2017-272AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING THE SCHEDULE OF FEES CONTAINED IN ORDINANCE 2017-073 BY AMENDING THE PUBLIC HEARING NOTIFICATION FEE AS AUTHORIZED BY THE DENTON DEVELOPMENT CODE FOR THE CITY OF DENTON, TEXAS; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. WHEREAS, the City Council directed staff to implement recommendations to improve the City's public hearing notification practices; and WHEREAS, the cost for mailing public hearing notices, mailing courtesy postcards notices, and publication of legal notices in the newspaper have increased; and WHEREAS, the City Council has considered an increase in public hearing notification fees; and has determined that having the applicant pay the actual cost for all notifications is in the public interest and benefits the citizens of the City of Denton; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 11 The findings and recitations contained in the preamble of this ordinance are SECTION ... ... ...... - ------- incorporated herein by reference. SECTION 3. This ordinance shall repeal every prior ordinance in conflict herewith, but only insofar as the portion of such prior ordinance shall be in conflict; and as to all other sections of the ordinance not in direct conflict herewith, this ordinance shall be and is hereby made cumulative except as to such prior ordinances or portions thereof as are expressly repealed hereby, S:\Legal\Our Documents\Ordinances\17\Draft Fee Schedule Update Ordinance.doc SECTION 4. If any section, subsection, paragraph, sentence, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portion of this ordinance, and City Council of the City of Denton, Texas hereby declares it would have enacted such remaining portions despite any such invalidity. SECTION 5. This ordinance shall become effective on October 1, 2017.
