2017-283AN ORDINANCE OF THE CITY OF DENTON, TEXAS ESTABLISHING A SCHEDULE OF FEES FOR THE OPERATION OF STOKE DENTON ENTREPRENEUR CENTER FOR THE CITY'S INITIATIVE TO DIVERSIFY DENTON'S ECONOMY BY SUPPORTING ENTREPRENEURS AND FOSTERING EARLY-STAGE TECH AND TECH -ENABLED BUSINESSES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Denton has the authority under its Charter to manage its property through the adoption of user fees as reimbursement for the use of city - provided facilities or services; and WHEREAS, the City has a Commercial Lease Agreement with Rail Yard Partners, Ltd. to lease 9,216 square feet of office space located at 608 East Hickory, Suite 128, Denton, Texas to operate a space to provide support for entrepreneurs as they start, build, and grow their companies, especially in the field of early-stage tech and tech -enabled business ("Stoke Denton" or "Entrepreneurial Center"); and WHEREAS, the public purpose of this initiative is to diversify Denton's economy by creating knowledge-based, high -paying jobs and developing a startup ecosystem that supports and expands the tax base, and Stoke is a tangible way for the City to further this public purpose; and WHEREAS, the City desires to manage Stoke Denton Entrepreneur Center and to charge user fees for the use of Stoke Denton Entrepreneur Center and related services as detailed herein ("Fees"); and WHEREAS, the Fees reflect a fair approximation of the cost of using the City facilities and are not excessive in relation to the costs incurred by the City; and WHEREAS, the City Council finds that the Fees imposed by this ordinance are in the public interest in order to promote the growth of startups and tech/tech-enabled businesses within the City of Denton, Texas; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1,. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference. SECTION 2. The following fee schedule is hereby adopted for public use of the Stoke Denton Entrepreneur Center: Fees: 1 key card •-•# # to $50/month - # program o Up to $50/month ment# program $75/month virtual membership • $20/day drop-in coworking • $150/month coworking membership • $250/month dedicated desk • $900/month pod of 4 dedicated desks • $550-$900/month office • $150/hour event space for non-members • $75/hour event space for members • $40/hour conference rooms for non-members • 10% of the amount due as a late fee • Return check charges of up to $30 SECTION 3., This ordinance shall repeal every prior ordinance in conflict herewith, but only insofar as the portion of such prior ordinance shall be in conflict; and as to all other sections of the ordinance not in direct conflict herewith, this ordinance shall be and is hereby made cumulative except as to such prior ordinances or portions thereof as are expressly repealed hereby. SECTION 4. If any section, subsection, paragraph, sentence, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portion of this ordinance, and City Council of the City of Denton, Texas hereby declares it would have enacted such remaining portions despite any such invalidity.
