to Lawrence
