On Monday, September 26, 2016, the City of Denton City Secretary received an ethics
complaint filed by Denton resident, Sarah Gamblin, via electronic mail. More specifcally, Ms.
Gamblin alleges that Council Member Bagheri has violated the following paragraphs of the City's
Ethics Resolution (R2006-003):

As a representative of the City of Denton, I will be service-oriented.
I will be friendly, receptive, courteous, and respectful to everyone. I will
be attuned to and care about the needs and issues of all Denton citizens.
As a representative of the City of Denton, I,vill be communicative.

enter into dialog. I will listen carefully and my response will add value to
the conversation.

The factual allegations in support of Ms. Gamblin's complaint ai-e contained in her e-mail,
a copy of which is enclosed. A copy of tlie City's Cthics Resolution, as amended, is also enclosed.
Per City Resolution R2009-015, this complaint to the Chair of the Ethics Committee so as
to schedule a meeting of the �thics Committee within thirty (30) days of the filing of the coinplaint.
As Chair of the Ethics Committee, I have called an Ethics Committee ii�.eetin� to be held on Priday,
October 14, 2015 at 10:00 a.m. in the City Council Work Session Roorn, located at Denton City
Hall, 215 L. McKinney.
At this meeting, the Ethics Committee will review the complaint, along with any
documents submitted in support or against, and will determine whether the complaint is valid aud
if so, whether a hearing sllould be scheduled. In the meantime, if either of you ha�ve any documents
that you wish for the Ethics Committee to consider at its October 14'h rneeting, please submit thern

> On August 24 and 25, Councilwoman Bagheri responded with contempt toward an honest request I made on Facebook
for information about her agenda. She also responded with hostility towards Councilman Roden's response to my
question. Second, in a private Facebook message she vented all of her frustrations about Councilman Roden in
inappropriate and unprofessional ways. Third, she joined one of her friends in an attack on me on Facebook, related to
the original issue. I believe my accusations are well supported by the screen shots I took of our dialogue on FB and
private messenger.

> First, here is the context. On August 24th I posted on Facebook a question about flyers loc.ally distributed in August by
"Americans for Prosperity." I received a visit from a canvasser representing this organization at my home. I gleaned that
this organization was about "School Choice" and lowering taxes. I immediately thought of the many things I learned
about these issues from Facebook, like Ms. Bagheri's frequent posts about lowering,taxes, and from the newly
appointed fiscally conservative P and Z commissionerStephen Sullivan. I wondered about the possible intersections of
these agendas and what that might mean for son's education.

> Ms. Bagheri met my inquiry with hostility and arrogance which was triggered by a factual comment made by Mr.
Roden, revealing the "American Prosperity" group's association with EmpowerTexans, one of Ms. Bagheri's endorsers.
Ms. Bagheri's reply was sarcastic and disdainful toward Kevin and me "...what conclusion are you drawing? Because the
only one I can draw every time you and Sarah [meaning me.. and fyi, I had never asked about this before] start up with
this shit..." There is a lot wrong with this comment, but the main issues are that Ms, Bagheri is escalating a council
conflict in a public forum, and dismissing my concerns as a citizen and constituent as if they were extensions of conflicts
she has with Mr. Roden. This statement by Bagheri violates #2, #4 and #5 of the above policy.

> I persisted and later was able to get more focused attention to my questions in a private message on Facebook with
Ms Bagheri. However, in that private message Ms. Bagheri lambasted Councilman Kevin Roden at length, seeking to
damage my view of him. Eventually, after the diatribe against Mr. Roden, she answered my questions about her agenda
to a degree that helped me see her position. Nevertheless, this defaming of a colleague in the process violates #5 above,
in my opinion.
> In the mean time, back on the Facebook thread, I found myself under attack by someone else, who was defending Ms.
Bagheri's right to be defensive about my question. I defended myself addressing this person. At this point, Ms. Bagheri
piled on, demeaning me in this public, social media space. Apparently she felt I was attacking her friend? (I was not
aware of the connection in the moment but Ms. Bagheri is closely associated with the attacker, a co-administrator on
the group "Denton Matters." )
> Since this interaction, I have found myself the target of many attacks on frequent occasions by Ms. Bagheri's ardent
supporters. I can't help but think if she had treated my question with fairness, instead of contempt and ridicule, that Ms.
Bagheri's supporters might have also chosen to take a higher road. The violations of the above policy items, and the
general attitude of contempt and sarcasm displayed by Ms. Bagheri online, has created a tribal public environment for
civic discourse. It seems that commentary on social media is perceived by Bagheri in much the way tagging is used in
some urban graffiti, as a form of identifying gangs With this tribalist attitude the onty way to initiate a dialogue is to first
demonstrate loyalty to the tribe. Sara Bagheri is an elected official and should be trying represent all of us, not just those
who know better than to refer to her association with Empower Texans.

� I'm glad you haven't noticed taxes going up, David. My family's taxes went up
and they continue to go up. �urrently our commercial real estate taxes
represent more than 50% of the annual net income of the property. I define
that as regressive taxation based on the income level. To answer your
question, ad valorem, sales taxes, fees and franchise taxes make up the
general fund. Over the years the percentage of those items has floated the
same. Ad Valorem is consistently about 33-38% of the total. There will be
mare on the general fund at my budget and tax presentation Saturday
morning at City Hall, if you are interested.

I was sincerely asking a question. I'm trying to understand your positions and
your plans for the city. The first question fram the canvasser who visited me
today was, "do you think your taxes are to high?" This made me think of your
work on lowering taxes. These things plus Stephen 5ullivan, who has
expressed similar feelings about taxes, being appointed the P an Z, makes me
wonder if there are connections.. And I don't mean insidious connections with
the eev-il. I just want to understand this new direction of this city.
I am a concerned citizen trying to understand what may be coming down the
pike for my school age san.
I alsa want to better understand yaur position. I will look at my posts again
and try to see why yau construed this as an attack, but wow.
I know you are tired of Kevin connecting you with Empower Texans, and it
makes you defensive. I'm not Kevin. my question is innocent and I wish yau

I'm sorry to alienate you. I've decided to not
bottle up my feelings any longer. I thought my
first response to you was decent and direct.
Then came Kevin. As he does any time fihis topic
comes up. It's Kevin who works very hard to
bring ET into every discussion. I literally just
spent 8 haurs listening to his pedantry on
Tuesday. He's my trigger. He fiabricates about
my position in regular session and he yells at me
in closed session. He onfy needs the door to be
slightly open to start weaving his sophistry. I
knaw you like him and I don't intend to change
that. But I think he is one of the most dangerous
people I have ever met because he sows the
seeds of confusion and fear among the public
and he has a limited grasp of the main thing he's
supposed to be proficient at- the budget. Kevin
is the architect of your fear about SS on PZ,
these people canvassing door to door etc. when
the Truth is, everybody wants the same thing- a
bright future for their children. That's nothing to

Dear Ms Burgess,
Thank you for the information. Because of a prior professional commitment, I cannot attend the hearing on Friday. Ms
Bagheri has written to me that she intends to defend herself "as if this were before a court of law.", which concerns me.
Fairness would seem to require that I at least be present in these circumstances, and therefore I request that the
hearing be postponed until both sides can attend. Ms. Bagheri also indicated in her email that she would be sharing all
of our communication with the DRC. Because that communication is already accessible through Facebook, I cant help
but wonder if this is an attempt to intimidate me. This attempt at intimidation also leads me to believe that a
postponement is in order.
Please also note that the packet I was sent included none of the screen shots of Facebook conversation that I originally
submitted in my complaint. This may have been inadvertent, but I think it is important that the committee have some
idea of the kind of stuff that prompted my complaint. Please share the attached pdf file, containing screen shots and
captions, with the committee.
If the hearing can't be postponed I would like the following statement to be shared with the committee:
I hope that the outcome of this hearing will help forward a more positive environment of civic discourse. In addition, I
would like that policies regarding ethics complaints, procedures and potential outcomes be made more explicit to the
citizens, and that a social media policy be developed and implemented. I would like that Ms. Bagheri and all members of
council take their roles as civic servants with seriousness and reverence and take concrete action to demonstrate a
commitment to civility. I see my complaint as a part of process and effort to improve civic engagement. I am not a
lawyer and I do not think like one. Rather I am a citizen who seeks to live in the kind of civic democracy where occasional
questions can be heard and considered by our elected officials in a respectful environment.

TO THE HONORABLE MEMBERS of the City Council Ethics Committee, I
present the following response to Ms. Sarah Gamblin's allegations of ethics violations.
I.

At the outset, it is worth noting that the subject matter of the subject
communications was not related to city business. Ms. Gamblin asked about a group
advocating school choice. This is not in the realm of city business. Because of that, I
don't believe the ethics policy applies to the discussion. If it did, all discussions would be
subject to the ethics policy, and the policy does not indicate that intent in its plain
language.
Assuming however, that this Committee elects to take a liberal view of the ethics
palicy, Ms. Gamblin's complaint centers on 3 separate communications, which I have
organized as follows:
(a) My online response addressed to Mayor Pro Tem Roden, which mentioned Ms.
Gamblin, but nonetheless, was directed to Mr. Rodenl;
(b) My private communications with Ms. Gamblin, in which I apologized for
lumping her in with my response to Mr. Roden, and attempted to explain some
context for why I reacted the way I did to Mr. Roden2;
(c) My online response to Ms. Gamblin after she berated Jodi Ismert. Ms. Ismert was
defending my position by encouraging Ms. Gamblin to view things from a different
perspective.
Ms. Gamblin further alleges that my behavior has caused her to come under
attack by my supporters. She has provided no evidence of this claim, and
accordingly, I will not be addressing it.
The ethics policy provisions alleged to be violated are as follows:
No. 2 As a representative of the City of Denton, I will be service-oriented.
I will be friendly, receptive and courteous to everyone. I will be attuned to
and care about the needs of all Denton citizens.
No. 4 As a representative of the City of Denton, I will be communicative.

I will communicate that I am approachable, open-minded, and willing to
enter into dialogue. I will listen carefully and my response will add value

attitude. I will consider the broader regional and statewide implications of

Each allegation will be discussed herein below.

As evidenced by our private communications, I apologized to Ms. Gamblin for
mentioning her name in my communication with Mr. Roden. I acknowledged that I
shouldn't have included her in my admittedly sarcastic response to Mayor Pro Tem
Roden. Ms. Gamblin appeared to have accepted that apology based on our private
communication and her later past on the subject thread.
Ms. Gamblin was on notice and understood my desire not to get drawn into an
internet discussion with Mayor Pro Tem Roden based on our prior private
communications.3 She was also aware of Mr. Roden's online behavior toward me. She
acknowledged that fact in April when she said "But I do wonder if Kevin is slipping to
the Dark side. I don't like that he smeared you.i4 We had discussed this point at length
during the election when she asked why I didn't post on Denton Free Speech Matters.
I implore this Committee to consider the precedent being set with the facts Ms.
Gamblin is presenting. Ms. Gamblin and I should have been operating from a place of
mutual understanding, based on our prior communications. She was aware of my desire
to abstain from conversation with Mayor Pro Tem Roden and acknowledged my reasons
for doing so. Yet when a predictable reaction to Mayor Pro Tem Roden occurred, she
expressed indignation- even in the face of my sincere apology and followed this
indignation with a two-month public witch hunt to prove her point.
Agreeing with Ms. Gamblin would send a clear to the public: "Feign acceptance
and resolution of a matter with a public official and later bring it forward in allegations
made before this body. We will give you an audience under the guise of'ethics."' Because

of this disastrous result, I pray that this body will agree with me that communication (a)
was addressed and Ms. Gamblin should be held to her words and actions and not be
allowed to renew this complaint.
Further, it is my position that Ms. Gamblin does not have standing to
complain of my communication with Mr. Roden. She was right to chafe at her
inclusion in my response to him, which is why I offered my apology and explanation.
Beyond that, however, the matter is not her concern and the appropriate person to
allege an ethical violation based on that communication is Mr. Roden himself. Among
the numerous commenters on the thread, it was only Ms. Gamblin who felt the need to
take up for Mr. Roden. I believe the discussion that follows casts light on the reason why.

Communication (c) was my defense of Ms. Ismert, and specifically the
language I used in doing so. As the following discussion will demonstrate, the language,
tone and tenor of my communication was fully acceptable, and encauraged, within the
context of the forum in which it was posted, "Denton Free Speech Matters" (hereafter
"DFSM.") It was also acceptable in the context of my own relationship with Ms.
Gamblin, which has been show to be open, honest, and forthright as demonstrated in our
private communications in Exhibit B.

Context is imperative in understanding the true nature of Ms. Gamblin's
complaint, and the true nature of the discussion that took place on August 24. The subject
is merely the continuation of an online discussion that had been taking place over the
course of five months, beginning with my campaign to unseat the Mayor Pro Tem's
friend. As the following timeline will demonstrate, since 2016 Mayor Pro Tem has
engaged in public online accusations and innuendo with regard to one specific issue- my
association with Texans for Fiscal Responsibility, an endorsement arm of Empower
Texans. He has posted about my nomination on various pages both public and private. I
am able to document these discussions 3 times here. I am not able to publicly see other
conversations, but I am aware of their existence, both on Facebook and Twitter. As he
and Sarah Gamblin are simpatico, he was a regular commenter on her private page and
posts (which I am now blocked from seeing) on the topic of "radical right wing groups"
as he might call it. These discussions are in the same vein as the August 24 discussion
and made public to their viewers.
Beyond Mr. Roden's admitted fear of the "nutty" group, Empower Texans,
another important theme exists in Ms. Gamblin's online presence.5 As the timeline
demonstrates, Ms. Gamblin engaged in derogatory, sarcastic, and sometimes profane

posts on DFSM. She was not alone in her behavior. Denton Municipal Electric
employees also engage in this behavior, with Jim Maynard being the most frequent
poster. Almost identical to my statement (c) to Ms. Gamblin on August 24, is Mr.
Maynard's response to my comment on DFSM on May 3.6 In that thread, I simply posted
a link to governing.com that showed Gibbons Creek was not at risk of being shut down
due to EPA regulations. Mr. Maynard responded "Once again you have no idea what you
are talking about when it comes to energy. There are more things that come into play
when deciding to shut down a power plant. Things like age, economics, etc. geez the egos
in here. Out." This comment was met with no moderation from Mr. Campbell or Mrs.
Briggle. I can only assumed it was not deemed aggressive or rude by them and was
appropriate on DFSM.
Where Ms. Gamblin differs from Mayor Pro Tem Roden or Jim Maynard is her
often-invoked statements about "white privilege." As a person of color, I found these
posts distasteful and sometimes casually racist. Specifically, Ms. Gamblin posted
(and later deleted and apologized for the post) a statement to the effect of "Voting
third party in 2016 is the definition of white privilege." In response I posted "Wow."
As a woman of color who is entitled to vote however I wish, I was taken aback at the
audacity to marginalize so many people. Typically, I wouldn't bring the issue of racial
undertones into a discussion. I think it is highly relevant here.
As a person of color who is conservative on the fiscal front, I don't fit into Ms.
Gamblin's worldview. She readily admits her confusion about my fiscal positions. My
opinion is that she believes as a person of color, I belong to liberalism. The thought that
people of color don't have to be liberal is difficult for many white liberals like Ms.
Gamblin to understand. This is my opinion, of course, but I believe it is borne out by Ms.
Gamblin's attitude and her statements directed toward me online. What follows is a
chronology of that behavior.

]lelp with the gaps. This is over the course of about 18 months. it checks out in the city world. I can't

Last thing I need to point out about Mckinney's office of sustainability. They were funded by the Feds
with a grant. Their recommendations were that the city replicate services already provided by nan-
profits like farmers markets. The employees (3) were put in other departments. And mast importantly,
some of the recommendations were followed- just not through a separate "office of sustainability."
I appreciate yau so much for actually wanting to delve deepe'•. Whichever way this electian turns out,

Returning to posts on DFSM, after one month af aperation, it is clear that
DFSM is a vehicle far endorsement of incumbents, many times by DME employees.
DFSM is also a vehicle by which DME employees can insult the public withaut
intervention by either Mr. Campbell or Mrs. Briggle. On Apri130, Mr. Maynaxd states to
a member of the public "This is just another insane brain lapse from you.i8 On May 1,
employee Shane Wallin gives this retort to RDP critics, "The EMFs must be making you
crazy.i9 This cornment is fallowed by sarcasm coming from Ms. Gamblin far detractors
to "keep it up."

July 30 Amber Briggle posts to DFSM about her term on the Planning & Zoning
Commission ending. This leads to multiple discussions in several locations on FB abaut
her replacement, Stephen Sullivan, and his connection to Empower Texans. He is
accused by Ms. Gamblin and others of being a racist- a refrain repeated in our private
communications on August 25. ,
The subject of Stephen Sullivan's nomination is brought up again in the Denton
Matters page. In my defense of his nomination, and of leaving online behavior aut of the
equation when considering nominations to city boards, I point out the nomination of Ms.
Gamblin to the library board and her vitriolic language online, particularly toward Jodi
Ismert. Jodi Ismert respands that Ms. Gamblin has "apologized.i14
August 24 Gamblin posts the thread which is the subject of this complaint in DFSM. It is
about school choice.
This summary of the five-month run-up to the August 24th thread has some
commonalities:
1) During the manth of April, Mr. Roden's near daily attempts to undermine my
support on Facebook, using inflammatory statements about Empower Texans and
their desire to "take over city councils" and "gut local government." These attempts
were mirrored an his Twitter account.
2) Following the election during the summer months, inflammatary insults,
profanity and hyperbole by Sarah Gamblin directed to those with whom she
disagrees, but especially Jodi Ismert and anybody she perceived to be defending 7odi
Ismert.
3) A"Lord of the Flies" environment an DFSM in which the moderators were largely
absent and in which expletives, sarcasm and hyperbole were never checked,
particularly if made by the following people: Sarah Gamblin, Jim Maynard
or Shane Wallin.
It was in this environment that I was tagged in Sarah Gamblin's post about
school choice. My respanse was not out of the ardinary in tone, tenar ar vocabulary,
given the forum it was made in. Further, the moderators indicated the language I used
was acceptable, at least when it was used by Ms. Gamblin, Mr. Maynard or Mr. Wallin.
3. Discussion of Ga�a���1i�� IA:tlai�� �`c������1<�i��t
As I stated in the private message with Ms. Gamblin on August 25th, I was
sincerely sorry for lumping her with Kevin. I ought not have dane that. However, I
made a very concerted effort to bring Ms. Gamblin back into discussion abaut the

issue that it appeared she was interested in: taxes. We seemed to be on the right
track.
Unfortunately, Ms. Gamblin, in my opinion, chose to publicly degrade
someone who had simply tried to show Ms. Gamblin my worldview, in other words,
empathy. I didn't think it was right to stand by and witness such abuse. Because
DFSM lacks moderation, and particularly because at least one moderator had
already called Ms. Ismert "rude," I knew if I did not speak on her behalf, nobody would.
As I write this response to Ms. Gamblin's ethics complaint, I fully stand by
my decision to call her behavior out in the manner that I did. Ms. Gamblin's behavior
was simply bullying, and it deserved to be addressed in a public forum, using the
language and method that public forum had allowed Ms. Gamblin, Mr. Maynard and
others to use. The fact that Ms. Gamblin decided to revisit the thread to berate Ms.
Ismert after our private resolution speaks volumes to her online character as a
flame-thrower, a bully and simultaneously, a professional victim. I only pray that the
chronology above demonstrates that this was not an isolated incident, but a pattern and
practice on the part of Ms. Gamblin, particularly as it relates to her behavior toward
Ms. Ismert and those with whom she disagrees.
4. Post �'c���� �� ���r��
On September 28, I called Ms. Gamblin to let her know that I received her
complaint and that I have no objection to her moving forward, however l disagree
with her assessment of the situation or of the necessity of a complaint. That said, I
pointed out that if she felt my supporters became emboldened to harass her, that was a
valid point and I regret such an occurrence- if it happened. At writing, I have not seen
any proof of this claim.
I also pointed out to Ms. Gamblin that in the absence of a real ethics
ordinance or any procedures delineating the enforcement of the same, I highly
doubted she would achieve a resolution to her liking.
Following that conversation, I received an email from Ms. Gamblin accusing me
of being "threatening" because I pointed out that all our discussions will become public
record. � 5 Ms. Gamblin then took to the Denton Record Chronicle comment section to
accuse me of lying and misleading the public, a comment she later retracted after I
pointed it out to Michelle Maynard (the wife of Jim Maynard) on DFSM.
This post-complaint behavior is consistent with my assessment of Ms. Gamblin as
a provocateur and professional victim.

transparency and hiring an auditor. That is why I saught TrR's endorsement. lt was through their group that
I learned a lot about bonds, lobbying, pensions, etc. [ cross-checked their asseilians with the comptrollers
affrce and our awn budget summaries. And i found a financial guru to help with the gaps. This is aver the
course of about 3 8 months. It cl7ecks out in the city wc�rld, f can't speak the school boacd, that's not my area.
I'm an athiest, pra choice, and very socially liber•al, sa I tho«ght about this direction Cor a lo��g time. I alsa
talked with them (TFR) about my support ofthe fracking ban and why 1 believe HB 40 is unlawful. They
still endorsed me, knowing all that.

Last thing f need to paint out about Mckinney's office of sustainability. They were funded by the Feds with
a grant. Their recommendations were tha.t the city replicate services already providec� by non-profits like

In a few words, it means transparency, efiiciency, citizen invoivement, and the willingness ro make critrcal
improvements.
It means far every dollar of taxes paid, a citizen knows where it is being spent, that it's not being wasted, and that
it is spent for things many of aur residents can benefit from. [t also means that the city is up front with people
�bout how much things cost- �r ifthere are seriaus issuesthat could affecY aur qualiry of fife down the road.
My two examples: the ciry chose time and again that it woufdn't advocate for citizens when it came to fracking
and vested rights. Whose interest were they working for 'rn that iiistance? I disagree that it was for us.
Here's a fiscal example. I recently learned that there's a$60n� shortfall in the municipal pension pian due Co the
legislature revising anticipated ea��rings downward. (Btv✓, these anticipated earnings are crazy high to begin
��-ith.} ��e are contractually (and morally) ohligated ta pay our emrloyees that money. Where will it came fi•om?
Wf7at iti the numbers are revised downward again? I've never heard anyone have that discussion on ciry caunci{
or ���itli tl�e public. A city that works for citizens shoirld have that discussian. 1M0 it is the definition of
patronizing toe{ust say "ever}�thir7g is fine.°° The job of a city co�sncilar is ta include citizens and infntm citizens-
��,�ithout emotional pleas, scare tactics or sophistry- throughout their term. Not just at election time.
Hopefiilly it's clear from my writing that 1'm far from hating the governrnent. We need it for so many things that
can never lie provided elsewhere. We need it ta create a ievel e�onomic playing field, to control extemalities like
pollutian, ta pravide safety, ete. Those are all essential f'unctions. What I can't aeree with is the idea that if I look
at �ovemment with a critical ey�, that means I 17ate it. That's nonsense.
In manufacturing; this idea of critical inspectian is called "concinuous improvement." You look criticatly, identify
weakness, and correct thoughtfully to «�ake a better product. .A city that works far citizens continuausly
improves thraugh critical analysis.

what denton's landscape looks like. When my family came here in 1996, we knew most of the business owmers. I
went to schoal with their kids. The social fabric was very (ight because of that. Now, Denton is a city af investors
and chains and their emplayees, not entrepreneurs and business o���ners. That changes who we are as a city- far
worse in my opinion. That's what drave me �vith the communiry market. I want�d ta help make Dc:nton a city of'
owners again, not tenants and $13/HR employees. IMO a lot- maybe all- ofthe things ihat make Denton great
came froiY� people, not city hafl. The govemment isn't good at c�ming up with these ideas, f believe. The best
thin� they can do is get out aftl7z ��-ay and have fair ta� policies so that TGIFridays isn't treated differently than
