WHEREAS, on June 20, 2000, by Ordinance 2000-216 the City Council approved a
Detailed Plan for residential uses on 253.36 acres located in the PD-170, PD-172 and PD 176
Zoning District, which specifically excluded Tracts 1 and 3, as shown on the Cancept Plan
appraved by Ordinance 99-367; and
WHEREAS, on July 25, 2018, the Planning and Zoning Commissian conducted a public
hearing as required by law, and recammend approval of the requested Detailed Plan with
conditions [4-0]; and
WHEREAS, the City Council likewise held a public hearing on August 21, 2018 and found
that the Detailed Plan is consistent with the approved Concept Plan for PD-176 and is consistent
with the Denton Plan and the Development Code; NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HE BY ORDAINS:
SECTIONw 1,. The Detail Plan for the subject Property, lacated within Tract 3 af Planned
Development District 176 (PD-176), is attached hereto and incorporated herein by reference as
Exhibit B, and is hereby approved, subject to the following canditions:
1. Na exterior lighting on the building shall face a single-family residential use, or if such
lighting is proposed, it shall be screened fram view of adjaining residential properties. A
photometric plan shall be provided with the building permit applicatian demanstrating
compliance with the DDC's site lighting requirements in Section 35.13.12,
2. Due to the proximity of this lacation to single-family residences, the majority of the PD
being residential, and the lack of signage regulations in the PD, the project shall comply
with the Code of Ordinances sign requirements far non-residential districts as well as the
following limitations:
a. No illuminated wall signs may face an adjoining single-family use,
3. The height of the proposed masanry screening wall shall be 8 feet.
4. Hours of operation shall be limited to 7:00 a.m. to 9:00 p,m. daily,
5. The centralized vacuum motor shall be interior to the structure and sound-proofed ta limit
noise to surraunding properties.
SECTION 2. The approved site plan, landscape plan, and building elevations provided
in the Detail Plan specify the fallowing:
The detail plan specifies the total building square footage at approximately 4,478 square
feet, with a maximum height af 30 feet.
2, The detail plan specifies total of 5 parking spaces and 25 vacuum stalls, 5 of which are
intended for future construction.
The detail plan specifies approximately 20-foot wide landscape buffer containing
existing trees, 8 new tree plantings, and a masanry wall as described in the conditions
set forth in Section 1 af this Ordinance.
4. The detail plan specifies a total af 27 new trees and 33 new shrubs to be planted in
accordance with the Landscape Plan.
5, The detail plan specifies a maximum lot caverage of 60.7%, once the five future vacuum
stalls are pravided.
SECTION 3. The provisions of this ordinance, as they apply to the 2.13 acres shown in
the Detail Plan herein approved, shall govern and contral aver any canflicting provisions of
Ordinance No. 99-367, but all pravisions af Ordinance No. 99-367, as they apply ta that remaining
portion of the district not herein amended, shall continue in force and effect, and shall apply to the
remainder of said district.

SECTION 5. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of the
provisions or applications, and to this end the provisions of this ordinance are severable.
SECTION 6. Any person violating any provision of this ordinance shall, upon conviction,
be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense.
SECTION 7. In compliance with Section 2.09(c) of the Denton Charter, this ordinance
shall become effective fourteen (14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-
Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the
date of its passage.

Site Location and Legal Description
Being 2.167 acres of land located in the Berry Merchant Survey, Abstract No. 800, Denton County,
Texas, being a portion of Tract 1 described in the deed to CDI 2499, LLC., recorded in County Clerk's No.
2017-63521, Deed Records, Denton County, Texas. Said 2.167 acres of land being more particularly
described as follows:
BEGINNING at an 1/2" iron rod stamped "Beasley RPLS 6066" set at the southeast corner of said Tract
1, said iron rod set lying in the north line of Wheeler Ridge, Phase 4, an addition to the City of Denton,
Denton County Texas, recorded in Cabinet W, Slide 901-903, Plat Records, Denton County, Texas, from
which an 1/2" iron rod found at the northeast corner of said Phase 4 bears N89°42'44"W 175.22 feet, said
iron rod set being the southwest corner of a tract of land described in the deed to The State Of Texas,
